Foreign terrorist fighters represent one of the powerful threats to the security of states and humanity in the 21st century. Besides participating in the actions of the Islamic State, they also pose a significant danger when they return to their countries of origin to recruit new volunteers, radicalize local communities and actively partake in terrorist attacks. So as to increase the effectiveness of the fight against terrorism, states and international organizations (the EU, Council of Europe, UN) have been moving in the direction of criminalizing all manifestations of terrorist activity. The paper strives to achieve the following: providing a definition of foreign terrorist fighters; proffering a legal qualification of travel abroad undertaken by Polish citizens for terrorist purposes by reference to selected provisions of the Polish Criminal Code; conducting an analysis of the provisions of EU Directive of 15 March 2017 on combating terrorism against the backdrop of the criminalization of the activity of foreign terrorist fighters; comparing the Polish and European criminal legislations within the pertinent scope. De lege ferenda comments will be offered by means of a summary.

In the 20th century, the perception and quality of political crimes underwent significant changes, which led to the creation of constitutional law. Act III of 1921 was the first piece of legislation that substantially tightened the scope of crime against the state, but because of precisely defined offences and related judicial practice, it could be avoided that deeds, which essentially fall within the scope of the exercise of fundamental rights, could fall under the Act. The following significant criminal law, which strengthened existing provisions to an extent that provided a good basis for the establishment of a later Communist dictatorship, was brought about by the persistence of Soviet presence following the World War II.

This paper tackles the problem of death penalty in Belarus which is a notyetanalyzed topic in the Polish literature. This problem seems to be important since Belarus remains the only European country where death sentences are imposed and carried out. The author describes the law regulations and possible results included in the Criminal Code and the Criminal Enforcement Code of the Republic of Belarus. In particular, emphasized are the assumptions against the international law, very wide scope of adjudication, inhumane way of execution, and limited access to information. Some possible actions undertaken to amend the death penalty law in Belarus are also discussed.

The provision of Article 53(1) of the Polish Criminal Code sets out directives that guide the court in deciding on the severity of the penalty in each individual act of sentencing. These directives are referred to as “general directives of judicial sentencing”. Four such directives are generally derived from this provision: the directive of the degree of culpability, the directive of the degree of social harm, the directive of individual (specific) prevention and the directive of general positive prevention. The amending act of 7 July 2022 introduced new wording to Article 53(1) of the Criminal Code. Changes were also made to Article 85a of the Criminal Code, which sets out general directives of judicial sentencing in the case of aggregate penalties. The author takes a critical look at the changes introduced in the respective provisions. The aim of this examination is to determine the extent to which the content of the general directives of judicial sentencing, as defined in the amending act of 7 July 2022, differs from their previous formulation, and to what extent the introduced amendments can be considered justified.

The aim of this article is to present the development of Polish and EU regulations on child pornography. Four amendments to the Polish Criminal Code, which were passed with the purpose of effecting tools to protect children, are strictly connected with the changes in the EU law – from the Green Paper of 1996 to Directive No. 2011/92/EU of the European Parliament and of the Council. The paper presents the current definition of child pornography, the understanding of which has evolved since the 90s. Changes in the EU law and the Polish regulations can be divided into three stages – first attempts at specifying instruments on child protection, widening the scope of the definition of child pornography and stiffening sanctions for child pornography. Amendments tothe Polish Criminal Code reflect the actual tendency to adopt more precise tools to prevent children from sexual exploitation. However, it does not lead to desired effects. Child pornography is a growing problem due to the relentless technological development but current regulations in their casuistic form are not a suitable tool to combat sexual exploitation of children.

The article concerns two legal and linguistic opinions which are a legal analysis of the article 158 item 1 of the Criminal Code. The authors claim that this regulation (its wording) has been a considerable divergence ever since the Criminal Code entered into force in 1997. Legally, it means the divergence between what the legislator said and what he possibly intended to say. According to the authors, the legislator’s communicative intention was not implemented in this case. The reason for this was the fact that the analized fragment (the article 158 item 1) of the legal text (the current Criminal Code in Poland), which is an important tool for social impact, does not meet the demands made for legal texts: clarity, comprehension, and explicitness. The divergence shown in the article is associated with the legislator’s use of the pronoun “which/who” and the phrase “the man is exposed to occurrence”. Morover, the analysis of the article 158 item 1 of the Criminal Code conducted by the authors contains clues. They allow this regulation to be drafted in such a way as to reflect the intentions of the legislator.

Opis:
The article analyses the rights and duties of a social representative in criminal proceedings (article 90 Code of Criminal Procedure). Participation in court proceedings may be declared, before the commencement of judicial examination, by a representative of a community organisation, if there is a need to defend a social interest or an important individual interest within the statutory purposes of such an organisation, especially in matters pertaining to the protection of human rights and freedoms. The representative of a community organisation who has been admitted to participate in court proceedings may participate in the trial, express their points of view and make statements in writing. The court shall admit a representative of a community organisation if it finds this to be in the interests of justice. This person shall not be allowed to ask questions to person questioned by the court, he has no right to make a complaint with the court, can`t submit motions for evidence and are not entitled to participate in a session or in an investigation. The author emphasizes the importance of participation by the citizenry in the administration of justice principle and the right to a fair and public hearing of his case. In article they were also discussed old draft bills in the position of social representative in criminal cases, and in particular the advantages and disadvantages of amending article 90 c.c.p. Amendment of 10 June 2016. The author argues that the changing of position will not increase the participation of the public in the proceedings, because the legislature did not admit procedural rights.
