Introduction: The article deals with civil runtime requirements for the Treasurу of the Russian Federation for the unlawful actions of preliminarу investigation, prosecution and trial. Objective: To analуze the institution of protection of rights and legitimate interests of citizens and organizations in the course of the investigation, consideration and resolution of cases in the judicial and administrative authorities, as well as the Institute for compensation for damage caused bу bodies of inquirу, preliminarу investigation, the police, prosecutors and courts in the implementation of state and municipal functions. Methods: When writing this article the author used the following methods: general scientific dialectical analуsis and sуnthesis, induction and deduction, abstraction and concretization, formal logic, comparative legal, sуstem, technical and legal. Results: The author analуzes the legal regulation and the procedure for compensation for damage caused bу unlawful actions (inaction) of inquest, preliminarу investigation, prosecution and trial. Particular attention is given to a subject that meets the relevant requirements, and which is obliged to compensate the damage. It is noted that the use of recourse liabilitу to the official who committed offenses in the performance of public functions bу or on behalf of the Russian Federation does not exclude the possibilitу of bringing him to disciplinarу, administrative, criminal and other forms of legal liabilitу, the combination of which should be directed to the full satisfaction of both public interest and the interests of the victim. For the recoverу of funds bу the Treasurу of the Russian Federation on behalf of the Ministrу of Finance should act in the face of the Russian Federation Main Department of the Federal Treasurу. Execution of judicial decisions at the expense of the appropriations provided for this purpose the law (decision) on the budget. Conclusion: civil legal regime of propertу claims against the Treasurу of the Russian Federation, a subject of the Russian Federation, the municipalitу is interdisciplinarу and consists of (1) a public law regime mediated bу the rules of budgetarу law (Articles 158, 242.2 BC Code) and legislation on enforcement proceedings, and (2) the civil law (Articles 125, 170, 1071 of the Civil Code). The latter is expressed in a civil law features a set of reimbursement (compensation) of the harm caused to public legal education.

Opis:
The energy sector is a strategic industry of each state. Energy industry is one of the most important regulated fields at the EU level and a crucial direction of cooperation between the EU and Ukraine. EU legislation, primarily directives and regulations from the Third Energy Package, prescribe requirements in respect of the legal status of national regulatory authorities in the fields of energy and natural gas. Ukraine, as a full-fledged member of the Energy Community, as well as in line with the EU‒Ukraine Association Agreement, shall institute laws and regulations necessary for the implementation of those requirements. In particular, EU legislation stipulates requirements with regard to the independence of national regulatory authorities from other state authorities during the exercise of their regulatory powers. In recent years, Ukrainian public authorities have undertaken steps to develop and approve a legal framework in order to implement the requirements of EU energy legislation, in particular those related to the legal status of national regulatory authorities. The approval of the Law of Ukraine on the National Energy and Communal Services Regulatory Commission in 2016 was one of the critical achievements in this direction. However, the new Law has not solved the problem of the constitutional legal status of the energy regulator. The Constitution of Ukraine’s provisions specifying the powers of the President of Ukraine and the Verkhovna Rada of Ukraine as against permanent independent regulatory authorities (e.g., pertaining to the establishment, appointment and dismissal of members, accountability) shall be amended in order to bolster the principle of independence of national regulatory authorities in the energy sector as prescribed by EU legislation.

Opis:
The purpose of this article is to analyse and describe fundamental individual rights in relation to the Constitution of Sweden and New Zealand. Basic human rights include the right to dignity, right to liberty and the right to equality. Everyone is equally entitled regardless of origin, race, gender or education. Based on the analysis of several acts concerning the constitutional legislation of both countries it is evident that there is a lack of uniformity the nature of these have been complex and difficult to convey. Concerning Sweden, the Constitution consists of four acts in which the act of government includes standards governing and representing protection of the rights a liberty of a citizen. Constitutional legislation of New Zealand is more complicated because it consists of the Treaty of Waitangi 1840, The New Zealand Bill of Rights Act 1990, numerous laws, statutes setting up by the New Zealand Parliament as well as numerous constitutional customs, which may constitute legal standards and translate into precedent acts of courts. Despite the daily violation of rights in both Sweden and New Zealand, the complex legal systems protect and secure the rights of the people in their countries by introducing a series of laws and other regulations. The government of both countries, as well as public authority and other non-governmental organisations do their best to ensure they are respected and not violated. It should be noted that both Sweden and New Zealand have proven to comply with the obligations imposed on them under their national and international obligations with some undoubtable success, with generally well accepted principles in the whole civilised world.

The principle of state liability has been widely recognised in 20th century and codified in certain jurisdictions. English law, however, has been traditionally reluctant to recognise the liability of Crown distinct from the of its servants. According to the long-standing principle of rule of law, servants of the Crown should be liable for torts committed in their official capacity just as individuals. The principle has been allegedly designed to protect the individuals from arbitrary decisions of public authorities, which fall in their actions under jurisdiction of common courts. It was not until the advance of Crown Proceedings Act 1974 when the Crown took material liability for torts committed by its servants. The nature of tortious liability of the public bodies, however, remained peculiar. The aim of this article is to indicate that the underlying concept of individual liability of servants, once designed to protect the individuals, now restricts the scope of civil liability of public bodies in English law.

The legal status of the Pridnestrovian Moldavian Republic, which declared its independence in 1990, since that time has unchangingly remained ambiguous. The state has factually existed for almost thirty years so far, although it has not hitherto been recognised by any member of the international community. Its status from the constitutional law viewpoint is contradictory to the one analysed in the light of the international law, according to which Transnistria still formally remains a Moldavian autonomous region of a special status. This paper, being a part of the wider research carried out over Transnistria’s legal status, aims at establishing its primary political system’s grounds. Therefore, it comprises the analysis of the origin and development of Transnistrian first independent basic law, which appeared to be the foundation of the abovementioned solutions. The paper undertakes an attempt to not only analyse, but also evaluate the political system’s primary principles and development of Transnistria as a newly created state in the first years of its functioning. The subject of the work is particularly focused on the shape and content of the first constitution of Transnistria of 1991, which bound during the first four years of the state’s independence till the presently binding constitution of 1995 entered into force, along with observing of how its functioning in practice shaped the constitutional and political reality.

The hereby paper takes up the analysis of the constitutional position of the Finnish parliament Eduskunta from the moment of its establishment and as a result of its development during the centuries, with a special attention paid to the present normative state and on the basis of the hitherto constitutional practice. It aims at deriving the origin and presenting the evolution of this authority at the Finnish lands, which in consequence leads to reliable conclusions in the scope of determining its current constitutional position in the system of the supreme state authorities of Finland. The subject of the paper focuses on the analysis of the beginnings of Eduskunta’s formation and Finnish parliamentarianism, its further evolution, current composition, internal structure, functions and competences presented on the basis of the exegesis of the provisions of the binding basic law of 1999 and the parliament’s rules of procedure. The constitutional principles referring to the parliament and the analysis of Eduskunta’s relations with the other supreme state authorities, which determine the state’s form of government, seem to be of particular significance in this context, as they contribute to a more precise definition of Eduskunta’s constitutional position, as well as to pointing out its originality and dissimilarity regarding other contemporary democratic states.

In the present article, the author presents the origin of the draft law, prepared by prof. W. Czachórski, on the civil liability of state and self-government entities for acts of political power (imperium) of their public officers, as well as the reasons for the publication of the proposal followed by an article in 1946 just after the end of the World War II. Another question that has been discussed in the article is the correctness of implementation into Polish private law of a public concept of state liability adopted in Article 121 of the 1921 Constitution (being merely a declaration not a binding norm). The article reviews the opinions of scholars concerning public character and scope of constitutional concept of state liability. An attempt also was made to determine whether the drafted rules on compensation by the state for damages caused by its officers were adequately constructed within the law of obligations. The basic aim of the article is to provide an answer to the question, whether the proposed general liability rule was based on principle of the fault of the state for the damage caused, vicarious liability for the servant’s acts or whether it was based on another non-fault principle explaining state liability for the detrimental acts committed by the state officers. The author discusses possible conditions of state liability in 1946 draft law, as well as doubts expressed by legal doctrine in this matter. Furthermore, the work contains a review of judicial decisions and scholarly opinions with respect to the well-established and undisputed state liability for damages caused by public officers exercising commercial tasks (dominium). The article includes a review of the different pre-war binding rules on that issue, based on French, German, Austrian and Polish law, as well as a review of the judicial interpretation of those civil law rules binding in this respect during the Second Republic of Poland (1918–1939). The goal was to point out the dynamic character of the interpretation delivered by courts, with special reference to a new concept of organizational fault (faute de service) developed by the French Conseil d’Etat. The article also discusses proposed concept of state co-liability with the officer in terms of joint liability or complementary subsidiary non-fault state liability, resulting from the principle of justice or social solidarity. What is more, the article highlights another interesting issues concerning the question whether the relationship between state and its officer was meant to be based on the traditional solidarity of debtors or whether it represented another legal concept adopted in favour of the injured party. Finally, the present work characterizes the influence of the draft decree on the Act of 15 November 1956 on the liability of the state for damages caused by state agents and on the corresponding provisions of the 1964 Polish Civil Code, both acts adopted during the People’s Republic of Poland. The aim was to indicate important differences between the 1946 draft law and 1956 Law which was enacted under strong influence of new concepts of the socialist state liability for acts of its employees (agents), not only for officers. In the end, the article presents the potential course of the development of the Polish law in case the drafted law would be adopted.

This article discusses one of the solutions adopted in the nuclear energy law, which contributes to the reduction of the investment risk. It is the so-called pre-licensing which involves the assessment of key site or technical factors at the pre-investment stage in order to avoid possible problems at the stage of investment implementation. The author analyses the Polish solutions in the context of the general concept of pre-licensing, with particular respect to: the nature of pre-licensing legal instruments (opinions), the scope and requirements of the application for an opinion, and the binding force of pre-licensing acts. The practical significance of this issue is all the greater considering governmental plans to implement nuclear power in Poland and in the light of recent activities of private entities as to the construction of smaller nuclear power plants. In the latter case, prelicensing instruments are already being exercised in practice.

Opis:
Possible change of religious regulations of the Constitution should take place in cooperation with churches and world-wide organizations. The legislator limits Poland’s international obligations to protect freedom and human rights in religious matters. The Concordat of 1997 is also a limitation. At present there is an unfavorable political situation for liberal changes. The most important changes should be to increase the protection of non-believers and philosophical organizations. The neutrality of public authorities in religious matters must also be better guaranteed. The beginning of the constitutional debate on religious issues, however, risks the change for the worse. This debate does not start.
