Regulatory authorities are a relatively new phenomenon in the system of Polish public administration, which is still an area of vivid discussion, especially among representatives of administrative law theory. The aim of this paper is to study regulatory authorities through the prism of political and legal doctrines that determine certain normative solutions, and to outline some aspects of the problem from a comparative perspective, which seems valuable for a more complete understanding of the essence of the discussed institutions. The article begins with general comments on regulators in the Polish legal system. Subsequent passages of the text were devoted to presentation of the discussed institution in the context of some political and legal doctrines, as well as comparative and legal considerations.

In the Muslim Religious Union there is a dispute over the establishment of the Mufti office. From 2016, a schism has arisen in this religious community. This situation is a source of challenges for the authorities of the state administration and the courts in the application of a number of principles of the 1997 Constitution of the Republic of Poland. There are principles: autonomy and independence of religious associations in their scope, legalism, legal certainty or confidence of citizens in the state and their rights. The legal status of the Union is based on anachronistic legislation: the Act of April 21, 1936, on the relationship of the State to the Muslim Religious Union in the Republic of Poland and the statute approved by the Council of Ministers by way of an ordinance of August 26, 1936. In practice, the Muslim Religious Association applies the 2009 internal statute. Religious authorities and courts try to remain neutral and not interfere in the internal dispute in the Muslim Religious Union. This is in line with the standards stemming from the judgments of the European Court of Human Rights and the constitutional principle of autonomy and independence of religious associations in their own rig However, there is a state of legal uncertainty. It is urgent to repeal the Act and the Statute of 1936. This can be done either by a Constitutional Court decision or by passing a new law on the basis of the Muslim Religious Union Agreement with the Council of Ministers.

Opis:
The rule of law, human rights, and democracy are the three pillars of functioning of the European states. The concept of the rule of law is very deeply rooted in the idea of the European integration since 1949 when the Council of Europe was established. The rule of law is understood as: respect for the separation of powers, duty for the executive power to respect law, observance of the rule of the compliance with the law, respect for legal certainty and the principle of res iudicata, maintenance of judicial control of the executive power, exercise of the right to court ,guarantee of a fair trial and existence of an effective appeals remedy. In many countries rule of law are in danger. That is why European safeguards plays an important role.European safeguards means different instruments in form of monitoring reports of the Council of Europe institutions , opinion of the Venice Commission, fact finding missions etc. which creates a critical illustration of the situation of the member states. The EU law creates the legal procedures based on the art. 7 of the EU Treaty as well as on the art. 258 of the Treaty of the Functioning of the EU which effectively can stop rule of law backsliding in the EU countries. On the side of the member states of the EU the preliminary ruling procedure can effectively stopped the violation of the EU law and principles. European safeguards are not limited to the European institutions. The UN reports on democracy, rule of law and human rights contribute fundamentally to the proper implementation of these principles. In order to respect fully the rule of law, democracy and human rights a closer cooperation and a better coherence is needed. The way how the violation of the rule of law, democracy and human rights were limited in Poland shows the importance and effectiveness of the European the European safeguards.

The principle of independence of the state and the Church is one of the fundamental norms of religious relations in contemporary Poland. It is permanently embedded in the Polish legal system. It appears in the Constitution of the Republic of Poland of 1997 and in the Concordat of 1993. It was also expressed in the Act of 1989 on Guarantees of Freedom of Conscience and Religion and in individual denominational acts of 1989‒1997. On the other hand, this principle is contradicted by the denominational laws of 1928 and 1936. The principle of independence of the state and religious associations appears in Polish law together with the principle of autonomy and cooperation of these entities. Guaranteeing the principle of independence of the state and religious associations is especially the result of the negative experiences of the state’s denominational policy in the years 1944‒1989. In the field of juridization of the principle of independence of the state and the Church, there are clear similarities between the relevant provisions of the Constitution of the Republic of Poland and the Polish Concordat. Certain legislative standardization is also present in the denominational acts of 1989‒1997. Appropriate models were provided primarily by the Act of 1989 on the attitude of the State to the Catholic Church in the Republic of Poland. From 1989, the Polish legislator put emphasis primarily on guaranteeing the rights of religious communities towards the state. Paradoxically, among the religious associations with an individual statutory regulation from 1989‒1997, few, although the most far-reaching, restrictions on independence (self-government) in relations with the state were provided for the Catholic Church. However, the independence of the state from the Church was not sufficiently ensured.
