Opis:
Local food systems (LFS) is not a legal term, although it is used in EU documents, and legal instruments supporting their development can be indicated in EU, and national legal orders. Based on the analysis and comparison of these instruments, extracted from Italian, French, Polish, American, and EU legislation, this study aims to formulate proposals for possible and beneficial solutions to be introduced into national and EU legislation, aimed at supporting LFS. The proposal includes the introduction at the EU level, along with the local food labelling system, of the LFS definition supporting small farmers who run agricultural production with the use of environmentally friendly, sustainable methods. In the field of food law, it is necessary to articulate the LFS requirements more clearly so that they are better understood by farmers. In national legislation, the instruments to be implemented involve the possibility for the farmer to carry out the activity of processing and selling his products directly to consumers and local retailers as part of his privileged agricultural status, at the same time obliging municipalities to create farmers’ markets, and supporting agriculture in the urban and peri-urban areas. Other necessary instruments include the requirement to offer local products in gastronomy by public institutions, hotels, restaurants and agritourism, and implementation of appropriate solutions in the public procurement law encouraging local food supplies.

The article presents the basic legal mechanisms shaping modern agriculture through the Rural Development Programme 2014−2020. It discusses the main problems of juridical character, which could be an obstacle in the use of financial resources by farmers. It also underlines the importance of the existing support mechanisms due to the size of allocated grants for Poland. At the same time it draws attention to the possible CAP reform after 2020 and the resulting possible restrictions in financing the Community policy in agriculture.

The subject of the study is the external trade relations of the EU as a subject of international law, concluded with organisations of states and individual countries within the framework of the EU Common Commercial Policy. The aim of the study is to assess the provisions of the EU-Mercosur Agreement made in terms of the choice of legal instruments for the association of the two regions in terms of sustainable socio-economic growth and trade, while ensuring environmental protection and consumer food safety. The essential considerations are preceded by a demonstration of the evolutionary changes in the approach to food safety and environmental protection in the EU’s external trade agreements and Mercosur’s internal regulations. The analysis carried out mandates a number of conclusions relating to the two chapters of the agreement governing food safety of imported food products and environmental protection. The norms as negotiated in the agreement do not implement the objective of sustainable development and should be renegotiated. The exclusion of the precautionary principle only confirms the thesis that has been put forward.

Protection of jobs has become one priority aim of the legislator during the crisis caused by the SARS-CoV-2 coronavirus pandemic. In the justification of the draft Act of 2 March 2020 on special solutions relating to the prevention, neutralisation, and combating of COVID-19 and other contagious diseases and the ensuing crisis situations (COVID Act), it was emphasized that the aid mechanisms introduced in the Act were supposed to prevent mass collective redundancies. And although the legislator tried to preserve sustainable employment during the COVID crisis, only a part of the introduced legal provisions offered a guarantee of work to employees. This article aims to provide an overview and assessment of the aid mechanisms implemented by the Polish legislator to protect jobs during the COVID crisis. The anti-crisis activities of the legislator, intended to preserve sustainable employment, can be divided into indirect and direct measures. An analysis was carried out taking into account the above division. Based on the analysis, reflections are formulated on the effectiveness of the implemented aid mechanisms. Finally, conclusions for the future are offered.

Domestic violence and other forms of gender-based violence remain a serious problem of Czech society. In Czechia, there is no definition of violence against women or gender-based violence against women, nor ‘gender’ enshrined in law or established in judicial practice. Similarly, no legislation, nor jurisprudence, acknowledges gender-based violence as a form of discrimination or violation of the principle of equality. The paper focuses on gender-based violence in the Czech Republic. It aims at mapping the current situation, identifying weaknesses in legislation as well as in practice and proposing some effective steps for the future. This paper aims at providing a broader view on the state of affairs in the field of gender based violence in order to keep the debate on this very important but neglected topic, alive. This paper draws a conclusion that in Czechia, a structural change is needed. Not only solid and robust legislation aimed at better protection of victims of gender-based violence should be adopted but also a change of mindset in the legal practice and judiciary should occur. EU law with some proposed changes could help a lot to make the abovementioned changes possible.

At the current stage of the European integration, the problems occurring as a result of the coexistence of the European private law, including contract law, and the national legal systems, find their origins in the differences in legal concepts underlying these legal orders, defined by different goals and hierarchies of values. In European private law, the tendency to protect the weaker party of the contractual relationship is stronger than in national legal systems, or at least some of them. This results from the fact that the European legislator confers particular importance to the consumer protection, employment, public health and access to the public utility services (transport, telecommunications and Internet services, energy). In these very fields, European law limits the parties’ formal autonomy in order to guarantee their actual autonomy. The regulatory functions of the European law determine the content of legal relationships in order to compensate the “deficiency of equality” by strengthening the weaker party and limiting the professional’s rights. By these means a perspective based on the distributive axiology rather than on the commutative function typical for the civilistic relationships is being introduced into private law. This trend is reflected in the EU Court of Justice case-law. The abovementioned tendencies clearly correspond with the ongoing evolution of the national systems of private law under the influence of European law. In other words, the impact of the European law is getting stronger, and this not only by way of introducing new regulations, but also due to the alteration of the methods of legal interpretation and applying the law, by putting emphasis on the wider context of legal mechanisms. This process leads more and more often to consequences, which legal scholars use to characterize as a “publicization” or “constitutionalisation” of the private law.
