The result of the codification works that were carried out in the years 1960-1971 on substantive misdemeanour law in Poland was a Code on Misdemeanours of 1971. The measures created in this Code were strongly influenced by the idea of misdemeanours polarization and stratification of responsibilities. According to this idea, severe repression was supposed to be limited to the most serious misdemeanours. Towards other offenders progressive leniency was provided, with non-criminal means replacing them. Under influence of political factors the character of general part of Code on Misdemeanours was determined by provisions which were introduced aimed at severe treatment of serious offenders. Also the specific part was shaped in the repressive spirit. The conditions to realise the assumptions accepted by codifiers of the substantive misdemeanour law were created only after the fall of communist system in Poland, when in 1990 the adjudicating boards were cut off from the influence of Ministry of Internal Affairs and placed in the structures of the Ministry of Justice.

The purpose of this article is to analyze the ideological basis of concepts that underpinned the establishment of the Codification Commission by virtue of the Act of 3 June 1919 and to assess its position within the system of authorities of the Second Republic of Poland. The author has found that the issues around shaping the relations of the Codification Commission with the Government and the Sejm have been covered in literature of the subject in a one-sided manner. Authors who have devoted their attention to the issue of autonomy of the Codification Commission formulated their evaluations based on the interpretation of the regulations in the drafts of the Act that established the Commission, as well as on their subsequent application that enabled the restriction of this autonomy. They did not, however, sufficiently account for the ideological declarations, thus in fact rejecting the deputies’ assertions of their striving to ensure “complete autonomy and self-sufficiency” of the Codification Commission, and the Government’s affirmations that it did not aim to “subject” the Commission to its control. Meanwhile, the author’s intention is to show that there was a widespread consensus at the time, especially at the Sejm, which sovereignly decided on the wording of the Act on the Codification Commission, that deputies had adopted a law that sufficiently protected the autonomous status of the Commission and its apolitical nature.

This paper emphasises that Europeanisation of law contributes greatly to the phenomenon of decodification. The impact of European legislation on the position of the civil code as the main source of private law is clearly visible in the case of directly effective regulations. Also, implementation of directives can (and often does) lead to the creation of legislation regulating civil law matters, yet separate from the civil code. The Polish experience with implementation of directives concerning consumers protection makes for a good example. Regulation of timeshare contracts completely outside the civil code is – according to the Polish doctrine – a result of difficulties with integrating this particular provision into the codification of private law. If such difficulties are inevitable, so is also progressing decodification of civil law due to its advancing harmonization on the European level.

The article presents the challenges and difficulties faced by lawyers of the Second Polish Republic in the field of lawmaking. The experience of many years of partitions, the influence of foreign legal traditions, and the vocabulary adopted from foreign law were a problem in the process of preparing legislative projects. Actions taken by lawyers and linguists allowed to standardize the Polish legal language. As a result, the terminology and legislative techniques from one hundred years ago are still used today.

A few months before the suppression of the Hungarian Revolution in August 1849, Emperor Franz Joseph issued the Constitution of Olmütz, which suspended the Hungarian constitutional order. After 1850, the Viennese Government aimed to unify the legal system in the whole empire, and as part of the process, many Austrian legal norms were imposed by royal decrees upon the Hungarian territories. This led to fundamental changes in the country’s legal system (the customary law as “law in action” took precedence up until 1848), even though it happened unconstitutionally. The worsening state of affairs and the defeat in the Austro-Sardinian War led the Emperor to promulgate a new constitution which became known as the October Diploma in 1860. Accordingly, Hungary regained its former constitutional status, but Franz Joseph ordered the newly reinstated chief justice to assemble a council that should debate over the most pressing issues regarding the administration of justice. There, the most influential lawyers proposed that the Hungarian laws shall be restored – albeit with several compromises. Most members agreed that an absolute and immediate repeal of every Austrian legal norm would certainly violate the rights of the citizens. Therefore, even though this committee did not accept the validity of these laws, the majority of its members argued that some of them must remain in effect until the Parliament will reconvene. Consequently, the Austrian legal norms as “law in books” deeply influenced the “law in action” in Hungary for the years to come.

The article attempts to summarise the process of codifying the Ukrainian language in the first half of the 19th century. It covers the most important reference grammars of that time, presenting them in the context of the sociopolitical situation of a Ukraine divided between the Austrian and Russian Empires. The article describes the work of linguists and researchers who emphasized the autonomy of the language spoken in the Ukraine in contrary to the common trend which treated this ethnolect as a dialect of Polish or Russian. The presented reference grammars are a rich source of information about the Ukrainian language itself (including its regional varieties), as well as other forms of communication used at the beginning of the 19th century, such as iazychie. These works were a milestone towards the forming of the modern Ukrainian language and nation.

Opis:
The article analyses the rights and duties of a social representative in criminal proceedings (article 90 Code of Criminal Procedure). Participation in court proceedings may be declared, before the commencement of judicial examination, by a representative of a community organisation, if there is a need to defend a social interest or an important individual interest within the statutory purposes of such an organisation, especially in matters pertaining to the protection of human rights and freedoms. The representative of a community organisation who has been admitted to participate in court proceedings may participate in the trial, express their points of view and make statements in writing. The court shall admit a representative of a community organisation if it finds this to be in the interests of justice. This person shall not be allowed to ask questions to person questioned by the court, he has no right to make a complaint with the court, can`t submit motions for evidence and are not entitled to participate in a session or in an investigation. The author emphasizes the importance of participation by the citizenry in the administration of justice principle and the right to a fair and public hearing of his case. In article they were also discussed old draft bills in the position of social representative in criminal cases, and in particular the advantages and disadvantages of amending article 90 c.c.p. Amendment of 10 June 2016. The author argues that the changing of position will not increase the participation of the public in the proceedings, because the legislature did not admit procedural rights.

The rise of modern international law as an autonomous scientific discipline in the early 1870s can be considered the culmination of multiple legal and extra-legal processes which trace their origins back to much earlier in the century. Several decades before the founders of the Institut de Droit International declared themselves the “legal conscience of the civilized world”, other societal groups had already expressed profound disaffection with the existing law of nations, which they viewed as inherently insufficient to guarantee lasting stability amongst civilized states. The conferences of the “Friends of Peace”, held between 1843 and 1851 in several European cities, featured many jurists who routinely employed legal modes of reasoning to communicate and advance legalistic objectives such as mandatory international adjudication and the codification of international law.

This article analyses the scope of the coercion of a state as a ground for invalidating a treaty under international law. The coercion of a representative of a state (i.e. duress) is also addressed. The paper presents the notion and the legal limitations of the use of force under international law. It also discusses duress and coercion of a state as grounds for treaty invalidity in an historical perspective. The main purpose of the paper, however, is to present the scope of the concept of the coercion of a state under the 1969 Vienna Convention on the Law of Treaties (VCLT). The article comments on the phrase of Article 52 of the VCLT on the invalidity of treaties that refers to the rules of international law, as embodied in the UN Charter, regarding the threat or use of force in concluding treaties. It considers whether the wording of VCLT articles on coercion as grounds for invalidating a treaty reflects customary rules of international law. The authors also consider a concept raised by certain developing states that coercion comprises not only the threat or use of force but also economic and political pressure. Finally, discussed are the procedures to invoke grounds for treaty invalidity applicable in the case of the coercion of a state.
