    The aim of the article is to show the challenges in scholarly attempts to conceptualize the phenomenon of irregular immigration. Although this type of migration has been of interest to scholars for several decades, it still requires in-depth analysis to better explain and understand its causes, scope, and consequences. The article attempts to clarify the nature of irregular immigration, indicating both the general ways of defining this phenomenon and the process of shaping it in socio-political reality since the end of the 19th century. The analysis reveals the internal diversity, dynamism, and ambiguity of this type of migration, which developed in parallel with the control instruments implemented by the states, aimed at enforcing increasingly complex immigration regulations conditioning the entry, stay and work of immigrants. The presented theoretical reflection on the complexity and the heterogeneity of irregular immigration is then confronted with the interpretation of this phenomenon in the EU immigration policy. Another important complement to these studies is to show the terminological challenges that have emerged in previous studies on irregular immigration. They are important both for the objectification of theoretical investigations and for an empirical analysis of this social phenomenon.

    This paper explores Australia’s history and background of migration and refugee policies and examines the possibilities of applying the Australian solutions in the European Union. It has often been assumed that the history of Australia’s migration and refugee policies and the solutions it has applied are not relevant for the European Union (although they are suffi cient, albeit controversial, in the case of Australia). In order to verify this assumption, fi rst the origin and the current rules of Australia’s migration policy are presented and described, and then the determinants of immigration to Australia are indicated. Next, the overall state of relations between the EU, its Member States, and Australian immigration matters is explored. The main research questions posed in this text concern the key points of Australia’s immigration policies and its determinants, as well as the current state of the EU’s and its Member States’ relationship with Australia with respect to the refugee crisis and immigration. The paper ends by offering conclusions with respect to the above.

    This article analyses carrier sanctions in light of Poland's membership of the European Union and its obligation to protect the EU's external borders. It offers an in-depth analysis of the scope of the carriers' obligations with regard to bringing third-country nationals to the Eastern external border of the European Union and explores ways how these obligations should be fulfilled correctly so that carriers are not obliged to pay administrative fines of as much as 3000-5000 euro per person. The research is based on an extensive review of the jurisprudence of Polish administrative courts and takes into account the specificity of this jurisprudence.
