The purpose of article is to present, analyse and evaluate the effective legal regulations concerning the extent and manner of passing information about surgical implantation of cells, tissues or an organ to the recipient of the graft. The prospective recipient of the graft should possess extensive knowledge concerning the suggested medical intervention by way of implantation of cells, tissues or an organ as well as data regarding the subsequent medical procedures that follow. Therefore, information obtained by the patient ought to be as exhaustive as possible. That is to say, it must contain any data that would enable the prospective recipient to make a reasonable decision whether to agree to the intervention or not while being fully aware of what they give their consent to and what might be expected. Information should be presented in a manner that is intelligible and comprehensive for the prospective recipient of transplant, which shall be assessed individually, on the basis of current intellectual abilities of the patient.

Introduction: As Polish society is in its majority Christian, the knowledge and attitudes presented by priests may have a tangible impact on Church mem-bers’ decisions concerning organ donation. Purpose: To evaluate the knowledge, attitudes, and decisions of priests of various Christian denomina-tions regarding organ transplants in Poland. Materials and methods: The paper presents the re-sults of a study carried out in the form of a question-naire survey of 86 priests. Survey participants in-cluded priests of 3 most common Christian denomi-nations in Poland: Catholic, Protestant and Eastern Orthodox. Results: Awareness of the current regulatory frame-work among the clergy is relatively low. Only a small percentage gave correct answers to questions about applicable laws regulating the matter of organ transplantation in Poland. Conclusions: Data gathered during the study implies a positive attitude among priests towards organ transplantation performed to save life and improve health. A vast majority of survey participants support the idea of transplantation. The problem is low awareness of existing documents and laws regulating organ transplantation.

On January 1, 2012, an amendment to the act on Patient Rights and the Ombudsman for Patient Rights was passed. The amendment introduced the concept of a medical event, defining legal bases for voivodeship commissions to adjudicate on medical events and setting regulations for establishing compensation and atonement in such cases. The commissions do not adjudicate on hospital staff’s fault in a medical event. The provisions of the act on Patient Rights and the Ombudsman for Patient Rights determined a fee for an application concerning adjudication for a medical event; however, the provisions do not allow for exemptions from this fee. The provisions are imprecise and obscure. Despite the commissions’ obligation to issue a statement on a medical event or its absence within 4 months from the moment of application, the provisions hamper the chances of obtaining financial compensation for damage suffered as a result of medical events.
