    The phrase ‘libel tourism’ appeared for the first time in 1990, when a Hollywood star ArnoldSchwarzenegger sued American author Wendy Leigh for his unauthorized biography in an English court[Rayner 2010; Sanchez 2011]. A number of recent cases included wealthy libel tourists such as NicoleKidman, David Hasselhoff, Roman Polański, Jennifer Lopez, Marc Anthony, Britney Spears, Tiger Woodsand Cameron Diaz. Since 2005, the number of libel actions in the High Court has doubled, and in 2009, therewere 219 defamation cases issued; 34 of them were identified as having a “foreign connection” [Ministryof Justice, Report of the Libel Working Group]. In a short time, the widespread opinion has appeared thatLondon has become the “Libel Capital of the World” [London “The Times”, Be Reasonable; Carvajal,Britain, a Destination for ‘Libel Tourism’]. Through an extensive review of relevant case law and studiesI would like to draw attention to the problem of libel tourism which creates a chilling effect on press freedom.

    Unlike the author’s economic rights, the authorship of a work as well as other moral rights should not necessarily be classified as a kind of intellectual property. If literature presents the problems of copyright as an element of intellectual property, this is done in reference to economic rights. The issues connected with moral rights appear then as the background condition for economic rights to arise. However, according to the will of the legislator, the nature of these rights was formed in a different way. While economic rights are a kind of intellectual property, the authorship of a work should rather be viewed as a phenomenon at the intersection of the right to privacy (particularly at the stage of an already established but not yet completed work) and the right to freedom of expression (from the moment of the exercise of other moral rights and the moment of taking a decision to make a work public under the author’s own name). The right to withhold authorship cannot be interpreted as the right to change the author by agreement of the interested parties.

    The focus of this article is to examine the notion of freedom, and more precisely freedom of speech, in the light of The People vs. Larry Flynt. The analysis will pay close attention to what has always been a central concern of American society constituting one of the basic principles on which the new nation was founded. What is more, the article will try to indicate that freedom of speech has been as essential as controversial in many respects, which is proven by numerous examples from American history. As a baseline of this study I have chosen Larry Flynt, whose life and legal battles form the central theme of the selected biopic. The article will scrutinize the plot of the movie, as it provides interesting insights into the life of this controversial advocate of freedom of speech. Flynt made himself well-known, if not notorious, by being the focal point of countless debates that concerned moral issues, public taste, and two basic rights guaranteed by the Declaration of Independence and the First Amendment. Ultimately, the article will try to challenge the concept of a society based on the notion of freedom of speech by asking and trying to answer three questions: What precisely is freedom of speech? Is freedom of speech absolute? Are there any limits of expression and if so, then where to draw the line?

    Both freedom of expression and information quality are socially significant issues. They are however treated separately in the studies to date. The subject of theoretical research, whose results are discussed in the present article, is the connection between the two problems. The objective of the article is to define the impact of the quality of information on the way freedom of speech is used. To achieve this, the following hypotheses are verified: 1) appropriate information quality is conducive to behaviors that are within the freedom to express opinions; 2) inappropriate information quality need not be intentional; 3) the deliberately wrong quality of information may result in situations that are not within freedom of expression; 4) it is possible to effectively counter the use of information of intentionally wrong quality. The article is of scientific and research character. The presented problems have an international scope.
    Zarówno wolność wypowiedzi, jak i jakość informacji są istotnymi społecznie zagadnieniami. W dotychczasowych badaniach są one jednak traktowane osobno. Przedmiotem teoretycznych badań, których wyniki zawarto w artykule, jest związek tych zagadnień. Celem artykułu jest określenie wpływu jakości informacji na sposób korzystania z wolności wypowiedzi. Jego osiągnięciu służy zweryfikowanie następujących hipotez: 1) właściwa jakość informacji sprzyja zachowaniom mieszczącym się w ramach wolności wypowiedzi; 2) niewłaściwa jakość informacji nie musi mieć charakteru zamierzonego; 3) zamierzona niewłaściwa jakość informacji może prowadzić do sytuacji, które nie mieszczą się w ramach wolności wypowiedzi; 4) efektywne przeciwdziałanie wykorzystywaniu informacji o zamierzonej niewłaściwej jakości jest możliwe. Artykuł ma charakter naukowo-badawczy. Podjęta problematyka ma zasięg międzynarodowy.

    Public discussion in 2018, concerning the European Parliament, passing the Directive on copyright and related rights in the Digital Single Market, in the public discourse referred to as ACTA 2, evoked huge social emotions. The source of the conflict were two colliding values: the need to protect copyright and to ensure economic interest of authors and freedom of expression (freedom of the Internet), particularly important for users of works and Internet users. The decisions of the European Court of Justice, given on 29 July 2019 in the proceedings between Funke Medien NRW GmbH and Bundesrepublik Deutschland and the coincident decision in the case Spiegel Online GmbH vs Volker Beckow, deals with the above-given conflict of values. This article provides a description of the main arguments of the above-mentioned judgements of the ECJ and points at their consequences in the scope of changing the current interpretation of the provisions of copyright. The article also contains remarks on the influence of these decisions and their consequences for the disabling of content by providers of content-sharing service providers which violates freedom of expression considering the new Directive of 17 April 2019. The author presented arguments confirming that the Directive (EU) 2019/790 of 17 April 2019 on copyright and related rights in the Digital Single Market and the new way of interpreting copyright rules provided by the judgements of the ECJ has significantly changed the hitherto may of perceiving the rules of permissible use of works.
    Dyskusja publiczna z 2018 r. dotycząca uchwalenia przez Parlament Europejski dyrektywy w sprawie prawa autorskiego i praw pokrewnych na jednolitym rynku cyfrowym, nazywanej w dyskursie publicznym mianem ACTA 2, budziła ogromne emocje społeczne. U źródła tego konfliktu leżały dwie zderzające się ze sobą wartości: potrzeba ochrony praw autorskich i zabezpieczenia interesów ekonomicznych twórców oraz wolność wypowiedzi (wolność internetu), szczególnie istotna dla użytkowników utworów i użytkowników internetu. Wydane przez Trybunał Sprawiedliwości Unii Europejskiej w dniu 29 lipca 2019 r. orzeczenia w sprawie Funke Medien NRW GmbH przeciwko Bundesrepublik Deutschland oraz zbieżne z nim orzeczenie w sprawie Spiegel Online GmbH przeciwko Volkerowi Beckowi dotyczy wskazanego wyżej konfliktu wartości. Niniejszy artykuł zawiera opis głównych tez wskazanych wyżej rozstrzygnięć TSUE oraz wskazuje na ich konsekwencje w zakresie zmiany dotychczasowego sposobu interpretacji przepisów prawa autorskiego. W artykule zamieszczono także uwagi dotyczące wpływu tych rozstrzygnięć i ich konsekwencji w zakresie naruszającego wolność wypowiedzi blokowania treści przez podmioty świadczące usługi hostingowe w świetle wymagań nowej dyrektywy z dnia 17 kwietnia 2019 r. Ponadto wskazano argumenty świadczące o tym, że dyrektywa 2019/790/WE Parlamentu Europejskiego i Rady z dnia 17 kwietnia 2019 r. w sprawie prawa autorskiego i praw pokrewnych na jednolitym rynku cyfrowym oraz nowy, wytyczony w komentowanych orzeczeniach TSUE, sposób interpretacji przepisów prawa autorskiego istotnie zmienił dotychczasowy sposób postrzegania przepisów o dozwolonym użytku utworów.

    Freedom of expression and freedom of the press form guarantee and emphasize the democratic character of a state. The dissemination of information and opinions is a prerequisite of democracy, which essentially requires that citizens be guaranteed the possibility to participate in public affairs. An opportunity to learn some information and opinions is of paramount importance for broadening knowledge, sharpening the critical mind, shaping one’s own views and making rational and informed choices. For full access to information and opinions circulating in the public, it is necessary that it should be made public and media and their journalists will make it in the best way. The aim of this study was to compare constitutional legal solutions concerning freedom of expression and freedom of the press and the way they are effectuated in practice in theRepublicofArmeniaand in theRepublicofPoland.
    Swoboda wypowiedzi i wolność prasy stanowią gwarancję i podkreślenie demokratycznego charakteru państwa. Przekazywanie informacji i opinii jest warunkiem demokracji, która z istoty swojej wymaga zagwarantowania obywatelom możliwości uczestnictwa w sprawach publicznych. Możliwość zapoznania się z informacjami i opiniami ma podstawowe znaczenie dla pogłębienia wiedzy, wyostrzenia zmysłu krytycznego, ukształtowania własnych poglądów oraz dokonywania racjonalnych i świadomych wyborów. Aby dostęp do informacji i opinii funkcjonujących w obiegu publicznym był pełny, konieczne jest ich upublicznienie, a najlepiej robią to media i zatrudnieni w nich dziennikarze. Celem opracowania było porównanie konstytucyjnych rozwiązań prawnych w zakresie swobody wypowiedzi i wolności prasy oraz sposobu ich urzeczywistniania w praktyce w Republice Armenii i Rzeczypospolitej Polskiej.

    For freshly harvested vocabulary, which is an analytical body for my research, comparative context and background is the vocabulary recorded by Stephen Schuman in 1955. I mean to show which lexical units in a language of the children are new and which, to some extent, archaic, which comes most, and from what area. The study shall be limited to the active vocabulary of preschoolers,and the direct object of interest I make concrete nouns.
    Dla świeżo zebranego słownictwa, stanowiącego korpus analityczny dla badań autorki, kontekstem i tłem porównawczym jest słownictwo zarejestrowane przez Stefana Szumana w 1955 roku. Chodzi jej o to, by pokazać, które jednostki leksykalne w języku dzieci są nowe, a które w pewnym stopniu archaiczne, jakich przybywa najwięcej i z jakiego obszaru. Autorka badania ogranicza do czynnego słownictwa przedszkolaków, a bezpośrednim przedmiotem zainteresowaniaczyni rzeczowniki konkretne.

    Opis:
    Cultural activity of visually impaired persons plays an essential role in their rehabilitation. It allows them, among other things, to understand themselves and learn about their own predispositions, develop creative skills, reduce upsetting emotional tensions related to their disability and  create long-lasting bonds with society. Therefore, it is worth taking a closer look at these forms of  participation in which visually impaired or partially sighted are involved. Their characteristic was conducted on the basis of a dichotomous division into reception and creativity. Taking into account these two areas, there are indications of strategies aimed at bringing culture closer to people with visual impairment.
    Aktywność kulturalna osób z niepełnosprawnością wzrokową pełni istotną rolę w ich rehabilitacji. Umożliwia m.in. zrozumienie siebie i poznanie własnych predyspozycji, rozwój zdolności twórczych, redukowanie przykrych napięć emocjonalnych wynikających z niepełnosprawności, tworzenie trwałych więzi z otoczeniem społecznym. Wobec tego warto bliżej przyjrzeć się formom partycypacji w kulturze osób niewidomych i słabowidzących. Ich charakterystyki dokonano na podstawie dychotomicznego podziału uwzględniającego recepcję i twórczość. Analogicznie do tych obszarów wskazano strategie „przybliżania” kultury osobom z niepełnosprawnością wzrokową.
