Opis:
Documents of the Second Vatican Council became essential root of the Canon Code Law of 1983. There is a number of references to conciliar constitutions, decrees and declarations in each Canon Book. This is true also in regard to the marital law included in Ćanons 1055-1165. Amongst sources which were inspirations for the aforementioned marital law there were the following constitutions: Sacrosanctum Concilium, Lumen gentium, and Gaudium et spes; and decrees: Orientalium...., Unitatis..., Christus...and Apostolicum and also Gravissimum. Lawmaker makes 34 references to these documents. The conducted analysis allows to show to what extend norms of the marital law remain under the  influence of the Second Vatican Council.

This paper elaborates upon the Catholic Church’s teachings on religiousfreedom in the period from The French Revolution to The Second VaticanCouncil. Based on quotations from the original documents, the author presentsthe evolution of the Church’s position that switched from the initialrejection to the final acceptance of the religious freedom over past two centuries.The fact of this dramatic change begs the question about the continuityof tradition and credibility of the contemporary stance of the Church. Basedon the document by the International Theological Commission, “Memoryand Reconciliation: The Church and the Faults of the Past”, as well as theteaching of Pope Benedict XVI, the author demonstrates that – in contrastto some contemporary interpretations – the hermeneutics of continuity ispossible regarding Church’s teaching on religious freedom.

The article discusses the history of reforms of American religious sisters initiated by Pius XII and concluded by a joint agreement between the LCWR and the Commissions of the Congregation for the Doctrine of the Faith. The article shows the character of the reforms undertaken before and after the Council and how two organizations representing American sisters were established. The continuous departure of the LCWR from the teaching of the Church is presented in opposition to the fidelity of the second organization with canonical status – CMSWR. The lack of vocations among the sisters gathered in the LCWR is a sign of mistakes in the reforms that were undertaken and politicization of the organization.

This paper describes the reforms of American religious sisters started byPius XII until the recent closure of Archbishop Peter Sartain’s commission.The paper shows how the reforms of congregations were taken up beforeand after the Council and how the two organisations representing Americansisters were founded. The continual dissent of LCWR from Churchteachings is shown in contrast to the fidelity of the alternative canonicalorganization, namely CMSWR. The lack of new vocations among LCWRsisters is a sign of mistaken reforms and the lack of attractive power intheir political agenda.

Opis:
The present work is a conference in the Faculty of Law of the Catholic University of Murcia (Spain) and want to consider the importance of the juridical science named ius publicum ecclesiasticum and the connections between the Church and the Civil Governments. The focus of the study, in my intention, is to underline the important ‘juridical culture’ of this special part of the Canon law.
Le presenti riflessioni intendono focalizzare lo sviluppo delle relazioni fra la Chiesa e gli ordinamenti giuridici statuali dall’angolo di osservazione di una branca del diritto canonico dalla forte valenza culturale: lo ius publicum ecclesiasticum. Partendo dal Concilio di Trento, importante momento prodromico alla genesi della disciplina giuridica giuspubblicistica, si potrà valutare l’impatto provocato da alcuni documenti del Concilio Ecumenico Vaticano II per la “ristrutturazione” del diritto pubblico ecclesiastico, segno tangibile della capacità della Chiesa, nelle diverse epoche, di comprendere i mutamenti della società e i bisogni delle persone.
