    Małżeństwo, jako wyłączny związek między mężczyzną i kobietą, zostało podniesione przez Jezusa Chrystusa do rangi sakramentu. Jest to główny powód, dla którego Kościół katolicki przywiązuje wielką wagę do kodyfikacji praw dotyczących małżeństwa, ale także do ochrony tego sakramentu i podkreślenia jego znaczenia w życiu wspólnoty. Artykuł ten dotyczy ustawodawcy prawa o sakramencie małżeństwa I Synodu Archidiecezji Warmińskiej, który odbył się w latach 2006-2012. Autor podzielił swój artykuł na dwie części. Pierwsza dotyczy norm synodu dotyczących sakramentalności małżeństwa i zawiera porównanie między prawodawstwem powszechnym i partykularnym. Autor chciał ukazać specyfikę niektórych aspektów sprawowania tego sakramentu. Druga część zawiera normy, które zostały omówione podczas procesu synodalnego, ale nie zostały uwzględnione w ostatecznej redakcji dokumentów synodalnych. Autor chciał ukazać, jak wyglądał proces synodalny i przedstawić relację między prawem partykularnym a powszechnym w Kościele katolickim.
    Matrimony, as an exclusive relationship between man and woman, was raised by Jesus Christ to a level of a sacrament. That is the main reason why Catholic Church is paying great attention to codify laws about matrimony but also to protect this sacrament and to mark its relevance in the life of a community. This article talks over the legislature about the sacrament of matrimony of I (XIV) Synod of Archdiocese the Warmia, which was held between 2006 and 2012. Author divided his article into two parts. First is about the norms of Synod about the sacramentality of matrimony and includes comparison between universal and local legislature. Author wanted to show a local specific of some aspects of the celebration of this sacrament. Second part includes norms which were discussed during the synodal process but weren’t included in final redaction of synodal documents. Author wanted to show how the synodal process looked like and present the relation between the particular and universal law in the Catholic Church.

    The author presents provides a commentary on the judgment (a negative) nullitatis matrimonii oft the Roman Rota c. Erlebach, passed 3.02.2011 (in the third instance) by a turnus of auditors coram Erlebach on the grounds of exclusion of the indissolubility of marriage (from the archidiocese of Montevideo). The court of first instance passed a positive judgment and the second instance court issued a negative judgment. The case concerns a marriage concluded in 1973 by a man who was permeated by Marxist philosophy, rejected God and religion, and even marriage. The man married under the pressure of the fiancé’s family as well as for obtaining material benefits.Both the court testimonies of the man and the witnesses (the woman defendant refused to testify) they did not let you know the plaintiff’s will. It was also missing causa proxima exclusion of bonum sacramnti, as well as circumstances pro simulatione; moreover, many circumstances deny the simulation.The verdict c. Erlebach is an example of an in-depth assessment of the evidence, which showed the views and beliefs of the man, but did not show a positive act of will.

    Artykuł stara się pokazać, że pojęcie sakramentalności jest jednym z kluczowych dla uchwycenia całościowej wizji teologii Josepha Ratzingera/Benedykta XVI. U niemieckiego teologa pojęcie to nie jest odnoszone jedynie do siedmiu sakramentalnych znaków łaski, ale służy do interpretacji Bożego Objawienia w historii zbawienia (i stworzenia), katolickiej interpretacji Pisma Świętego, wnikania w tajemnicę Kościoła i celebrowanej liturgii. Dlatego też w artykule podjęty został temat sakramentalności w jej fundamentalnym znaczeniu, aby pokazać, że to, co materialne, objawia to, co duchowe, że przeszłość wskazuje na przyszłość według modelu „obietnica–wypełnienie”. Sakramentalność – według Ratzingera – odnosi się również do tego, czego człowiek nie może wyprodukować własnymi siłami, ale musi to przyjąć jako dar od Boga. W tych znaczeniach omawiana jest sakramentalność stworzenia, słowa i Kościoła w ujęciu bawarskiego kardynała i późniejszego papieża.
    The article endeavours to show that the concept of sacramentality is one of the key ones for grasping the overall vision of Joseph Ratzinger/Benedict XVI’s theology. The German theologian does not refer the concept only to the seven sacramental signs of grace, but he uses it to interpret God’s revelation in salvation (and creation) history, the Catholic interpretation of Sacred Scripture, insight into the mystery of the Church and the celebrated liturgy. Therefore, in this article the theme of sacramentality is taken up in its fundamental sense, in order to show that the material reveals the spiritual, that the past points to the future according to the ‘promise-fulfilment’ model. Sacramentality – according to Ratzinger – also refers to what man cannot produce by his own efforts, but must accept as a gift from God. Within these meanings, the sacramentality of creation, the Word and the Church as seen by the Bavarian cardinal and later pope will be discussed.

    Opis:
    Si tratta della causa Montisvidei nullitatis matrimonii, giudicata nella terza istanza da quattro sopra indicati titoli dalla parte della convenuta. Mentre nella prima istanza è stata emanata la sentenza favorevole alla tesi dell’acctore (solo dal titolo dell’errore circa indissolubilità e della sacramentalità), il tribunale d’appello non ha condiviso la convinzione dei giudici della istanza precedente, sentenziando negative a tutti i titoli d’invalidità. Dopo l’ appello dell’attore la causa è stata ricognita dal turno rotale c. Bottone. Il tribunale, dopo aver analizzato il materiale abbastanza scarso (la convenuta non ha partecipato al processo; le deposizioni hanno deposto solo i due testimoni), ha emanato la sentenza negativa da tutti i quattro titoli. Nel commento alla suddatta sentenza rotale si sottolinea soprattutto i motiovi con cui i giudici rotali hanno risolto la causa.

    Robert Sokolowski pisał, że biblijne słowa uaktywniają obecność Boga. Czy można jednak mówić o sakramentalności słowa analogicznej do samego sakramentu? W artykule zebrano refleksje na temat „uobecnienia” słowa Bożego intra mysteriorum celebrationem. Kwestia ta wiąże się z tematem związku przeszłości z teraźniejszością w Eucharystii, którym zajmował się Sokolowski. W artykule zrekapitulowano poglądy filozofa dotyczące obecności eucharystycznej, w dialogu z którym dokonano następnie namysłu nad obecnością Chrystusa w słowie Bożym. Z „paschalnocentryczności” Pisma Świętego wynika jakiegoś rodzaju uobecnienie antycypacyjnego wydania się Boga w wydarzeniach zaświadczonych w natchnionych tekstach. Liturgia słowa musi prowadzić do kulminacyjnego wydarzenia Paschy i jego sakramentalnego uobecnienia. Nie może być mowy o „dwóch obecnościach” Pana w czasie Mszy Świętej. Słowa ustanowienia z Ostatniej Wieczerzy pełnią rolę w aktualizacji Paschy, zaś natchnione słowa nie są w taki sam sposób słowami „ustanawiającymi”. Dopiero w ich wewnętrznym ukierunkowaniu prowadzą do misterium Chrystusa obecnego w Najświętszym Sakramencie.
    Robert Sokolowski writes that biblical words activate God’s presence. However, is it appropriate to speak about the sacramentality of the Word of God analogous to the sacrament itself? The article presents reflections on the word of God “becoming present” intra mysteriorum celebrationem. This issue is related to the topic of the relationship between the past and the present in the Eucharist, which Sokolowski deals with. The article recapitulates the philosopher's views on the Eucharistic presence, then, in dialogue with him, it reflects on the presence of Christ in the word of God. The “Passover centeredness” of Scripture implies a kind of re-presentation of God's anticipatory self-giving in the events witnessed to in the inspired texts. The liturgy of the Word must lead to the climax of the Easter event and its sacramental re-presentation. There can be no question of “two presences” of the Lord during the Holy Mass. The words of institution uttered at the Last Supper play a role in the actualization of the Passover, while the inspired words are not in the same way “institutive”. Only in their interior orientation do they lead to the mystery of Christ present in the Blessed Sacrament.
