    In times of multiculturalism and religious pluralism issue of mixed marriages it is very timely. It is an object of interest of all faiths and religions. The author of the present article takes the issue of mixed marriages from the point of view of three Christian faiths: Roman Catholic Church, the Orthodox Church and the Evangelical Church of the Augsburg Confession in Poland. Each of these churches makes his faithful requirements that are necessary to be able to to marry with a person of another faith or religion. Unfortunately, the similarity these norms can lead to difficulties in marriages of different religious or church affiliation.

    Opis:
    W artykule podjęto analizę problematyki okoliczności skutkujących narusze- niem lub ograniczeniem wolności sumienia lub wyznania w aspekcie indywidualnym. Autorowi opracowania zależy na osiągnięciu postawionych celów badawczych poprzez analizę ogólnych założeń Dekretu Generalnego Episkopatu Polski z roku 2020. W ramach opracowania wzięto pod uwagę obszar naruszeń wolności sumienia przez małżonka w kontekście małżeństwa mieszanego (kwestie zmiany wyznania, utrudniania praktyk religijnych). W ramach indywidualnej ochrony wolności sumienia i wyznania analizo- wano także procesy kanoniczne, w szczególności – procesy małżeńskie. Tym bardziej, że kwestia sumienia i wyznania jest brana pod uwagę z urzędu w toku procesu małżeńskiego.
    The article analyzes the issue of circumstances that result in the violation or limitation of freedom of conscience or religion in the individual aspect. The author of the study wants to achieve the relevant research goals by analyzing the general as- sumptions of the General Decree of the Polish Episcopate of 2020. Within the scope of the study, the area of violations of the freedom of conscience by the spouse in the con- text of a mixed marriage (issues of changing religion, hindering religious practices) was discussed. As part of the individual protection of the freedom of conscience and religion, canonical processes, in particular – matrimonial processes, were also discussed. Especially that the issue of conscience and religion is taken into account ex officio in the course of the matrimonial process.

    Wenn die Eltern im Glauben geteilt sind, so kann die einzige vernünftige Lösung ausschließlich in der Erziehung aller Kinder im Sinne bloß des einen oder bzw. des anderen einzigen Glauben liegen. Schmerzhafte Frage dabei ist, welche von dieser Religionen überwiegen soll? Antwort auf diese Frage, welche die Katholische Kirche mit einer autoritativen Aussage und Rechtmäßigkeit tut, ist die, daß alle Kinder in der Katholischen Kirche getauft und erzogen werden sollen. In der Praxis verbindet sich dies oft mit ernsten Problemen, die sowohl seitens der Eltern, wie auch ihrer Kinder in Erfahrung gebracht werden. Ob jedenfalls die Katholische Kirche tatsächlich anders verfahren kann, ohne gleichzeitig den Glauben an sich zu verlieren, sowie ohne Verneinung ihrer eigenen Persönlichkeit?

    Opis:
    The author of the presented article focused his attention on the question of the realization of conditions concerning nupturients in the case of contracting a mixed marriage between a Catholic and a member of a Church or Ecclesial Community not in full communion with the Catholic Church. The analysis of can. 1125, n. 1-3 CIC shows that the conditions to be fulfilled before granting a permission concern mostly the Catholic and do not in any way infringe the religious liberty of the other party. According to the will of the legislator, the non-Catholic party is only obliged to meet the requirement codified in can. 1125, n. 3 CIC which remains in a close relation with the natural structure of marriage. This obligation is especially important since not sharing the Catholic concept of marriage as for the components crucial for the canonical system results in invalidity of marriage.

    Since the Catholic Church acknowledged autonomy of other Christian Churches and Ecclesiastical Communities to state their law, it has become more important and necessary to respect that kind of law, especially in cases of mixed marriages between Catholics and the faithful of other Christian denominations. This article describes selected issues of law of the Church of England – the established Church of that part of the United Kingdom. The first paragraph explains the legal definition of marriage as seen in the Canons of the Church of England. It also refers to essential qualities of marriage such as unity, indissolubility and sacramentality as understood in the doctrine of the Church of England. The second part of the article describes impediments that make marriage void, that is age, consanguinity, affinity and still existing lawful bond of previous marriage or civil partnership. The third section raises the issue of required forms of solemnization of marriage which are acknowledged by the Church of England as causing valid marriage. The following paragraph refers to the two ways of dissolution of marriage stated by the English law, which are divorce and nullity. It presents also the conditions required by the Church of England, which allow a divorced person to remarry. The fifth paragraph describes what the view of the Church of England over mixed marriages is. The conclusion includes advice for Catholic ministers, who may be asked by the faithful to assist at the solemnization of mixed marriage between a Catholic and a member of the Church of England, regarding the fact that Catholic ministers are required by canon law to inform the couple about the essential qualities of marriage as seen by the Catholic Church as well as to check whether both parties are free to marry one another.

    The origins of the marital announcements issue concerning persons of dierent church aliation, go back to the eighteenth century. Since then, this issue has been regulated by the particularistic law, which was largely conditioned by the civil law. So far, there has been formulated only one do- cument of general nature which focuses on this subject – Pio-Benedictine Code. Codication of John Paul II does not mention the discussed issue. In Poland the discussed issue appears in the Polish Episcopal Conference Instructions on preparing for marriage in the Catholic Church and in the Polish Episcopal Conference Instructions on the pastoral care for marriages of dierent church aliation. However, they do not give clear guidelines, but some tips which certain standards of conduct can be inferred from. Perhaps the new Polish Episcopal Conference Instruction on marriage in the Catholic Church, which is being presently prepared, will regulate this issue in detail.
