Opis:
The presented sentence of the Roman Rota, to which the author provides a comment, concerns nullitatis matrimonii, which was heard by the turnus c. Monier on the grounds of exclusion by the female defendant of the indissolubility of marriage and offspring. This sentence was passed by another instance, after obtaining by the male claimant nova proposition causae (in the first and third instance the sentence was negative, in the second instance it was positive); the defendant failed to attend all three instances. However, her testimony given in c. Monier instance, fully confirmed by the claimant and witnesses, unequivocally demonstrated that she simulated marriage consent – both in reference to bonum sacamenti and bonum prolis (the reason for both simulations were her beliefs concerning marriage and its procreative purpose, which deviated from the teaching of the Church). The sentence of the Roman Rota c. Monier is an example of an in-depth assessment of means of proof, which enabled to convincingly declare the nullity of marriage.

The judgment (pro nullitate matrimonii) was issued in the third instance (it was negative in the first instance and positive in the second instance) due to the exclusion bonum prolis (can. 1101 § 1 CIC) by the man. On the basis of testimonies of the petitioner and witnesses, after taking into consideration all circumstances, especially cause of simulation which was pessimistic view of the world and all entire life, Roman Rota judges had no doubt that the petitioner excluded the good of offspring by his positive act of will.

Zarówno doktryna, jak i orzecznictwo wskazują, że wykluczenie dobra wierności musi dokonać się pozytywnym aktem woli, jednak przydatne w określeniu prawdziwej woli symulanta zdaje się być określenie relacji zachodzącej między wolą zawarcia małżeństwa a wolą wykluczenia dobra wierności. Ważne jest określenie tych przyczyn, zarówno dalszych, jak i bliższych. Orzecznictwo wskazuje nie tylko na zaburzenia czy anomalie psychoseksualne, ale w obecnym czasie znaczenie posiada przede wszystkim mentalność współczesnych ludzi, propagujących idee wolności seksualnej, które w niektórych przypadkach mogą osiągać znamiona osobowości zdeprawowanej. Przyczyny bliższe są bardzo różne w zależności od  przypadku, choć do najczęstszych zalicza się chęć utrzymania relacji pozamałżeńskiej z osobą, z którą kontrahent był związany przed zawarciem małżeństwa.
Both the doctrine and the jurisprudence indicate that the exclusion of the good of faithfulness must be done by a positive act of will, but it seems useful in determining the true will of the simulator to define the relationship between the will to marry and the will to exclude the good of faithfulness. It is important to identify these causes, both further and closer. Among other reasons, jurisprudence indicates not only psychosexual disorders or anomalies, but at the present time, first and foremost, the mentality of modern people promoting the idea of sexual freedom, which in some cases can become a depraved personality. The reasons are very different depending on the case, although the most common is the desire to maintain an extramarital relationship with the person with whom the contractor was related before entering into marriage.

Bezrobocie jest zjawiskiem analizowanym między innymi na gruncie ekonomii, i związane jest ze stanem nierównowagi jaki ma miejsce wówczas gdy popyt na pracę jest mniejszy niż jej podaż. Ta nierównowaga przekłada się wówczas na rosnącą wielkość zasobów dostępnej siły roboczej, niewykorzystywanej w procesach gospodarczych, która pomimo czynienia starań nie jest w stanie znaleźć miejsca zatrudnienia. Zjawisko bezrobocia w sposób szczególnie uciążliwy dotyka ludzi młodych, którzy nie dysponują wcale, bądź w ograniczonej skali doświadczeniem zawodowym, które może stanowić o atrakcyjności pracownika na runku pracy. Celem artykułu będzie próba analizy zjawiska bezrobocia z uwzględnieniem tych obszarów, które w nowej perspektywie unijnej. Strategia na rzecz inteligentnego rozwoju, sprzyjającego włączeniu społecznemu, Europa 2020, znajdują szczególnie miejsce – chodzi o obszar wykluczenia społecznego.
Unemployment is a phenomenon widely considered in the field of economics, and it is related to the state of imbalance that occurs when the demand for labor is less than its supply. This imbalance then translates into an increasing amount of available human labor resources, not used in economic processes, who, despite efforts, are unable to find a place of employment. The phenomenon of unemploy-ment in a particularly burdensome way affects young people with none or limited professional experience, which may determine the attractiveness of a prospective worker on the labor market. The aim of the article is an attempt to analyze the phenomenon of unemployment taking into account those areas which, from the new EU perspective, the 20202 Europe 2020 Strategy, belong to the area of social exclusion.

Opis:
Bonum prolis, constituting one of three goods of Saint Augustine, including procreation and bringing up children, connected integrally with bonum coniugum, has been the subject of simulation (so called partial simulation) of the marital consensus, i.e. exclusion – the positive act of will – right to fulfill marital acts aiming per se at procreation. Based on the analysis of five published judgments of the Roman Rota issued in 2002 the author presents the meaning of bonum prolis for the marital unity and the exclusion of this good (with respect to the procreation), differentiates the exclusion of the right to procreation itself from the exclusion of exercising this law only, takes into consideration the concurrence of bonum prolis exclusion with bonum sacramenti exclusion, and, finally, discusses proofs for the bonum prolis exclusion. The analysis of the judgments is preceded by presenting the issue of the procreative meaning of the marriage and the effectiveness nullifying the marital consensus arising from the intention contrary to the procreation.

Podobnie jak błąd może zdeterminować wolę do braku akceptacji małżeństwa zgodnego z nauką Kościoła, sprawiając wadę konsensu, tak również można bezpośrednio wykluczyć wierność małżeńską pozytywnym aktem woli. Samo zjawisko błędu wchodzi w skład zjawiska symulacji, gdyż w obu przypadkach mamy do czynienia z niezgodnością między wolą a jej zewnętrzną formą wyrazu. Nie oznacza to jednak, iż błąd determinujący wolę nie odróżnia się od symulacji. W przypadku bowiem symulacji następuje pozytywne wykluczenie dobra wierności, w przypadku błędu owo wykluczenie jest nieświadome, czyli bez udziału pozytywnego aktu woli kontrahenta. W tym przypadku ów pozytywny akt woli byłby skierowany przeciwko rzeczywistości, której się nie zna.
Just as an error can determine the will not to accept marriage in accordance with the teaching of the Church, causing a defect in the consensus, so as well can marital fidelity be excluded directly by a positive act of will. The very phenomenon of error is part of the phenomenon of simulation, since in both cases there is a discrepancy between the will and its external form of expression. This does not mean, however, that the error determining the will is indistinguishable from a simulation. In the case of a simulation, there is a positive exclusion of the good of fidelity, in the case of an error, this exclusion is unconscious, i.e. without the participation of a positive act of will of the person. In this case, this positive act of will would be directed against a reality that one does not know.

Znaczenie organizacji międzynarodowych we współczesnym świecie, a w szczególności ich członków, którzy posiadają szerokie spektrum możliwości przynależenia do poszczególnych społeczności wzrasta z roku na rok, co umożliwia im kształtowanie własnych interesów narodowych przy pomocy narzędzia, jakim są właśnie organizacje międzynarodowe. Formą ograniczenia a wręcz pozbawienia praw przysługujących państwom, które należą do organizacji międzynarodowej jest ich wykluczenie ze struktur organizacyjnych. Jest to swego rodzaju konsekwencja, z którą państwo członkowskie musi sobie radzić dopuszczając się określonych działań naruszających podstawy funkcjonowania tejże organizacji. Nie każdy czyn godzący w interesy organizacji stanowi podstawę wykluczenia. Jest to najdotkliwszy ze skutków, jakie organizacja może przewidywać w swoim statucie, ponieważ to właśnie akt założycielski zawiera postanowienia w tym zakresie. Wykluczenie z organizacji jest, jako przejaw mocy organizacji w stosunku do członków, podstawą jej władzy nad członkami.
The importance of international organizations in the modern world is rising year by year, enhancing the status of their members and giving them a wide range of opportunities to join diverse groups and communities, which enables them to shape their national interests using their membership in international organizations as an expedient instrument of leverage. If a state has its membership in an international organization restricted or is crossed off the list of members, it will sustain a serious blow to its rights. Restricted membership or outright exclusion is a specific consequence a member state may have to cope with if it has acted in contravention of the principles and regulations which are binding on the members of the given international organization. Not every act that violates the interests of an organization gives grounds for full exclusion, which is the severest penalty an international organization can prescribe in its statute. The power to exclude noncompliant members is a manifestation of the organization’s prerogatives and the basis of its authority over its members

Non esiste chiarezza nella definizione legale del termine bonum coniugum. L’incapacità di adempiere i doveri matrimoniali,intesi come bonum coniugum, può essere considerata il  fondamento per la conferma della nullità del matrimonio nel can. 1095 n.3 CIC. Nel caso di causa di esclusione bonum coniugum dalla sfera di consenso matrimoniale, le ragioni degli uditori della Rota non sono uniformi. Certi giudici della Rota non accettano la simulazione bonum coniugum come motivo divisorio per la nullità. Esistono tanti elementi, i quali sono necessari per definire bonum coniugum.Prima di tutto gli stessi comprendono la volontà del contraente di formare una duratura ed unica relazione interpersonale per procreare e crescere dei figli.Negli ultimi anni la Rota Romana ha pubblicato qualche sentenza sulla simulazione di bonum coniugum.In queste pubblicazioni è chiaramente visibile la ricerca della definizione bonum conigum nei fondamentali diritti e doveri matrimoniali, che richiamano le definizioni tipo “unità della vita”, unità del matrimonio”,”intimità dell’unione personale”, “consorzio matrimoniale della vita e dell’amore”.Queste non sono delle definizioni severe, ma le interpretazioni troppo strette o troppo larghe e possono provocare errate soluzioni.Trovare la definizione legale del termine bonum coniugum è un compito molto difficile. E’ un termine aperto e con tanti significati. Il linguaggio che descrive questo termine è molto impreciso e poco chiaro. Gli uditori della Rota sono molto cauti nel formare le definizioni e le conseguenti pronte soluzioni legali,invece la giurisprudenza non e’ unilaterale in questa questione. Parlare di doveri e di diritti non basandosi su termini legali può condurre ad una sbagliata interpretazione da parte dei tribunali d’Istanze inferiori e provocare così il rischio di  forme locali di giurisprudenza”,delle quali ha parlato Papa Benedetto XVI durante l’incontro con i lavoratori della Rota nel 2008.

One of nullity titles which is difficult to establish in the canonic process of nullitatis matrimonii is the exclusion of the marriage indissolubility (can. 1101 § 2). The significant issue here is to establish – at the moment of the marriage conclusion – the positive act of will of the betrothed focused on (in one of possible ways) the marriage indissolubility. In the reviewed published judgments of the Roman Rota of 2004 a tendency to strengthen principles worked out by this apostolic tribunal regarding both the method of bonum sacramenti exclusion and the character of the positive act of will, as well as proving this exclusion in an individual case, can be noticed.
