Opis:
The change of written regulations of the municipal law, according to principles included in a gloss to the Magdeburg Weichbild and the Sachsenspiegel, required the consent of the town owner. In the case of towns belonging to the royal domain, the change required the king’s acceptance, in the form of approving the regulations prepared by the town burghers. Although the formal approval of the regulations made the king involved in the legislative process, his function cannot be understood as connected with any intentional legislative activity. As it turns out, the initiators of the changes in private law were the burghers themselves, who observed new legal solutions in other towns and, when the need arose, prepared projects of resolutions reforming the law. In smaller towns, this duty belonged to municipal scribes, who had to have an at least intermediate knowledge of law and, drawing on their professional practice, would point out the flaws and shortcomings in existing regulations. In the case of Ciężkowice resolution of 1550 and Biecz resolution of 1595, an interesting phenomenon can be observed, consisting in borrowing legal solutions, however, not mechanically, but to an extent that met the needs of the town community. The majority of the regulations in Biecz resolution was derived from the Cracovian laudum of 1530. The Biecz town statute (wilkierz), in turn, was a compilation of the Cracovian laudum and Ciężkowice resolution. It is an notable case of borrowing legal solutions from a city (i.e. Ciężkowice) with which Biecz remained in an economic conflict over nearly the whole 16th century. The Ciężkowice statute (wilkierz) abandoned the division of inherited property into gerada, hergewet and dziedzictwo, regulated the question of inherited debts after the Cracovian pattern, raised the problems of ius propinquitatis, and contained detailed administrative regulations, including those concerning the maintenance of the municipal school.

The article focuses on some regulations of the Polish-Magdeburg Law and the proceedings related to municipal elections in Knyszyn (a royal town in the Podlaskie Voivodeship) from 16th to the beginning of 18th century. The first, theoretical part of the article, describing pertinent rules of that law, is based on books written by the 16th-century Polish lawyers Bartholomaeus Groicki and Paulus Szczerbic. Its second part analyses some documents from the municipal records in order to explain the practice of elections in this town. Unfortunately, the number of available sources is limited, as we only have the royal privilege from 1568 A.D. and some information about the elections from 1625, 1643 and 1706. The article tries to find the answer to the following questions: the attitude of the inhabitants of that town toward the municipal offices and its representatives, the circle of persons exercising power and its stability, the influence of external factors on the appointment of officials. Summing up, the author points to some changes in the electoral procedure and to the multilateral interest in the results of the election.

The book by Marcin Starzyński recapitulates, rectifies and complements what we at present know about the medieval City Council of Cracow as an institution. The discussed monograph collected the most important issues devoted to the medieval Council of Cracow. The monograph pointed also to the directions along which further research should be continued. The volume therefore does not conclude the study of the aforementioned institution. Its task is rather to introduce further research whose subject-matter might include: the prosopographic studies, the law-creating accomplishments of the Council and the political role that it played in the medieval Kingdom of Poland. It is worthwhile to note that half the volume is covered by the appendices that inform of the city councilors, include the register of the Council-produced wilkurs and specify the debts incurred by the Council in order to achieve the measures needed for lending money to the Kings.

Opis:
The study presents scholarly editions of legal-historical sources published in the Czech Republic after 1990. The study of legal history is narrowly connected with the auxiliary sciences of history. This situation particularly concerns the history of the Middle Ages and the early modern period, but modern legal history also has contact points with these auxiliary sciences. Of particular importance is the close connection with diplomatics and codicology. Sources of a diplomatic nature include documents, office books, and files. Sources of a codicological nature include legal artifacts that have survived in manuscripts of a personal character or were issued in incunabula and old prints. They concern legal collections, legal codes, and synodical statutes. The legal-historical artifacts in the article are divided into artifacts of land law, municipal law, mining law and ecclesiastical law. a paper on editions of documents and letters precedes.
