The paper refers to selected issues of exploitation in the face of justice. The analysis is based on the definitions of exploitation contained in the Polish Penal and Civil Codes. The main goal is the identification of the necessary and sufficient conditions for the recognition of exploitation as being unjust. A supplementary question will refer to a specific type of justice which should be considered in this case. In this respect, we should consider retributive, distributive and social justice. Another important factor in this regard is the accepted theory of value. In the presented considerations, we will focus on the labour theory of value. The principal issue can be expressed by the questions whether exploitation is ipso facto unjust and how the phenomena of exploitation and justice are related to each other.

In the 1840’s due to Luigi Taparelli and Antonio Rosmini emerged the term of “social justice”. From this time, its meaning has developed in many ways. The paper brings up some applications of the notion. In the literature of the subject one can find numerous identities of “social justice”. The article focuses on the identity of this term with justice framed as: legal, distributive, commutative, penal, and restorative. Some of these concepts assumes and requires existence of some kind of social persons. By briefly analysing those notions the author tries to show the specificity of particular types of meanings assigned to the social justice.

On the example of a workload dispute (a version of a ‘border dispute’) I present the general problem of two persons – M and P – with equal entitlements to one commodity, which is equally desired by both of them. They are both moderately altruistic; they are not angels untempted by a selfish willingness to get their own way, nor are they devils, who want to destroy others even if it leads to self-destruction. As human beings operating in a world of limited goods, they are so physically and intellectually feeble that neither of them is able to permanently enslave the other and submit him to the second person’s will. Such being the case, each solution to the problem means that the profit of one person is the loss of the second. The question, whether justice is possible at all, suggests itself whether in a situation when people are more or less equal, or with limited altruism and/or selfishness and scarce resources.

Rawls’s theory of justice is based on Kant’s ethics and the theory of social contract. Rawls tries to obey two rules: of universalizations and universality and of the maximization for the least privileged. His theory can be used to judge the ethical position of business firms. It follows from my studies that a just organization of a firm is rare in times of transformation. This may be another reason for mass emigration and it must be taken into account in future debates of the economic development.

Adolf Reinach met and befriended Hermann Kantorowicz in one of Lujo Brentano’s political economy seminars during the 1901/1902 academic year at the University of Munich. After Munich, Kantorowicz would go on to be a major contributor to the Free Law Movement (Freirechtsbewegung) in Germany and play an important role in the development of the sociology of law in the 20th century. Reinach encountered the work of Edmund Husserl while studying with Lipps and later became central to the phenomenological movement in Göttingen. But all the while he remained interested in and focused on issues related to justice. His last scholarly publication before leaving for battle in WWI, Die apriorischen Grundlagen des bürgerlichen Rechtes (The a priori Foundations of Civil Law, 1913) published in the very first edition of the Jahrbuch für Philosophie und phänomenologische Forschung (Yearbook for Philosophy and Phenomenological Research) is a testament to this. Here we see Reinach taking his phenomenological education and applying it to entities of justice. I believe Kantorowicz inspired this lasting interest in matters of justice. This essay will focus on the influence of Kantorowicz on Reinach, and while doing so attempt to flesh out and contrast the ways in which these two men sought to overcome the problems of justice (Recht) of their time. Many of these problems still continue to be relevant today.

The article presents various links between business and ethics. The idea of responsibility, used to describe legal, economic and ethical aspects, forms the main, unifying thread. The author employs it to analyze three spheres of human activity. The first sphere, the subjective one, concerns self-responsibility, when individuals are striving to satisfy their own needs and to achieve happiness. The second, the encounter with the Other, embraces two meanings: responsibility for and towards the Other. The third sphere, the social one, extends the idea of responsibility onto the historical community we belong to. The concept of co-responsibility is not confined to our life span, but it embraces the future generations as well. The author pinpoints an important element in creating the foundations of a given community, i.e., regulations that form its basis, especially the principle of justice, encompassing the distribution of goods. Many contemporary authors underline this ethical, political and economic aspect (Rawls, communitarians, Ricoeur, Habermas). The main thesis the author would like to substantiate is as follows: in business activities, the ethical conduct of an individual is not sufficient. It needs to be broadened to encompass other perspectives since contemporary societies are based on the multidimensional idea of co-responsibility.

Taxes are closely related to the functioning of the state. From the moral and social point of view, it should always be directed towards the common good. Implementing this principle, the state supports the improvement of citizens’ welfare. Provides them with collected taxes their services, such as internal and external security, education, culture, infrastructure, social services and others. The formation of fair tax system and the mechanism of budgetary resources also has great importance because of the importance of the whole economy. In addition, the state’s fiscal system applies to every citizen as a taxpayer. Therefore, this issue also has important ethical dimension of individuality. The article focuses on these issues, emphasizing an ethical perspective the following three issues: (1) The social context of contemporary reflections on the obligations to the state, (2) the state and its goals, and (3) the moral aspects of the duty to pay taxes.

The so-called debate between Jürgen Habermas and John Rawls concentrated mainly on the latter’s political liberalism. It dealt with the many aspects of Rawls’s philosophical project. In this article, I focus only on one of them, namely the epistemic or cognitivistic nature of principles of justice. The first part provides an overview of the debate, while the second part aims to show that Habermas has not misinterpreted Rawls’s position. I argue that Habermas rightly considers Rawls’s conception of justice as a moral one. In the last part, I discuss two key questions raised by Habermas. The first concerns the relation between justification and acceptance of the principles of justice. The second concerns the relation between two validity terms: truth and reasonableness.

The article Truth in criminal trial points out great importance of facts in every criminal procedure. The author presents a new look at some legal regulations in Poland. For example he strongly criticizes laws (and practice!) which forbid disclosure of a criminal’s personal data. It is just unfair towards decent citizens because they might be future victims of such criminals. By the way: veritatem sequi est tueri iustitiam.

The paper has three parts. The first part concerns the solidarity principle’s genesis. Its philosophical base is the personalistic anthropology, which speaks about prosocial nature of man and its active participation in the social life. The biblical-theological base of solidarity are: personal dignity of man comme God’s image, person and learning of Christ, community of the Church. The second part of paper discusses elements ontological-anthropological and biblical-ethical which are necessary in the realisation of solidarity’s principle. They are following: pluralism of equal persons and societies, its dialogue, co-production of common good by honest work, integral development economic and intelectual-cultural, equality, social justice and love, peace and reciprocal settlement. The thirt part of paper speaks about three circles of application of solidarity’s principle; namely: solidarity professional-working – defend of rihts of workers, solidarity general-social of nation and state – protection of economic and political human rihts, solidarity international of humanity – trend towards peace and prosperity.

My qualitative research paper focuses on the Anne Frank sapling installation at the Clinton Presidential Museum and Library in Little Rock, Arkansas. Saplings grafted from the tree that grew outside Anne Frank’s window in Amsterdam while she wrote her famous diary are provided by the Anne Frank Center for Mutual Respect to organizations that will link the tree to dialogues about past and present social justice issues. Building on Thomas Gieryn’s recent work on “truth-spots,” I explore the sapling installation as a possible “truth-spot,” and reflect on what kind of truth is supported there. From a symbolic interactionist perspective, I consider the sapling as a boundary-crossing entity that, together with other elements of the installation, stimulates reflection and inclusive dialogue, and fosters hope without shunning complexity. I discuss the sapling’s ecological needs and material agency, since it is not a passive recipient of human meanings and orchestrations. I also comment on the changing role of museum installations and exhibit space in the context of social justice.

The subject of social justice are groups or whole societies – also states, object of this justice are their mutual rights and common good. The process of economic and technological globalization means among other things: establishment of the world market, predominant role of international companies, centralization of leading elites’ decisions, financial disproportion between individual people and countries. In the teaching of contemporary popes (John XXIII’s, Paul VI’s, John Paul II’s) the idea of social justice has also international dimension and therefore process of economic globalization ought to respect two principles of the Church’s social teaching: the principle of the subsidiarity and the principle of solidarity. The principle of the subsidiarity demands to respect subjectivity of all nations and states as well as to aid their integral development. The principle of solidarity postulates creation of common good of world society, this good are: peace, economic prosperity, commerce profitable for all states, cooperation and financial help of rich countries for underdeveloped countries. The social justice in the international dimension is the expression and the imperative of solidarity of all nations and states.

The purpose of this article is to analyze the ultimate purpose of the tax system that gives meaning and legitimacy to taxation. The citizen thus becomes an integral part of the State, has the ability to elect its representatives through suffrage. The law is a guarantee of equality and justice that provides legal security, facilitating peace and coexistence. This guarantee is manifested through the constitutional system (Alvarado Plana, 2016: 193–195), where the Constitution (Escudero, 2012: 857–858) becomes the legislative framework and the supreme norm of the entire legal system that orders the coexistence of citizens and ensures the proper functioning of the State. The tax system is defined as a revenue collection tool to cover the needs of the State, but there is certainly more than that: to achieve the goal of equality, justice, freedom, peace and well-being of the society, but also to guarantee the sustainability of the system, achieve progress and social peace.  It is also essential to attract investment, create wealth and achieve proper development within the European Union (Sampedro, 2010: 300–309). Methodology. The analysis includes the basic values and principles assumed by Spanish culture, the evolution towards a modern society in which the citizen has rights and duties enshrined in the Constitution that justifies and legitimizes tax system and therefore taxes and a critical vision and an approach to our tax model through its ultimate purpose to contribute to defray public spending. All of these based on the principles and values established in the Spanish Constitution, which enshrines the rights of the citizen and, through them, supports the conception of the State itself. It also provides a modern approach to the future of our society and guarantees the legitimacy of our tax system. The result of the research. The analysis shows that the ultimate goal of the tax system is to contribute to public spending by the State. Therefore, in the contribution and control of spending, we find the guarantee that the State has healthy public accounts (deficit reduction, less public debt, and strict control of spending), so that the State has greater sovereignty and economic decision-making capacity. It allows the country to meet the objectives of the Constitution for any advanced society, such as peace, equality, justice, freedom and well-being of its citizens.
