Opis:: W ocenie TK od ustawodawcy wymaga się, aby prawo było tworzone w sposób klarowny. Nie zostało to wzięte pod uwagę w przypadku nowelizacji Ustawy z 13 września 1996 r. o utrzymaniu czystości i porządku w gminach. Narzucono gminom obowiązek zorganizowania systemu odbierania odpadów komunalnych od właścicieli nieruchomości, którzy mieliby ponosić tego koszty w drodze opłaty za gospodarowanie odpadami komunalnymi. W ustawie jednak nie sprecyzowano charakteru tej opłaty. W konsekwencji powstała niejasność, który z organów nadzoru nad działalnością jednostek samorządu terytorialnego jest właściwy do zbadania uchwał podejmowanych na podstawie ustawy o utrzymaniu czystości i porządku w gminach. W tej kwestii wypowiedziały się sądy administracyjne, jednak wyrażone stanowiska były rozbieżne, mimo iż oparte były na tych samych aktach prawnych. W artykule ukazano polemikę organów publicznych.
From Constitutional Tribunal point of view, lawmaker is obliged to create law in possibly clear way. It was not taken into consideration in case of amendment to act from September 13th 1996 regarding keeping cleanliness and order in boroughs. Boroughs had to organize pick up system for municipal waste from property owners, who would have to cover the costs of the whole process as municipal waste management fees. However, the act does not define the character of this fee. As a result there is the uncertainty, which organ of supervising the local self-government units activities is correct to research on resolutions taken basing on keeping cleanliness and order in boroughs act. There are few statements issued by administrative courts, though they are incompatible, despite the fact that were based on same deeds. The article shows the polemic of public bodies.

Zainspirowany twórczością Augusta Strindberga, autor dramatu poszukiwać będzie nowych dróg ekspresji. Analizowany utwór jest przykładem dramatu stacyjnego, który będzie ulubioną formą dramatopisarzy ekspresjonistycznych.

Opis:: The aim of this article is to identify the relation between transaction costs and the law, both on theoretical and practical grounds. In literature various approaches on the issue of transaction costs are presented, but it was Ronald H. Coase’s discovery and explanation that turned out to be one of the most crucial determinants of the development of Law & Economics. Thereby, the findings of economics on the issue of transaction costs are interfuses L&E as a jurisprudential movement. Detailed analysis of selected current Polish legal regulations lead to a conclusion that some of those regulations generate transaction costs, while other limit the ability to transact. Concurrently, legal regulations that foster reduction of the level of transaction costs are indentified. In general conclusion it can be asserted that the previous assumption – legal regulations can affect transaction costs in both positive and negative way – is true.
Celem niniejszego artykułu jest identyfikacja relacji pomiędzy kosztami transakcyjnymi a prawem, tak w płaszczyźnie teoretycznej, jak i praktycznej. W literaturze przedmiotu zagadnienie kosztów transakcyjnych znajduje różne ujęcia, jednak to odkrycie i wyjaśnienie znaczenia kosztów transakcyjnych przez Coase’a okazało się jedną z najbardziej kluczowych determinant rozwoju Law & Economics. Tym samym dorobek nauk ekonomicznych w zakresie kosztów transakcyjnych przenika się z L&E jako nurtem nauk prawnych. Szczegółowe analizy wybranych przepisów obowiązującego polskiego prawa prowadzą do wniosku, że niektóre z regulacji prawnych generują koszty transakcyjne, inne zaś ograniczają możliwość dokonywania transakcji. Jednocześnie zidentyfikowane zostały przepisy, które sprzyjają zmniejszaniu kosztów transakcyjnych. W uogólnionej konkluzji można zatem uznać za prawdziwe przyjęte założenie o możliwości oddziaływania tak pozytywnego, jak i negatywnego przepisów prawa na wielkość kosztów transakcyjnych.

Opis:: A crucial element of the mechanism to prevent corruption in public administration is the explicit procedure of reacting to corruption events, regardless of whether it is based on ISO procedures or if it results from another system of legal solutions. The statutory anti-corruption solutions introduced in public institutions in the form of management control involve the staff abiding by ethical values, and they serve to improve the transparency, legal conduct, and ethics in the operations of a public administration office. The results of empirical research confirm that the implemented management control procedures form integral parts of the anti-corruption system in public entities.

Opis:: The authors have recognized that to create the novel’s characters, both individual and collective, Henryk Sienkiewicz willingly uses the metalinguistic statements. The analysis included nearly 50 metalinguistic statements present both in the narrative part and in the dialogs. In the center of those statements there are lexemes speech, word, language. The authors searched for the answers to two fundamental questions in what way the metalinguistic remarks:1) create the reliable, medieval reality presented in the The Knights of the Cross?2) remarks update the novel’s problems?Using the metalinguistic notes to create the historical reality of the novel was the deliberate and effective action. Thanks to it Sienkiewicz illustrates the ethnic diversity of medieval Poland inhabitants, he also shows the difficulty in communication between representatives of different nations. Thanks to metalinguistic remarks the author of a novel indicates the role of the Latin language in the former custom; he also shows the language specificity of the different society layers. Metalinguistic comments reveal the parallels between the fictional reality of the novel and the reality of the times in which Henryk Sienkiewicz lived and worked. In metalinguistic notes the clearly negative evaluation of the German language and its users is shown. The linguistic situation in the State of the Teutonic Knights, which is shown in the novel, indicates similarities to situation under Prussian rule in the nineteenth century.

Opis:: VAT is the main indirect tax in Ukraine, among other countries, providing one of the largest items of state budget revenues. The presence of the VAT refund procedure and the need to cover public spending with the revenues from VAT administration require that an effective method of planning and forecasting VAT revenues for the new fiscal year be used. The purpose of the article was to analyze the effectiveness of two methods of forecasting of VAT revenues, such as the moving average method and the method of correlation and regression. This was done by analysing the effectiveness of forecasts made for previous years and comparing them with actual data to make the forecast of VAT revenues using these methods for 2014–2016 years and identifying the main causes of problems in the forecasting process. The results show that the forecasts based on two methods (correlation and regression analysis and double moving average) are sufficiently accurate. After making certain adjustments, these methods can be used at the national level.

Opis:: The aim of this article is to present the main thesis of the theory: The Evolving Systems Approach to Creative Work developed by an American psychologist Howard E. Gruber and his co-workers and students. The authors of the study, inspired by this approach, use it in their individually carried out research to outline the theoretical framework of it, define study cases and draft explanations and interpretations of the experiences of the researched persons in individually conducted research on the creative work of Polish female directors and academic teachers implementing new didactic solutions into the students’ education process. The authors present in the article excerpts of the report on the process of analysis and interpretation of data from qualitative interviews and analysis of documents related to creative work of the research participants.
Celem opracowania jest przedstawienie głównych założeń teorii The Evolving Systems Approach to Creative Work wypracowanego przez amerykańskiego psychologa Howarda E. Grubera i jego współpracowników oraz uczniów. Autorki opracowania zainspirowane tym podejściem wykorzystują je w swoich badaniach do nakreślenia ram teoretycznych, zdefiniowania przypadków oraz wyjaśnienia i interpretacji doświadczeń badanych osób w prowadzonych indywidualnie badaniach, dotyczących twórczej pracy polskich reżyserek i nauczycieli akademickich wdrażających nowe rozwiązania dydaktyczne do procesu kształcenia ze studentami. Autorki przedstawiają w artykule fragmenty relacji z procesu analizy i interpretacji danych pochodzących z wywiadów jakościowych oraz analizy dokumentów związanych z twórczą pracą badanych osób.

Opis:: Non-governmental organisations in recent years have gained new possibilities to realise their initiatives, thanks to the strong need among corporations to maintain their socially-desired image, which translates into their greater openness towards possible cooperation with the third sector. Several representatives of NGOs, utilising the latest technological solutions, are improving both the extent of their influence and its effectiveness. As multiple examples from Lubusz Voivodeship illustrate, the strategy of cooperation between business and non-governmental organisations can take on many forms, not necessarily based on financial support. Currently, a bargaining chip in the case of both sides is their knowledge capital. Corporations striving to maintain a positive image in the surroundings they function within are more eager to support social initiatives, recognising in it a possible path to gaining a competitive edge. In my article, I intend to reflect the specificity of the business/NGO relation and its determinants on the basis of selected examples from Lubusz Voivodeship. By analysing case studies, I will try to indicate the most common mutual expectations and construct a vision of a “perfect partner”. The context of analysing the quality of relations between business and NGO’s is social capital, which is an important value determining its shape. This arises from the belief that an organisation’s social capital has a meaningful impact on its attractiveness in the eyes of a potential partner. In my paper I will also present the most recent data, depicting the level of trust among the local community.

Opis:: Due to the growing importance of local pro-development attitudes and non-governmental organizations for development, it is important to look at their activities in different subregions. In this work the author presents the results of research carried out in the Leszno subregion on the presence of elements of social capital, the organizational and financial sustainability of NGOs, and their cooperation with public administration in the context of their impact on local development. In addition, through a comparative analysis of selected issues, it recalls the good practices of NGOs in Switzerland which, because of the long tradition of their operation and the experience gained, can also be used in Polish settings.

Opis:: The aim of this article is to assess the public finance imbalance in selected CEE countries. The study examines public debt and deficit in six European Union Member States: Bulgaria, Croatia, the Czech Republic, Poland, Romania, and Hungary. The study revealed the growing imbalance in public finance in these countries, resulting mainly from the increased public debt. Moreover, the examined countries have problems with the implementation of supranational fiscal rule for budget balance, which resulted in the imposition of the Excessive Deficit Procedures.
Przedmiotem podjętych analiz jest ocena nierównowagi finansów publicznych w wybranych krajach Europy Środkowo-Wschodniej. W opracowaniu zbadano kształtowanie się długu publicznego oraz deficytu w sześciu państwach Unii Europejskiej: Bułgarii, Chorwacji, Czechach, Polsce, Rumunii oraz na Węgrzech. Przeprowadzone analizy wykazały, że w państwach tych narasta nierównowaga, wynikająca m.in. ze wzrostu zadłużenia publicznego. Ponadto poddane ocenie państwa wykazują problemy z realizacją reguły przewidzianej dla deficytu, co wpłynęło na nakładanie na nie procedur nadmiernego deficytu.

Opis:: Jedną z powszechnie przywoływanych w literaturze koncepcji kultury organizacyjnej jest ujęcie E. Scheina, który ujmuje kulturę organizacyjną funkcjonalnie, interpretatywnie i dynamicznie, wskazując na jej złożoność i wielopoziomowość. Schein przedstawił także autorski sposób badania kultury organizacyjnej, który nazwał clinical research (CR). W tekście autorki omówiły podejście CR i wskazały zakres wspólnych rozwiązań metodologicznych między CR a diagnozą psychologiczną, interwencją socjologiczną oraz etnografią. CR z diagnozą psychologiczną łączy poszukiwanie przez organizację wsparcia (u badacza) i wymaganie zaangażowania członków organizacji w badanie. Podobnie jak interwencja socjologiczna A. Touraina CR posługuje się własnymi pojęciami badanych, opiera się na ich refleksyjności i akceptacji konkluzji badania. Analogicznie do etnografii CR każdą organizację traktuje jako odrębny przypadek, zaś badacza uczula na stałe budowanie relacji z badanymi. Wykorzystanie CR w badaniach kultury organizacyjnej jest zatem unikalnym w procedurach badań organizacyjnych przykładem integracji metod badawczych nauk społecznych i humanistycznych.
Edgar H Schein`s approach is one of the most commonly quoted concepts of organizational culture. In it, he recognized organizational culture functionally, interpretatively, and dynamically, pointing to its complexity and multi-levelness. Schein also presented an original method of studying organizational culture, one called clinical research (CR). The authors of this paper discuss the clinical research method and indicate the scope of methodological solutions shared between CR and psychological diagnosis, sociological intervention, and ethnography. The search for support (from the researcher) and the requirement to involve members of the organization are the elements linking CR with psychological diagnosis. As is the case with the sociological intervention of Alain Touraine, CR uses own concepts of the subjects based on their reflectiveness and acceptance of the key findings. And, finally, similarly to ethnography, CR treats each organization as a separate case and sensitizes researchers to permanently build a relationship with their respondents. Therefore, among organizational research procedures, using CR for organizational culture research is a unique example of integrating research methods from within social sciences and the humanities.

Opis:: Artykuł opisuje badanie audytoryjne oraz akustyczne przeprowadzone na nagraniach prezenterów czterech stacji radiowych BBC: BBC Radio 1, BBC Radio 4, BBC Radio 5 Live i BBC World Service w trzech typach audycji: wiadomościach, wiadomościach sportowych oraz programach rozrywkowych. Badanie miało na celu znalezienie odpowiedzi na pytanie, czy występują różnice w akcencie brytyjskich prezenterów reprezentujących różne stacje radiowe BBC oraz prowadzących różne typy audycji, a także - jeśli w istocie tak jest - w jakich kontekstach używany jest formalny, standardowy brytyjski akcent RP oraz jaką pełni funkcję. Szczegółowym analizom poddano dwa zjawiska fonetyczne: h-dropping, czyli elizję dźwięku /h/ w pierwszej akcentowanej sylabie w słowie, oraz /t/ glottalling, czyli zastąpienie głoski /t/ przez zwarcie krtaniowe. Badanie potwierdziło występowanie różnic w akcencie prezenterów. W wiadomościach względnie często zauważono występowanie standardowego akcentu RP, natomiast w programach rozrywkowych oraz wiadomościach i reportażach sportowych znacznie rzadziej. Badanie pokazało także, że różnice w wymowie prezenterów odzwierciedlają różnice poszczególnych stacji radiowych: stacje ukierunkowane na młodych odbiorców mają większy zasób regionalnych, niestandardowych akcentów aniżeli stacje ukierunkowane na dorosłych odbiorców, skupiające się na przekazie informacji.

Opis:: Von 1981 bis zur sogenannten Wende 1989 (und sogar einige Jahre darüber hinaus) veröffentlichten der Verlag C.H. Beck in München und die Verlagsgruppe Kiepenheuer in Leipzig gemeinsam die Bibliothek des 18. Jahrhunderts. Die Reihe war eines der großen, auf langfristige Zusammenarbeit angelegten Unternehmen zweier Verlage im geteilten Deutschland. Mehr als 40 zum Teil mehrbändige Werke konnten in ihr erscheinen. Der hier vorgelegte Bericht versucht, die Bedingungen der damaligen Kooperation zu rekonstruieren und darüber hinaus etwas von der Atmosphäre zu vermitteln, in der die gemeinsame Arbeit stattfand.
Od roku 1981 do tzw. Przełomu w 1989 (a nawet kilka lat dłużej) wydawnictwa C.H. Beck z Monachium oraz Kiepenheuer z Lipska publikowały wspólnie Bibliothek des 18. Jahrhunderts [Biblioteka XVIII wieku]. Seria ta była jednym z największych, długofalowych przedsięwzięć dwóch wydawnictw w podzielonych Niemczech. W serii tej ukazało się ponad 40, głównie wielotomowych, dzieł. Przedstawiona relacja jest próbą rekonstrukcji warunków ówczesnej współpracy obu wydawnictw oraz towarzyszącej jej atmosfery.
From 1981 until the Fall of the Berlin Wall in 1989 (and even several years beyond) the publishing houses C.H. Beck in Munich and Kiepenheuer in Leipzig issued jointly Bibliothek des 18. Jahrhunderts [Library of the 18th Century]. This series was one of the big projects planned for a long-lasting cooperation between two publishers in divided Germany. More than forty works of literature, some of them in several volumes, were issued within the scope of this ,Library‘. The present report is an attempt at reconstructing the conditions of cooperation during that period and to convey something of its atmosphere.
