Opis:
The Inspire Directive introduces a conceptual framework related to spatial data infrastructure, unifying the issues related to the access to spatial data within the European Union. The Directive was implemented into Polish law in the Act of 4 March 2010 on spatial information infrastructure. Both the Directive and the Act provide for the possibility of introducing limitations to access to spatial data and services in connection if access would adversely affect, among others, intellectual property rights. The carried out study shows that most poviats subject to the study have not acquired the required scope of intellectual property which may potentially result in the access limitations.

The article aims to outline the divergence between authorities on publicly available spatial data in Poland, using the example of a dispute between the Polish Data Protection Authority and the Surveyor General of Poland concerning the publication of the numbers of land and mortgage register on the Polish spatial information website Geoportal. The issues of whether the number of the land and mortgage register is personal data and grounds for processing land register numbers from the DPA’s and Surveyor General’s perspectives are analyzed. Then, the reasons for this conflict and, more broadly, for disputes between authorities are examined. It is hypothesized that the main reason for this dispute is that the different aims drive different authorities empowered in the regulation of processing publicly available data.

Opis:
The Water Management Information System is an important instrument of water resource management that enables the collection, processing, publishing and sharing of water management data. The Water Management Information System is an integral part of proper and effective water management, the vision of which has been shaped over the last decades, transforming into an increasingly effective system adapted to the applicable legal and organizational conditions. The main feature of the information system is its multi-tier nature, providing access to other information resources, which will allow the utilization of data imported from other thematic databases. In this manner, on the basis of appropriate regulations, access to current data from various sources, a uniform reference system and proper use of water management data in planning and programming socio-economic development will be ensured. In the paper, WIMS will be characterized as a public register, taking into account the categories of data collected in the context of restricting access to data. The subject of the considerations will be the identification of important elements in the field of ensuring access to information on water management, as well as its dissemination through the WMIS.

The article analyzes the concept of hacking, taking into account its evolution from a neutral term that means going beyond specific schemes of action to a negative context in which the concept is often equated with a cyber-security breach or cyber- crime. A study of the understanding of the concept of space and cyberspace, as well as selected cyber threats, shows the impact of the development of modern technologies on the blurring of the boundaries between real and virtual space. Based on selected cases in the field of cybercrime, the specific features of actions in cyberspace and their effects in the real world are indicated. New methods of cybercriminals open up new areas of criminological research on the geography of crime. The paper points out the involvement of State-Actors in cyber attacks, which makes it challenging to eliminate safe harbors for cyber criminals and reduces the effectiveness of instruments of international cooperation in criminal cases.

The subject of this article is the discussion of infrastructure for spatial information as an example of opening public sector data. The main aim of this paper is to identify the concept of opening public data. All areas of public administration activities at the national and local government level are more or less related to the use of spatial data. The article discusses the concepts of: spatial data, spatial information system. The article focuses on the work of the European Union on increasing the integration of spatial information systems. Polish public administration is becoming increasingly aware of the benefits of opening access to public data. This paper presents an enormous value of opening data, which should be disposed of appropriately and properly implement.

The Statement of Applicability (SoA) is a mandatory document ISMS that you need to develop, prepare, and submit with your ISO 27001, and it is crucial in obtaining your ISO 27001 Risk Assessment and ISMS certification. According to ISO/IEC 27001, Information Security Management System is a collection of ‘that part of the general management system, based on the approach to business risk, to establish, implement, operate, monitor, review, maintain and improve information security. ISO/IEC 27001 specifies the requirements and implementation process for the Information Security Management System. However, implementing this standard without a good SoA document may prove impossible. The article presents a system model for the construction of SoA for ISMS and its certification following the ISO 27001 standard. This model aims to provide instruments for designing and generating an SoA document in relation to ISMS, covering all information processes in GIS. This model allows organizations to evaluate their current state of GIS information asset security implementation according to the best practices defined in ISO/IEC 27001. The proprietary model proposed in this article is assessed from a multi-stage perspective, which confirms that the proposed draft Statement of Use document makes a valuable and innovative contribution to information security management by considering the best practices in this field.

The purpose of the article is to analyze the impact of legal regulations on the use of spatial data related to Poland's tourism assets and its cultural and natural heritage through spatial information services used as part of spatial information systems, both in the public and private sectors. The conducted considerations are to allow for the formulation of de lege lata remarks and de lege ferenda postulates regarding the existing legal basis for the functioning of the spatial information infrastructure. The proposed solutions should have a positive impact on improving the efficiency of using the data collected in this infrastructure for purposes related to the promotion of Poland's cultural and natural heritage.

Opis:
Article focuses on the problem of copyright protection of spatial data used to create and perform multimedia works. Multimedia are hybrid works because they are constructed from two main layers (audiovisual work and computer program) but should be treated as one product according to the copyright. Thus spatial data included inside such a works have to be protected within them as a one product. Video games were chosen as an example of multimedia (hybrid) works. First chapter shows crucial role of (mostly) artificial spatial data in the creation and usage of video games. Spatial data describe game environment’s location of every (audio)visual object but are encoded in, and used by computer program to perform video game properly. As such spatial data are one of the reason for treating video game as unified product, consisting amalgamation of its elements. Because spatial data are binder of the video game both layers, they should not be subject of separated copyright protection. Thus to protect spatial data included in video game, the video game itself needs to be protected properly. However, because video games are hybrid works, they legal nature is not determined yet. There is also no legal definition or specific copyright regulation for video games. Because of this legal loophole, different doctrinal concepts together with European Court of Justice judgements, on the video game’s copyright protection, were analyzed. This was analyzed in chapter two. Conclusions consist statement that lack of video games legal nature’s determination, and caused by this lack of specific copyright protection of video games may lead to not enough copyright protection of the video game as a whole product as well as spatial data included inside. Specific regulation instead of casuistic judgements is needed, for ensure the video games market grows.

The use of spatial data allows implementation improvement of the public entities tasks in the field of health care. Both government and territorial self-government administration, within the scope of their competence, can process such information resources. The aim of this article is to present the role of spatial data in healthcare management processes. Local self-government units, in order to ensure equal access to health care services, develop, implement and evaluate the effects of health policy programmes, as well as take other actions resulting from the identified health needs and health condition of the inhabitants. These tasks of the local government may be carried out more effectively through the use of spatial information systems, facilitating data analysis, which may be fully or partially automated. In the Polish legal system, regional maps of health needs are created by voivodes, while the Nationwide Map of Health Needs is developed, established and updated by the Minister of Health. Spatial information systems can be a useful tool to support the implementation of tasks by the above-mentioned competent bodies and verification of the achieved results, provided that appropriate quality of collected data and interoperability of used solutions is ensured at the organisational, semantic and technical level.

The European GREEN SURGE project analyzing the best European practices in urban green infrastructure (GI) management showed that there is a lack of uniform solutions on national levels. The implemented GI are locally initiated and have the scope of selected cities. There is a need to standardize approaches to GI development in all cities of EU member states. An important current goal is to develop organizational assumptions for GI implementation. Standardization of the organizational structure of UGMB is necessary in order to give the right access and management licenses to, for example, create and operate an urban greenery information system. The main objective was to develop an organizational concept for Urban Greenery Management Bodies (UGMB) in line with the Urban Greenery Management System (UGMS) concept and key Green Infrastructure benefits. Three main competency poles responsible for optimal GI implementation are identified e.g. planning (expert body), administration (regulatory body), and field operations (executive body). The proposed concept of UGMB organizational structure can be a model for other EU member states, but also for other countries applying for EU membership.
