Opis:
No separate legislative acts are in force in Poland or the European Union that would regulate waste wood issues directly. Therefore, the analysis presented in this paper concerns legislation applying generally to waste, including waste wood. The issues discussed include terminology, classification and waste wood management. Pursuant to Directive 2008/98/EC, waste is any substance or object which the holder discards or intends or is required to discard. This definition of waste has remained unchanged in the amended Waste Act in Poland. Waste classification issues are partly resolved in the European Waste Catalogue. A national waste catalogue has been created, in which waste has been divided into 20 groups, depending on the source from which it is generated. Waste wood has been allocated to seven groups, and in particular to group 03. It is worth mentioning that the catalogue does not include a number of wood waste groups, namely OSB, fibreboard, plywood, board cutting waste, as well as products made from them, etc. This leads to problems with the interpretation of regulations concerning, in particular, the combustion of biomass. The priority task in waste management is waste prevention, followed by the preparation of waste for reuse, its recycling and finally other recovery methods, i.e. energy recovery or waste disposal. In view of the above, energy recover, as well as the reprocessing of waste into materials to be used as fuel or for backfilling or landfilling operations, is not a form of recycling. In spite of these assumptions, legislative acts are in force which regulate actions aimed at increasing the use of waste wood for energy recovery purposes. Regulations promoting the use of waste wood for energy recovery purposes can also be found in Polish legislation. The paper points out to the absence of clear and comprehensive legal solutions concerning waste wood management. This situation results in serious difficulties in the rational use of waste wood as one of the main sources of timber. It also leads to problems with estimating the quantity of waste wood and, consequently, prevents the correct assessment of its potential for use by particular sectors of the economy.

Opis:
The paper presents the possibilities of forest landscape planning based on an analysis of the existing legal acts (laws and regulations) and other documents (strategies, directives and statements) in the field of land−use planning, nature conservation and forestry. The need to take actions relating to forest landscape planning is a consequence of, inter alia, the growing importance of the non−productive forest functions driven by the rising social expectations of forests. The obtained results relate to forest landscape planning in Poland and other European Union countries. It has been demonstrated that forest landscape significantly affects the quality of peoples’ lives, and at the same time it is constantly threatened. An appropriate landscape planning is one of the priorities of Polish spatial policy. The results suggest that the issues relating to landscape planning are becoming increasingly important in the implementation of the principles of forest management in Poland.

Opis:
Due to the need to ensure protection of the forest environment against so−called forestry damage, the Polish legislator introduced a number of legal solutions (both in the field of criminal law and the law of misdemeanors), aimed at eliminating human behaviors that harm the forest as a priceless good. Despite the multiplicity of legal regulations, in practice there are situations of improper use (i.e. incorrect legal classification of an act), which in turn translates into the level of forest legal protection as property of special value. The paper analyses criminal law (sensu largo) in terms of penalizing behaviors that are a manifestation of forest damage, but also indicates their correct application in the situation of for example felling and then theft of wood or theft of wood itself. It should be pointed out that the current provisions on the protection of forest property, contained in the Penal Code (PC) of 1997, as well as the Code of Misdemeanors (CM) of 1971, differ significantly (while for the legal qualification: felling and then the theft of trees on the basis of PC should reach for the disposition of the provision of Article 290 of the PC in conjunction with Article 278 PC, then under the CM, only the provision of Article 120 of the PC). The non−uniformity of penal provisions and provisions regulating liability in the event of an offense aimed at ensuring the protection of forest property against forest damage creates a necessity to clarify them, but also to indicate an appropriate model for the classification of acts subject to their instruction.

Opis:
Polish constitution and other legal acts realize that state−own forests are the legacy of every citizen of Poland, and admission into it for recreation – including horse riding – is one of subjective rights, which should be effectively protected. Obviously the ‘theory of the owner’, where the foresters realizing in state−own forests only owner's privileges based on civil law, and both sides of that relation under law are equal, is not adequate on the area of administration and delimitation of these rights, as the citizen is always the weaker side.
