W artykule podjęto próbę ustalenia, czy koncepcja etyczna J. Benthama może służyć jako teoretyczne uzasadnienie dla ustawowej dereifikacji zwierząt. Autor ten dostrzegał związek przyczynowy zachodzący pomiędzy okrucieństwemwobec zwierząt, a uznaniem ich w systematyce prawa za rzecz. Prawdziwość tej tezy budzi jednak wątpliwości. Obowiązek humanitarnego traktowania zwierząt zawarty w ustawie nie jest wynikiem uznania, że zwierzę nie jest rzeczą. Prowadzi to do wniosku, że ustawowa dereifikacja zwierząt jest nie tyle koncepcją prawną, co ideologiczną. O ile sama w sobie nie poprawia ona losu zwierząt, to na płaszczyźnie prawnej otwiera drzwi dla przyznania zwierzętom podmiotowości, a w przyszłości nawet praw podmiotowych.
The article examines the question of whether J. Bentham’s ethical theory can serve as a theoretical justification for the statutory dereification of animals. This author saw a causal connection between cruelty to animals and classifying them as a thing(res) in law. The correctness of this conclusion appears debatable, however. The obligation to treat animals in a humane manner is not connected to and, in particular, does not issue from a statutory declaration that an animal is not a thing. Thisleads to the conclusion that statutory dereification is an ideological concept rather than a legal one. While by itself it does not improve the situation of animals, it nevertheless, in a legal perspective, opens the door to recognizing them as subjectsof law, and, in the future, possibly to granting them rights.

Opis:
The analysis undertaken in this article covers two issues: the legal status of water facilities and the methods of management of those devices that are owned by the State Treasury. The first one has not been the subject of interest of legal sciences for a long time. The doubts related to it were present in legal debate only through the case law of the administrative courts. The ground-breaking importance is held mainly by the judgment of the Supreme Administrative Court of 16 January 2009. It is the first judgment that settled on the legal status of the water facilities. The Administrative Court in Warsaw opined that the weir on the river was a part of the soil surface covered with fl owing water (river), however the Supreme Administrative Court questioned this view by affirming that such devices were subject to separate ownership and thus formed an exception to the principle of superficies solo cedit. Equally controversial is the governance of the water facilities owned by the State Treasury. The provisions of the Act on Water Law are inconsistent and incoherent. The problems arising in this context remain largely unnoticed in the case law of the administrative courts. The article is summed up by complex de lege ferenda conclusions, designed to remove incoherent and inconsistent provisions of the Water Law.

The legal-financial status of the Agricultural Property Agency is complex. Rights and obligations of the financial nature of the public are interspersed with numerous powers and duties of the sphere of private law. Specific elements shaping financial status Agency are organizational relationship and the capital of other legal entities, including primarily with the Treasury and the companies controlled by the Agency. They occur in the context of normative pass Agency to the public finance sector and its companies to the category of public sector entities. In view of the takeover by the executive agencies, a significant part of the tasks previously performed by the state without legal personality, budgetary establishments, precisely in this area normative appeared completely unique opportunity to examine the impact of the construction of legal personality to changes in the shape of subjectivity.

Opis:
Since the beginning of the 90’s there have been strong emotions associated with the emergence of many groups called cults in Poland. These groups are accused of illicit and unethical methods to recruit new members and their psychological dependence, resulting in blind obedience to leaders. Sects, carrying out their activities in the form of various types of religious formations, religious associations, churches and other religious organizations, brought to life after 1989 in Poland, operate on the basis of three acts, which include: 1. The Constitution of the Republic of Poland of 2 April 1997 ; 2. The Act on Guarantees of freedom of conscience and religion of 17 May 1989; 3. Act of April 7, 1989 r.- Law on Associations. Given the range of opinions and concerns regarding the issue of regulation of sects in Poland this question , posed in particular by the lawyer, of the legal status of the activities of religious sects , and in a broader aspect of their place in the modern world, seems to be reasonable, what is confirmed by the media , but mostly by the facts of the activities of these groups in society. As for the international standards, nowadays there are more and more information about the negative effects of the activity of sects throughout the world, what raised interest of social institutions and the authorities of individual countries in this subject. It encouraged the authorities to create an overall analysis to assess the degree of harmfulness of newly established movements, both in a national and international level. Especially in the late eighties of the twentieth century all kinds of reports and other documents devoted to the problem of sects and new religious movements began to appear. The theme was taken also by the representatives of Communities: Council of Europe, the European Union, as well as organs of the Organization for Security and Cooperation in Europe. These acts are only recommendations. They are mainly opinion- forming acts and have no legal force. However, in countries, they are crucial, because they are issued by important authorities To sum up, the activity of sects arouses interest in Europe. Although each country has different guidelines and varied range of impact, collaboration is indispensable nowadays.
