Opis:
The Court of the Eurasian Economic Union was created in 2015 as a judicial organ with jurisdiction over a range of subject matters within the Eurasian Economic Union. It replaced the Court of the Eurasian Economic Community, which operated within the Eurasian Economic Community and its Customs Union (2012-2014). Though the Union become the next step in the integration process of the post-Soviet area, the newly created Court has not been given de jure a successor status. The Court of the Union was set up anew as one of the four institutional bodies in the structure of the Union. It was empowered to settle disputes between the Member States, as well as to consider different types of actions brought by private actors (economic entities only). The interpretative function of the Court was enshrined as “competence on clarification.” Moreover, the Commission, the main executive and regulative organ, was not given locus standi in actions against the Member States to enhance their compliance with the obligations of EAEU law. Preliminary jurisdiction was also cut down as compared to the Court of the Community or other regional integration courts. However, some new functions were given to the Court, and its five years long practice shows a clear tendency to substitute missing powers with those given but in a broader context, as well as its aspirations to play a consolidating role for the legal order of the Union.

Artykuł 34 EKPC określa kryteria dopuszczalności wniesienia przez jednostkę skargi do Europejskiego Trybunału Praw Człowieka, ale stanowi również, że skarga może być wniesiona przez grupę jednostek, które twierdzą, że są ofiarą naruszenia praw zawartych w Konwencji lub w jednym z Protokołów do Konwencji. Celem artykułu jest analiza orzecznictwa Trybunału, które potwierdza, że ochrona praw grup jednostek może również wynikać z orzeczenia Trybunału wydanego w indywidualnej sprawie, jeżeli tylko wnioskodawca udowodni, że jest członkiem danej grupy wrażliwej i cała grupa wymaga przyznania takiej samej ochrony. Ważne jest, aby wrażliwa grupa i jej członkowie byli identyfikowani przez pryzmat charakterystycznych kryteriów oraz wspólnych okoliczności, w których ich prawa zostały naruszone.
Article 34 ECHR sets forth criteria for the admissibility of individual applications to the European Court of Human Rights but it also states that applications can be submitted by a group of individuals who claim to be a victim of a violation of rights enshrined in the Convention or one of the protocols to it.The aim of the article is to analyze of the Court’s jurisprudence which confirm that the protection of the rights of a group of individuals may also result from a decision of the Tribunal issued in an individual case if only applicant proves that he is a member of a vulnerable group and the whole group require the same protection. It is important, that the vulnerable group and its members must be identified by a set of characteristics criteria and by common circumstances in which their rights have been violated.

In recent years a growing interest in issues related to the protection of rights andsafeguards of ‘children in conflict with the law’ can be observed at the internationallevel. In the light of both the Convention on the Rights of the Child and the Councilof Europe Guidelines on child-friendly justice, in cases concerning children in conflictwith the law, an important element of the system of justice is to provide them with a fairtrial in which their rights and safeguards are not minimised or denied under the pretextof the child’s best interest. The European Union is currently working on a proposalfor a Directive of the European Parliament and of the Council on the proceduralsafeguards for children suspected or accused in criminal proceedings. The aim of theseworks is to set common minimum standards throughout the European Union on therights of children who are suspected or accused in criminal proceedings and childrensubject to European arrest warrant proceedings. One of the problems discussed in thecourse of works on the proposal for the directive is the issue of defining the scope of its application regardless of whether the proceedings in the cases of children in conflictwith the law are treated as ‘criminal proceedings’ under national law.During the period of work on the proposal, the European Commission funded aninternational research project focused on the protection of the rights of interrogatedjuveniles. The project entitled ‘Protecting Young Suspects in Interrogations: a studyon safeguards and best practice’ was coordinated by the University of Maastricht. Itaimed at comparing juvenile justice systems in five countries (England and Wales,Belgium, the Netherlands, Poland and Italy), with particular emphasis on the rights andsafeguards provided to juveniles suspected of breaking criminal law during their firstinterrogation connected with the alleged offence. Comparative legal analysis of juvenilejustice systems in the participating countries revealed that, as opposed to Poland, inall other countries the procedure applied in juvenile cases was principally the criminalprocedure. Moreover, unlike in Poland, it was commonly accepted that in the casesconcerning children in conflict with the law, respecting the child’s best interests didnot mean depriving them of the rights and safeguards granted to adults in criminalproceedings.In Poland, the proceedings in the cases concerning children in conflict with thelaw who are accused of displaying signs of demoralisation or committing a punishableact are regulated in a complicated and unclear way. Legislators assume combining theprocedural provisions included in the Juvenile Act, the provisions of civil procedureand, to a limited extent, the provisions of criminal procedure. Contrary to legislativeassumptions, the first interrogation of a juvenile suspected of punishable acts is mostoften conducted by the police before the institution of juvenile proceedings via thefamily court. Although this first interrogation is often decisive in the further courseof proceedings, the Juvenile Act does not contain detailed regulations in this regardand only briefly refers to the appropriate application of the provisions of the Code ofCriminal Procedure.Empirical research carried out in Poland as part of the project involved individual interviews with lawyers and focus group interviews with both police officers andjuveniles. The results of the research indicate that from the perspective of providingjuveniles with procedural rights and safeguards, current regulations are far fromsatisfactory. Because of the limited scope of the conducted research, it is difficult todraw generalised conclusions. However, the results undoubtedly allow the conclusionthat the issues regarding providing juveniles interrogated by the police with proceduralrights and safeguards ensured in international documents deserve much moreattention than has been paid so far. The results of the conducted empirical researchconstitute another argument for the need of an in-depth discussion on the necessary systemic changes in the Polish juvenile system of justice which is also supported by thejudgments of the European Court of Human Rights in the cases Adamkiewicz v. Poland and Grabowski v. Poland.

In EU law a lot of attention has recently been paid to personal data protection standards. In parallel to the development of the general EU rules on data protection, the Members States also develop cooperation between law enforcement agencies and create new information exchange possibilities, including the processing of personal data of participants in criminal proceedings. The aim of this article is to analyse whether the personal data of victims of crime are safeguarded according to the standards of the Charter of Fundamental Rights. For this purpose, the author analyses two directives: 2012/29/EU, which regulates minimum standards of victims of crime; and 2016/680/EU (also known as the Law Enforcement Directive), which regulates personal data processing for the purpose of combating crime. Based on the example of the Polish legislation implementing both directives, the author comes to the conclusion that the EU legislation is not fully coherent and leaves too much margin of appreciation to the national legislator. This results in a failure to achieve the basic goals of both directives. The author expects the necessary reflection not only from the national legislator, but also from the European Commission, which should check the correctness of the implementation of the directives, as well as from national courts, which should use all possible measures to ensure that the national law is interpreted in the light of the objectives of the directives.

Opis:
One consequence of the amendment to the Executive Penal Code from 5 January 2011 was the status of a specially protected prisoner. Tis study is based on research aimed at determining the individual and systemic consequences of creating this new category of prisoners. I assumed that these consequences in both aspects would be negative and this assumption was fully confrmed by the empirical material. Te research took place from 2014 to 2017 and consisted of 3 elements: a detailed description of the legislative process, an analysis of statutory, and executive provisions and  an examination of prison practice, whereby interviews were conducted with individuals covered by special protection. Te interviews reveal that these people are treated no differently than those who pose a serious threat to the safety of others and to order in the prison (so-called “N” prisoners) .
Następstwem nowelizacji k.k.w. z 5 stycznia 2011 r. było wprowadzenie statusu więźnia szczególnie chronionego. Opracowanie jest relacją z badań, których celem było ustalenie, jakie są indywidualne i systemowe konsekwencje stworzenia tej nowej kategorii więźniów. Założenie, że konsekwencje te są w obydwu wymiarach negatywne, w pełni potwierdziło się w świetle materiału empirycznego. Badania prowadzone były w latach 2014–2017 i składały się z trzech części: szczegółowego opisu procesu legislacyjnego, analizy przepisów ustawowych oraz wykonawczych, a także badań praktyki więziennej poprzez przeprowadzenie wywiadów z osobami objętymi ochroną. Z wywiadów wynikło, że postępowanie wobec tych osób niczym nie różni się od traktowania tych, którzy stanowią poważne zagrożenie dla bezpieczeństwa innych osób oraz dla porządku w zakładzie karnym (tzw. kategoria „N”).

The article analyses case law concerning national minority protection in the jurisprudence of the European Court of Human Rights and UN Human Rights Committee. The protection of national minorities is realized through protecting individual right of persons belonging to minorities. Due to significant amount of cases and given the importance of discussed issues, the analysis is restricted to three topics: names, education and political participation. The case law has set some important standards in those areas. In most of the analyzed aspects the approach of both organs has been the same, for example in regard to names and surnames of persons belonging to national minorities. The research also showed areas in which the case law was not consistent – while examining cases concerning the same French law regarding wearing of religious clothing by students in state schools, the UN Committee, contrary to the Court, found a violation by the state. However, in the vast majority of studied subjects, the jurisprudence of the Court and Committee is very similar and allows to formulate an international standard of national minority protection. Among national minorities indigenous people enjoy in some aspects greater protection than other groups, which is particularly evident in the Committee decisions.
