    This article analyses the amendments of January 2018 to the Act on the Institute of National Remembrance (INR) of 1998, which has raised doubts in light of international law and provoked diplomatic tensions between Poland on one side and Germany, Ukraine, United States of America and Israel on the other. The INR is a national institution whose role is, among others, to prosecute perpetrators of international crimes committed between 19171990. The article proves that the wording of the amendments is inconsistent with international law, as it ignores the principles of international responsibility, definitions of international crimes, and disproportionately limits freedom of expression. In consequence, it cannot be expected that third states will cooperate with Poland in the execution of responsibility for violation of the newly adopted norms.

    Opis:
    The article is an amended version of the Marek Nowicki Memorial Lecture presented at Warsaw University in 2014. It discusses the contemporary meaning of the right to free expression, concentrating on the basic principles of free speech as well as the limits of the right. In this context, the article pays special attention to British, Polish and European practice (particularly with respect to cases that are relevant for Poland). The specific topics tackled by the author include: free speech and the problem of criminalization of certain acts (e.g. the offence of defamation of public officials), hate speech, freedom of expression and the right of an individual to protect his or her good reputation (including the issue of libel laws), freedom of expression and the right to privacy (including the right to prior restraint on publication), free speech and internet, and the right to privacy versus national security.

    Publiczne prezentowanie barwnych zdjęć zakrwawionych, martwych ludzkich płodów na ulicach, placach, parkingach czy przed cmentarzem w ramach aktywności działaczy pro-life stanowi wykroczenie z art. 140 k.w., w przypadku zakłócenia porządku lub spokoju publicznego bądź wywołania zgorszenia u choćby jednej osoby – z art. 51 k.w. W Polsce normy publicznego zachowania nie dopuszczają narzucania innym, przypadkowym osobom, zdjęć zakrwawionych zwłok ludzkich. Zatem zachowanie takie narusza obyczajność publiczną chronioną przez oba przepisy. Obyczajność ta nie dotyczy bowiem tylko zachowań odnoszących się do sfery seksualnej czy płciowej, lecz jakichkolwiek zachowań dostrzegalnych dla innych osób, które mogą wywołać zgorszenie, sprzeciw, gniew czy potępienie.
    Public presentation of colour photographs depicting bloody, dead human fetuses on the streets, squares, parking lots or in front of cemetery as part of the so-called pro-life defenders is an offense under Article 140 of the Polish Code of Petty Offences. Also Article 51 of the Code of Petty Offences rules that Polish social standards of public behavior disallow all actions that may provoke outrage with at least one individual, which includes imposing on other, random people photos of bloody human bodies. Thus, such conduct violates public decency protected by both legal provisions named above. This standard of moralitydoes not apply to behaviors relating to the sexual or sexual sphere alone, but also to any behavior visible to other people who may cause outrage, opposition, anger or condemnation.
