Dyrektywa 2005/29/WE o nieuczciwych praktykach handlowych obowiązuje od ponad 15 lat. W tym czasie interpretowana była w literaturze przedmiotu, wytycznych Komisji Europejskiej oraz orzecznictwie Trybunału Sprawiedliwości UE. W niniejszym opracowaniu przeanalizowano 12 orzeczeń TSUE z ostatnich pięciu lat (2016–2021). W pierwszej kolejności omówiono stanowisko TSUE w przedmiocie relacji dyrektywy 2005/29/WE do innych instrumentów unijnych i krajowych. Następnie przedstawiono dorobek TSUE w kwestii podmiotowego zakresu stosowania dyrektywy 2005/29/WE. Z uwagi na fakt, że dyrektywa zmierza do ochrony zarówno konsumentów, jak i profesjonalistów funkcjonujących zgodnie z prawem, ma ona znaczenie dla – bez mała – ogółu obywateli UE. W tym kontekście precyzyjne określenie zakresu jej stosowania jest niezwykle istotne dla przedsiębiorców, konsumentów oraz wszystkich praktyków interpretujących prawo krajowe w świetle przepisów dyrektywy (zwłaszcza sądów), a także – choć w mniejszym zakresie – dla ustawodawców krajowych.   During the fifteen years since its adoption, Directive 2005/29/EC on unfair commercial practices has been interpreted in the subject literature, the guidelines of the European Commision and in the case-law of the Court of Justice. The paper analyses 12 judgements of the CJEU imposed in the last five years (2016–2020) in the context of the scope of Directive 2005/29/EC. First, the CJEU’s take on the relationship between Directive 2005/29/EC and other union and national regulations is discussed. Then the CJEU’s acquis regarding the subjective scope of the Directive is presented. In light of the fact that the Directive leads to the protection both consumers and traders operating legally, it is of importance for almost all UE citizens. Thus the precise determination of the scope of Directive 2005/29/EC is tremendously important for traders, consumers and all practitioners interpreting national law in the light of the Directive’s provisions (especially courts), but – also although to a lesser extent – for Member States’ legislators.

This article is an attempt to identify the essence of new positivism, described by Ludwik Ehrlich as a method of interpretation of international law. The evolution of his views on international law is examined with respect to the place of this method from the beginning of 1920s until his retirement in 1961. The article expounds on both the theoretical and methodological aspects of new positivism, according to which judicial decisions should be taken into account in addition to international treaties and customs for the determination of international law. The question of the obligatory force of international law is discussed as being related to the principle of good faith, which is at the core of Ehrlich’s views on international law. The article offers suggestions on how the method of new positivism might be used and what tasks it can fulfil today. It also makes an attempt to critically analyse Ehrlich’s method and to characterize it both in general and in the context of the theory of international law.

The aim of the publication is to present the results of research on the issue of the application of the provision of Article 297 of Polish Penal Code in practice and an attempt to evaluate them and an attempt to formulate conclusions. The features characterizing the offense under Article 297 § 1 of Polish Penal Code, which reads as follows: who, in order to obtain for himself or someone else, from a bank or organizational unit conducting similar economic activity under the Act or from an authority or institution with public funds - credit, monetary loan, surety, guarantee, letter of credit, subsidy, subsidy, confirmation by the bank of a liability arising from a surety or a guarantee or similar cash payment for  a  specific  business  purpose,  payment  instrument  or  public  contract,  submit  counterfeit, converted, attesting untruth or unreliable document or unreliable written statement regarding circumstances  of  significant  importance  in  order  to  obtain  the  mentioned  financial  support, payment instrument or order, it is punishable by imprisonment up from 3 months to 5 years. Discussed are also the indications of committing an act consisting in abandoning the notification in Article 297 § 2 of Polish Penal Code, worded as follows: who, in breach of a binding obligation, does not notify the relevant entity of the situation that may affect the cessation or limitation of the financial support referred to in § 1 or the public order or the possibility of further use of the electronic payment instrument. Next,  the  methodology  of  the  research  was  described  in  detail.  The  research  was  of  an  files nature  and  concerned  final  judgments  issued  by  courts  of  second  instance.  The  time  period of  researches was from 2012 to 2016. A purposeful selection was also made due to the legal qualification of the deed on the basis of which the conviction was handed down in the first instance, i.e. the offenses under Article 297 of Polish Penal Code. Then the results of the research were presented and an attempt was made to comment on the results obtained. The conclusions from the research indicated, among others, the cases of lack of correct understanding of the provision, confusion of concepts, unnecessary automatic cumulative classification of the deed, narrowing the use of the instruments mentioned in the provision to credits, loans and subsidies, and many more cases.
Celem publikacji jest przedstawienie wyników badań dotyczących problematyki zastosowania przepisu art. 297 k.k. w praktyce oraz podjęcie próby ich oceny i sformułowania wniosków. Opisano znamiona charakteryzujące przestępstwo z art. 297 § 1 k.k., który brzmi następująco: kto, w celu uzyskania dla siebie lub kogo innego, od banku lub jednostki organizacyjnej prowadzącej podobną działalność gospodarczą na podstawie ustawy albo od organu lub instytucji dysponujących środkami publicznymi – kredytu, pożyczki pieniężnej, poręczenia, gwarancji, akredytywy, dotacji, subwencji, potwierdzenia przez bank zobowiązania wynikającego z poręczenia lub z gwarancji lub podobnego świadczenia pieniężnego na określony cel gospodarczy, instrumentu płatniczego lub zamówienia publicznego, przedkłada podrobiony, przerobiony, poświadczający nieprawdę albo nierzetelny dokument albo nierzetelne, pisemne oświadczenie dotyczące okoliczności o istotnym znaczeniu dla uzyskania wymienionego wsparcia fnansowego, instrumentu płatniczego lub zamówienia, podlega karze pozbawienia wolności od 3 miesięcy do lat 5. Omówiono także znamiona popełnienia czynu polegającego na zaniechaniu powiadomienia z art. 297 § 2 k.k., o następującym brzmieniu: kto wbrew ciążącemu obowiązkowi, nie powiadamia właściwego podmiotu o powstaniu sytuacji mogącej mieć wpływ na wstrzymanie albo ograniczenie wysokości udzielonego wsparcia fnansowego, określonego w § 1, lub zamówienia publicznego albo na możliwość dalszego korzystania z instrumentu płatniczego. Następnie została dokładnie opisana metodologia przeprowadzonych badań. Badania miały charakter aktowy i dotyczyły prawomocnych orzeczeń wydanych przez sądy drugiej instancji. Cezurą czasową objęto okres od 2012 do 2016. Dokonano także wyboru celowego ze względu na kwalifkacje prawną czynu na podstawie, którego dokonano skazania w pierwszej instancji, tj. przestępstwa z art. 297 k.k. Następnie przedstawiono wyniki badań oraz podjęto próbę skomentowania otrzymanych rezultatów. Wnioski z badań wskazały, między innymi, na przypadki występowania braku prawidłowego zrozumienia przepisu, mylenie pojęć, niepotrzebnej automatycznej kumulatywnej kwalifkacji czynu, zawężenie stosowania instrumentów wymienionych w przepisie do kredytu, pożyczki oraz dotacji oraz a wiele innych.

The analysis herein, while mainly descriptive, presents the main foundations of the Constitutional Tribunal’s jurisprudence in matters of hierarchical control of the constitutionality of laws concerning the EU. It distinguishes some principles, concepts and constitutional theories which, according to the Constitutional Tribunal, set the limits of European integration. The main thesis of the paper is that, in this context, the basic and decisive rule is the supremacy of the Constitution, which does not have exceptions or limitations. A hypothesis was also formulated that the Solange II maxim does not reflect the actual state of European constitutionalism, in which the level of protection of fundamental rights is significantly increased while possible collisions between the level of protection of fundamental rights in the EU and the Member States should be solved by means of the clauses provided in Articles 51–54 of the EU Charter of Fundamental Rights.

Opis:
The aims of the present study have been: 1) to ascertain the actual conditions of the courts' decisions applying penalties and other measures towards multiple recidivists; 2) to determine the present penal policy towards this category of convicted persons; 3) to compare this policy with the assumptions included in the Penal Code in force. Punishment imposed upon multiple recidivists is regulated by the provisions of Art. 60, para. 2 and 3 Art. 61 of the Penal Code. Their formulation is as follows: on a perpetrator sentenced twice in the conditions specified in para. 1 (special basic recidivism), who has served altogether at leat one year of deprivation of liberty and in the period of 5 years after the serving of the last penalty commits again an intentional offence with the purpose of obtaining a material benefit or of a hooligan character, similar to at least one of the previously committed offencęs, the court shall impose a penalty within the limits of from three times the lowest sanction, but not less than 2 years, up to the highest statutory sanction increased by one half, and if the highest statutory sanction is not higher than 3 years: up to 5 years deprivation of liberty. The increase of the lowest statutory sanction provided in para. 1 or 2 shall not apply, when the offence is a serious offence; in this case the court shall consider the commission of the offence in the conditions specified in para 1 or 2 as a circumstance increasing the penalty. In particularly justified cases when even the lowest penalty imposed on the basis of Art. 60. paras 1 or 2 would be incommeasurably Severe by reason of the motives for the action of the perpetrator, his traits and personal conditions as well as his way of life before the commission and his behaviour after the perpetration of the offence, the court when imposing the penalty may refrain from applying the rules specified in Art. 60. paras 1 or 2; in these cases the court shall take into consideration the commission of the offence in the conditions specified in Art. 60, para 1or 2 as circumstances influencing increasing the penalty. With regard to a perpetrator sentenced in the conditions specified in Art. 60, para. 2 he court shall adjudge protective supervision; if adjudging this supervision is not sufficient to prevent recidivism, the court shall adjudge .the commitment of the sentenced person to a social readaptation centre. (Art. 62, para. 2). The present work has been based on the author's own research and to a minimum extent only on the analysis of the national statistical data. The point of departure for the study of the actual conditions of the courts decisions were the conditions specified in the Penal Code now in force. The conditions specified in Art. 61 of the Penal Code and related to the offender only have been assumed to form the ratio legis of special recidivism in the Polish penal legislation. If, however, when aplying this provision, the courts prefer the conditions related to the most recent act of the offender, this mignt be an indication of their different attitude towards the aim of punishment in the case of the discussed category of offenders. The existence of such divergences between the conditions of application of Art 61 of the Penal Code as included in the law on the one hand, and those applied by the courts on the other hand  has been one of the hypotheses verified in the present study.  The study has been based on the examination of court records. All the accessible records of criminal cases (230) have been included in it, in which Sentences were passed with regard to multiple recidivists (under Art 60. para. 2  and Art. 61 in connection with Art. 60, para. 2 of the Penal Code) in the District Court of the city of Poznań in the years 1975-1981. The question arised whether this could be treated as an equivalent to a random sample of the national population of convicted multiple recidivists. As shown by a comparison of distributions in question are highly convergent. A questionnaire to investigate the ourt records consisted of 41 questions concerning the convicted recidivist, his previous offences and criminal record, his last offence and the content of the last sentence. The impact of a number of variables on the application of Art. 61 of the Penal Code, on the length  of the prison sentence and on the decision of commitment to a social readaptation centre has been analysed in succession. Conclusions from the study are as follows: 1. In the application of Art.61 of the Penal Code ,the predominating part is played by the conditions connected with the degree of socil danger of the act and with its legal label. The conditions connected with the person of the perpetrator seem to have a much smaller effect. The reason of this state of affairs may be seeked in the fact that the court is obligated by Art. 60, para.2 of the Penal Code to impose long-term penalties of deprivation or liberty regardless of the degree of social danger (seriousness) of the offence which may be trivial in particular cases. Therefore, it is not to be wondered at that in these cases the courts apply Art. 61 of the Penal Code so as to impose a lower or more lenient penalty in order to make it commeasurable with the offence. The following conditions have been found to exert the greatest influence on the length of sentences to deprivation of liberty under Art. 60, para. 2: firstly, the legal appraisal of the offence and the related content of the instructions for meting out punishment specified in Art. 60, para. 2 of the Penal Code, and secondly, the degree of social danger of the offence. The character of the offence and the appraisal of its social danger influence the sentence too, including the type of penalty, when Art. 61 of the Penal Code is applied by the court. This is probably a further result of following the same conditions already when deciding on the application of Art. 61 of the Penal Code. When adjudging the commitment of convicted persons to a social readaptation centre, the courst were guided by the conditions connected with intense symptoms of demoralization of these persons and with a previous application of various penal measures towards them; thus the conditions were formally the same as those to be found in the Penal Code. At the same time, conditions connected with the recently committed offence were left out of account here. One should be particularly careful when interpreting the findings in this case aS the decisions in question may be conditioned by the courts' various attitudes towards the practical functioning of the centers, and by different purposes of their adjudgement in definite cases. The length of the perod for which commitment to a social readaptation centre was adjudged has appeared to increase with the length of the sentence to deprivation of libety. Admittedly, outright conclusions as to the need for amendments of the provisions of the Penal Code in its part concerning recidivists do not follow immediately from the findings of the present study. These findings have. however, demonstrated the degree to which the instructions for meting out, punishment specified in Art. 60, para. 2 of the Penal Code sever the relation between the offence and punishment, as  well as the fact that the corrective function of punishment imposed upon multiple recidivists - officially assumed by the legislator-has a fictious character in practice. In consequence, Art. 61 of the Penal Code is used in discord with its purpose; it is applied to adjust the adjudicated punishment to the seriousness of the offence committed.

The paper is a study of binding force of criminal court’s judgement in civil proceedings, related to issue of applying of the article 11 of the Code of Civil Procedure. The aim of the paper is an attempt to delineate model boundaries of binding of criminal court’s judgement in civil proceedings, in connection with applicaton of such relevant legal regulation. The author focuses on the presentation of the most important threads arising from need to take into account factual situation related to commission of a criminal offence contained in a conviction. The existing normative regulation has been examined and its defects identified. The analysis is connected with consideration of such complex problem from the point of view of recent changes in the amending concerning criminal proceedings and criminal law too. Gathering the tesis specified in article, the author notes that regulation mentioned above doesn’t create legal rule on the clear scope of application

The main topic of this article is retroactive application of procedural criminal law. In this text the question will be posed – and answered – whether the application of a new procedural provision that entered into force in the course of an ongoing proceeding should in that proceeding be considered as retroactive and in what scope or/and under what conditions can such retroactivity be allowed for. As will be shown the solutions in national jurisdictions differ according to the common law – continental law states divide. This problem will be discussed in the light of a decision in the ICC Ruto and Sang case. In this case the ICC Appeals Chamber had to answer several questions pertaining to the temporal application of new procedural provisions. Firstly, the Chamber had to decide whether a general ban on the retroactive application of substantive law should also apply to procedural criminal law. Secondly, the ICC Appeals Chamber had to analyze the criteria according to which it would evaluate whether the change of rules of criminal procedure in the course of an ongoing trial was to be considered as having a retroactive effect, and whether the change in the rules of admission of evidence could be considered detrimental to the accused. Thirdly, it will be shown that the ICC Appeals Chamber has chosen the common law concept of “due process rights” rather than the idea of “intertemporal rules” known from the continental doctrine, and why it chose to do so.
