The article tackles the problem of social courts and social conciliation commissions and jury existing in Poland and in other socialist countries, being the realization of a Marxist-Leninist theory of the state. These institutions provide accomplishment of constitutional rule of increasing the engagement of working classes in the governance of the state (with the broadest meaning of the “governance”, including justice administration). It is highlighted that the engagement of the citizens in the jurisdiction is an important feature of newly created society. As the participation of jury is an element of civil factor in the professional jurisprudence, the social courts are somewhere in the middle, between mediation and justice administration, and are purely social element with no professional background. As such the social courts may be seen as the realisation of communist idea of social self-governance.Short part of the article is devoted to the previous attempt of introduction of social courts and the reasons of its failure. Idea introduced by the Decree of the 2nd February 1946 on the law of citizen’s courts. It’s civil character was to be granted by the fact, that the non-professional citizen’s judges were to be elected by municipal national council. Unfortunately, the complexity and the formality of their functioning caused lack of interest in their foundation and finally their liquidation.Further part of the article analyses briefly the Law of the 30th March about social courts. They were created as a response to a social initiative in workplaces (social courts) or cities, communities and villages (social conciliation committees). The adopted regulation was modelled on the workers’ court in Wrocław and the conciliation commission functioning in Łódź. Their main function was to educate and prevent, and their effectivity was based on the moral authority and personal experience of their members. They were devoid of repressive function, and could apply only educative measures as: obligation to repair the damage, apology the victim, caution, reprimand or payment for a social aim (but very limited). The execution of the decision of the social court was voluntary. The model regulation of their functioning is proclaimed by the Front of National Unity’s National Committee and the Central Council of Trades Unions.In the next part of the article we can find a brief overview of the main sort of cases before the aforementioned institutions and the analysis of statistics of disputes gathered by the social conciliation committee in the countryside and in the cities. We can also find here the statistics concluding the functioning of the both institutions, their popularity and effectiveness.Author concludes that very important is lack of formal procedures what helps to resolve different kind of cases without reference to certain legal act. It also help to educate new society, free from the class conflict and introduce the mediation as the best way to resolve interpersonal conflicts.

Opis:
This Article investigates how the European Court of Human Rights becomes competent to make decisions in cases concerning (or taking roots in) 'historical situations' preceding the ratification of the European Convention by a given Member State or even the enactment of the Convention. 'Historical situations' refer to events that occurred in the period of Second World War or shortly thereafter. In all such cases, the preliminary question arises whether the Court is competent temporally (ratione temporis) to deal with the application. This group of cases concerned usually allegations touching upon the right to life and the right to property. The Court had to decide if the allegation in question related to a temporally closed event (making the Court not competent) or rather to a continuous violation (where the Court could adjudicate). A specific set of legal questions arose vis-a-vis the right to life, first of all that of the autonomy of the procedural obligation to conduct an efficient investigation. The Strasbourg case law did not provide a clear answer. However, following two crucial judgements rendered by the Grand Chamber, the Court has established an interesting legal framework. Article analyses also two other situations having a historical dimension: bringing to justice those accused of war crimes or other crimes under international law (in light of the alleged conflict with the principle of nullum crimes sine lege) and pursuing authors of pro-Nazi statements or speech denying the reality of Nazi atrocities.

Opis:
The recast of the European Insolvency Regulation, which has been applicable from 26 June 2017, implements a philosophy of Euro universalism, according to which insolvency proceedings opened in a Member State where the debtor has its centre of main interests (COMI) should have a universal scope and encompass all the debtor’s assets situated throughout the EU. The wording of the Recast Regulation is intended to comply with the ECJ case law concerning COMI, such as Interedil, Eurofood, Bank Handlowy or Mediasucre judgments. Nevertheless, it is now questioned whether the Recast Regulation strengthens or rather weakens the COMI/registered office rebuttable presumption and opens the gate for insolvency forum shopping. As far as international company law is concerned, the issue of transfer of seat as well as forum shopping has been widely discussed. So far the ECJ has issued a series of judgments in which it has explained the European freedom of establishment and the crossborder activities of companies in the internal market. Similarly, the US Supreme Court has issued several significant decisions, such as CTP Corp. v. Dynamics Corp. of America, Edgar v. MITE Corp., and International Shoe Co. v. State of Washington, in which the limits of acceptable forum shopping are better delineated. Based on the aforementioned, it may be concluded that European harmonization measures facilitating crossborder mobility should additionally assist in achieving predictability and efficiency, as well as the economic viability and security of the operations under consideration. This contribution analyses and expounds on the lessons that can be learned from both the ECJ case law as well as US Supreme Court’s decisions on international company law, including an examination of their effect on insolvency forum shopping. There is no doubt that, if successful, harmonized legislation on these matters would be a great asset for the internal market.

The article’s aim is to present to the wider public the important institution of Polish legal system - the Supreme Chamber of Control. It’s dated for 1919 and, with short pauses, it operates since then. The constitutional tradition entrusts the control of public finances to the specialised organ, which is independent from the Council of Ministers, but which is still linked to the Diet. Not only the control of the finances and the legality of other public organs’ actions, but also control of the management’s effectiveness is within its scope. The reconstruction of this institution was necessary after the political transformation. The legal act on the Supreme Chamber of Control was adopted on the 23rd December 1994 and entered into force on the 17th August 1995. Its position was enforced and it was placed among the most important state’s organs as Diet, President, Supreme Court. These changes are visible in different aspects of its activity (its decision cannot be modified or cancelled, its actions have for the aim to guarantee the proper functioning of State and its controlling prerogatives are very broad). Links with the Diet are analysed in the further part of the article (designation of part of the members, orientation of its activity by the Diet, examination and evaluation of the results of its activity, control over its budget). The weak point is that the President of the Supreme Chamber of Control is nominated for the undetermined term and can be at each moment called off by the Diet. It’s the realisation of the Supreme Chamber of Control’s links with the Diet and wasn’t controversial during the legislative process. There are special means of the protection of President’s neutrality as: immunity and the prohibition of membership in political parties and prohibition of realisation of other public functions. As it comes to the organizational structure, although it is central organ, it has local departments and offices. To make its structure transparent, the decisions of special significance (as realisation of state’s budget, main guidelines of the monetary policy and the yearly rapports on the Supreme Chamber of Control’s activity)  are adopted by special, collegial body.  The large part of the article is devoted to the analysis of the control’s scope which is divided into obligatory and facultative. Inter alia, it consists of the controlling of the public and local administration organs, state-owned enterprises, state’s banks,  and state’s organs which are the largest group subject to control. The further part of the article considers the possible results of the control. The conclusion of the articles approves the changes that were applied to the public finances control mode introduced by the Law of 23rd December 1994 but highlights the place for further improvements. Indisputably, the reduction of the dependence from the political factor and introduction of  internal semi-juridical procedure are the positive changes. However, lack of modification of the controlled area may be a defect, when we take into consideration the ongoing transformation, especially privatisation and reprivatisation’s processes.

The article is a summary of research that have been conducted in Institute of Justice Ministry of Justice. Paper is shared on three short part: description the researched sample, collected evidence and the analysis of the factors influencing the judge’s decision. It allowed to answer on the three basic questions: who were juveniles to whom the court has applied the strictest measures mentioned in the article 6 of the Act on proceedings in juvenile cases, what evidence had the juvenile court used in taking a decision in relation to a specific person and how decisions issued by the court were consistent with the recommendations of the „supporting institutions”.
