Opis:
This article examines the process of the judicial Europeanization of the Polish Constitution. In Poland the judicial method of Europeanizing the Constitution is currently the primary way of adjusting constitutional norms to requirements resulting from EU law. The phenomenon of re-interpretation of constitutional provisions in light of the new and changing realities is a characteristic feature of contemporary constitutionalism. It has been a long time since most national constitutions have undergone significant textual changes. In Poland, the scope of judicial Europeanization of the Constitution is connected, to a great extent, with the inflexible procedure required for constitutional amendments. In this situation, these so-called “silent changes” of constitutional norms are the easiest and fastest way of reacting to requirements stemming from Poland’s EU membership. In the Polish case not only have the norms regarding the political system of the state changed, but also constitutional standards relating to the protection of fundamental rights and freedoms have undergone the process of the Europeanization. To some extent, these changes relate to procedural norms as well.

Opis:
The aim of this paper is to show how the social legitimacy of the Constitutional Court in Poland is constructed. Social legitimacy is considered here in two dimensions. At the macrostructural level the socio-political processes, that led to the creation of the constitutional court are analysed. The microstructural dimension focuses on examining how the individual socio-demographic characteristics of the Constitutional Court’ judges (their scientific degrees, legal practice, political experience and institutions of power), contribute to the strengthening of the Constitutional Court’s position. Thus, the paper argues that the legitimacy of the Court is made by constructing the neutrality of the institution, in particular by locating it in opposition to politics and reinforced by the academic faction of the legal field. The study is based on the sociology of Pierre Bourdieu (and his follower Frédéric Lebaron), as well as inspired by Durkheimian sociology of religion.

Opis:
The procedure of question of law to the Constitutional Tribunal (article 193 of the Constitution) allows both a court and the Tribunal to have a dialogue concerning the normative act which will determine an issue current before that court. This specific dialogue should be reflected in the explanatory part of the judgment. Moreover, the effectivity of that dialogue depends strictly upon the way Tribunal explains motives of the ruling and presents its argumentation. The explanation of the judgment does not have a status of universally binding and final statement of the Tribunal. However it should convince the court and other addressees of the judgment of the Tribunal’s interpretation of the constitutional norms taken into consideration in particular case. Explanation presented by the Tribunal should give a clear solution of the constitutional issue put forward by the court in its question of law. Only then the court may resolve individual case issuing a judgment which conforms to the Constitution.

Opis:
The analysis herein, while mainly descriptive, presents the main foundations of the Constitutional Tribunal’s jurisprudence in matters of hierarchical control of the constitutionality of laws concerning the EU. It distinguishes some principles, concepts and constitutional theories which, according to the Constitutional Tribunal, set the limits of European integration. The main thesis of the paper is that, in this context, the basic and decisive rule is the supremacy of the Constitution, which does not have exceptions or limitations. A hypothesis was also formulated that the Solange II maxim does not reflect the actual state of European constitutionalism, in which the level of protection of fundamental rights is significantly increased while possible collisions between the level of protection of fundamental rights in the EU and the Member States should be solved by means of the clauses provided in Articles 51–54 of the EU Charter of Fundamental Rights.
