Opis:
The aim of the article is to answer the question on the role of the Charter of the United Nations for the international community, and in particular whether the Charter can be named the world constitution. The considerations upon this topic will be held from the perspective of the prohibition of the use of force. Thus, first of all, the prohibition itself should be briefly describe, in order to underline its absolute character and the fact that it was defined very broadly in the Charter. Secondly, one has to analyze the traits of the Charter as the potential constitutional act for the international community. Finally, these theoretical remarks will be referred to the states’ practice of application of the UN Charter. The conclusion stemming from such analysis indicates that the UN Charter may be formally named the world constitution, but in fact States do not treat obligations deriving from it as having any supreme power over their own national interests.

In its Judgement of 17 February 2016, the Polish Supreme Court adjudicated the case of Polish soldiers accused of crimes committed in the village of Nangar Khel in Afghanistan in 2007. Ultimately, the Supreme Court found that Polish soldiers were guilty of, inter alia, breach of Article 318 of the Polish Penal Code, which stipulates that a soldier commits a crime even when executing an order if he is aware of this crime. However, the part of the judgement devoted to the problem of unlawful orders is very limited and almost completely lacks references to international law. The Supreme Court could have referred to a number of international legal acts, starting from the beginning of 20th century and up to the more recent regulations, including those in the Rome Statute. Moreover, the Supreme Court did not use international case law. As a result, the argumentation of the Supreme Court should be assessed as limited and unconvincing.

The aim of this paper is to analyse four domains of ‘grey zones’ in public international law exploited by Russia’s activities during the conflict in Ukraine – acknowledgement of Russia’s involvement in the conflict; the use of force against Ukraine; the application of the right to self-determination; and passportisation carried out in Donbass. As this paper will demonstrate, legal assessment of the Russian actions is not impossible, although also not straightforward. It is only the resilience of public international law that may allow for the declaration of Russian actions as illegal, and the bringing of Russia to justice. The paper is divided into five parts: the first part defines the term ‘grey zone’ with regard to international law. The four sections following this are focused on the analysis of particular Russian actions as examples of conduct undertaken in the grey zones of international law, namely the Russian involvement in the conflict in Ukraine, the legal classification of Russian actions, the right to self-determination and passportisation.
