With the Act on the Polish Card Poland followed the pattern of some European states (mostly Central and Eastern European ones) of enacting specific domestic legislation conferring special treatment and benefits to persons who are recognized as its kin-minorities. The most important analysis of this phenomenon from the perspective of international law was the 2001 Venice Commission’s report entitled “Report on the Protection of National Minorities by their Kin-State.” The Polish legislation was adopted in 2007, so for obvious reasons it was not considered by the Venice Commission. However, a rather unexpected and unusual examination of the Polish kin-state legislation from the perspective of international law came from Belarus. The Constitutional Court of the Republic of Belarus (CCRB) conducted a comprehensive examination of the Act on the Polish Card in 2011. The main aim of this article is to present and comment on the reasoning of the CCRB. Beginning with the broader context, this article starts with a presentation of the origins and a short description of the Act on the Polish Card, followed by a discussion of why the Polish Card and other kin-state legislation instruments are topics of concern in international law. The main part of the article is devoted to the presentation and assessment of the 2011 CCRB decision on the Act on the Polish Card. The author’s assessment confirms at least some of the concerns put forward by the CCRB, i.e., that both the Act on the Polish Card and the practice based on it contradict some norms and principles of international law, namely the principle of territorial sovereignty, the norms of consular law, and several bilateral treaties in force between these two states. Bearing in mind that despite those concerns more than a quarter-million Polish Cards (also sometimes called Pole’s Cards) have been issued so far by the Polish authorities, the article ends with a discussion of why such a prolonged nonconformity with international law is possible.

Opis:
The aim of this paper is to show how the social legitimacy of the Constitutional Court in Poland is constructed. Social legitimacy is considered here in two dimensions. At the macrostructural level the socio-political processes, that led to the creation of the constitutional court are analysed. The microstructural dimension focuses on examining how the individual socio-demographic characteristics of the Constitutional Court’ judges (their scientific degrees, legal practice, political experience and institutions of power), contribute to the strengthening of the Constitutional Court’s position. Thus, the paper argues that the legitimacy of the Court is made by constructing the neutrality of the institution, in particular by locating it in opposition to politics and reinforced by the academic faction of the legal field. The study is based on the sociology of Pierre Bourdieu (and his follower Frédéric Lebaron), as well as inspired by Durkheimian sociology of religion.

Opis:
The article’s aim is to present to the wider public the important institution of Polish legal system - the Supreme Chamber of Control. It’s dated for 1919 and, with short pauses, it operates since then. The constitutional tradition entrusts the control of public finances to the specialised organ, which is independent from the Council of Ministers, but which is still linked to the Diet. Not only the control of the finances and the legality of other public organs’ actions, but also control of the management’s effectiveness is within its scope. The reconstruction of this institution was necessary after the political transformation. The legal act on the Supreme Chamber of Control was adopted on the 23rd December 1994 and entered into force on the 17th August 1995. Its position was enforced and it was placed among the most important state’s organs as Diet, President, Supreme Court. These changes are visible in different aspects of its activity (its decision cannot be modified or cancelled, its actions have for the aim to guarantee the proper functioning of State and its controlling prerogatives are very broad). Links with the Diet are analysed in the further part of the article (designation of part of the members, orientation of its activity by the Diet, examination and evaluation of the results of its activity, control over its budget). The weak point is that the President of the Supreme Chamber of Control is nominated for the undetermined term and can be at each moment called off by the Diet. It’s the realisation of the Supreme Chamber of Control’s links with the Diet and wasn’t controversial during the legislative process. There are special means of the protection of President’s neutrality as: immunity and the prohibition of membership in political parties and prohibition of realisation of other public functions. As it comes to the organizational structure, although it is central organ, it has local departments and offices. To make its structure transparent, the decisions of special significance (as realisation of state’s budget, main guidelines of the monetary policy and the yearly rapports on the Supreme Chamber of Control’s activity)  are adopted by special, collegial body.  The large part of the article is devoted to the analysis of the control’s scope which is divided into obligatory and facultative. Inter alia, it consists of the controlling of the public and local administration organs, state-owned enterprises, state’s banks,  and state’s organs which are the largest group subject to control. The further part of the article considers the possible results of the control. The conclusion of the articles approves the changes that were applied to the public finances control mode introduced by the Law of 23rd December 1994 but highlights the place for further improvements. Indisputably, the reduction of the dependence from the political factor and introduction of  internal semi-juridical procedure are the positive changes. However, lack of modification of the controlled area may be a defect, when we take into consideration the ongoing transformation, especially privatisation and reprivatisation’s processes.

This article seeks to explore whether the EU system of fundamental rights protection allows room for constitutional pluralism. By looking at recent developments in the case law of the Court of Justice of the European Union (the Court of Justice), it is submitted that the Court has answered that question in the affirmative, thereby respecting the diversity of the cultures and traditions of the peoples of Europe as well as their national identities. The application of the Charter does not rule out a cumulative application of fundamental rights. That being said, pluralism is not absolute, but must be weighed against the indivisible and universal values on which the European Union is founded. Logically, the question that arises is how we order pluralism. In this regard, I shall argue that it is not for the Court of Justice to decide when an EU uniform standard of fundamental rights protection is to replace (or coexist with) national standards. That decision is for the EU political institutions to adopt, since they enjoy the necessary democratic legitimacy to determine the circumstances under which the exercise of a fundamental right is to be limited for reasons of public interest. However, this deference to the EU political branches does not mean that EU legislative decisions are immune from judicial review. On the contrary, cases such as Schwarz and Digital Rights demonstrate that the Court of Justice is firmly committed to examining whether those legislative choices comply with primary EU law, and notably with the Charter. In this regard, when interpreting the provisions of the Charter, the Court of Justice – in dialogue with national courts and, in particular, constitutional courts – operates as the guarantor of the rule of law within the EU, of which fundamental rights are part and parcel. It is thus for those courts to make sure that each and every EU citizen enjoys a sphere of individual liberty which must, as defined by the Charter, remain free from public interferences.

Opis:
Domestic legislation and international instruments designed for the protection of human rights provide for general clauses allowing limitations of rights and freedoms, e.g. public morals. A preliminary analysis of the case-law leads to the observation that both national courts and the European Court of Human Rights, when dealing with cases concerning sensitive moral issues, introduce varied argumentation methods allowing them to avoid making direct moral judgments and relying on the legitimate aim of protecting morality. In the article the Authors analyse selected judicial rulings in which moral issues may have played an important role. The scrutiny is done in order to identify and briefly discuss some examples of ways of argumentation used in the area under discussion by domestic and international courts. The identification of the courts’ methods of reasoning enables us in turn to make a preliminary assessment of the real role that the morality plays in the interpretation of human rights standards. It also constitutes a starting point for further consideration of the impact of ideological and cultural connotations on moral judgments, and on the establishment of a common moral standard to be applied in cases in which restriction on human rights and freedoms are considered.
