Opis:
This article examines value-based selection criteria applied in classification of historic monuments and sites in American legislation. Furthermore, the author of this article arrives at conclusions which could be applied in the Polish provisions of law. In the USA, there are two registers of historic monuments and sites, i.e. National Register of Historic Places and National Historic Landmark Register which consists of buildings, districts, objects, sites, or structures that are officially recognized by the United States government for their outstanding historical significance. In both cases, the requirements which the properties, objects, and sites to be entered into the register must meet are defined very precisely. Moreover, detailed monument valuation criteria, different for each category, can support the decision on listing a monument or site. The author of this article analyses these criteria and concludes that they could provide a basis for developing interpretation guidelines for applying provisions of the Polish Act on Protection and Guardianship of Monuments and Sites. These instructions would help historic preservation officers assess values of properties and sites. Their decisions would be therefore less intuitive and subjective but based on specific criteria. This would result in value assessments being standardised in the entire country.

Celem artykułu jest odpowiedź na problem określenia charakteru prawnego wymogu czasowego dla potencjalnych Zabytków Historycznych. Większość artykułów, które odnosiły się do tego zagadnienia, postulowała określenie stylowej / technicznej aktualności obiektu opartej na "dowodzeniu historii", podczas gdy inne sugerowały brak podstaw do oddzielenia horyzontu czasowego od potencjalnego zabytku. Wychodząc poza te zagadnienia, niniejszy artykuł przedstawia analizę prawnej definicji Zabytków w połączeniu z definicją współczesnych dóbr kultury podaną w Ustawie o zagospodarowaniu przestrzennym. Analiza porównawcza tych definicji prawnych prowadzi do założenia, że ustawodawca podał alternatywną, bardziej jednoznaczną podstawę do oceny, czy przedmiot jest wystarczająco stary, aby można go było umieścić w rejestrze zabytków.
The aim of the article is to answer the problem of determining the nature of the legal requirement of temporal remoteness put upon potential Historic Monuments. Most of the papers that referred to the issue offered an understanding relying on determining stylistic/technical topicality of a property relying on the phrase „an evidence of a past period”, whereas some others suggested that there is no basis for expecting a temporal remoteness from a potential Historic Monument. Going beyond those commentaries this paper presents an analysis of the legal definition of Historic Monuments in conjuction with the definition of Contemporary Cultural Goods given in the Land-use Planning Act. A comparative analysis of those legal definitions leads to assuption that the legislator gave an alternative and more unequivocal basis for appraising whether a property is old enough to be listed on the Historic Monuments Register, which is to investigate whether the property is an achievement of a late generation.

None of the legal acts applied in the Polish monument protection system, ranging from the Regency Council Decree of 1918 to the Act of 2003, allows for transforming historic monuments and sites. This provision applies, paradoxically, unless a competent historic preservation officer approves such transformations. In other words, under the aforementioned acts, it is possible to make any modification to the existing historic monument or site, provided that a historic preservation officer issues an appropriate permit. Each of these legal acts provides framework for classifying historic monuments and sites, e.g. by introducing various forms of protection, classifying monuments and sites under various categories – immovable, movable, archaeological, etc. Therefore, classification is real. There are so many different historic monuments and sites falling under a great number of categories that it is impossible to provide them with real, even diversified protection. It is therefore necessary to implement such a classification of historic monuments and sites that would allow state and regional historic preservation officers and representatives of local government administration to carry out actions aimed at protecting properties and places of great historical significance. The recommended classification is a starting point for discussing methods, criteria, and rules governing classification of historic monuments and sites. Additionally, it will ensure appropriate protection.

This article is an attempt to pay attention to the rich heritage of the capital of Western Pomerania and to contribute to the discussion on the need to raise the monument’s history of its most valuable elements. The cultural landscape of Szczecin, which is a multicultural heritage of the historic Pomerania cultural area, is, by virtue of its origin, a carrier of original, authentic values that are absent in other Polish cities and regions. According to the authors it is possible to distinguish of three areas, that together reflect the groundbreaking process of spatial development in the history of the city, having authenticity and originality in the country. The first part of the entry should include the historic urban layout of Szczecin’s Śródmieście (Downtown) at the turn of the nineteenth and twentieth century with the form of star and triangular development quarters, as well as urban and architectural and landscape complexes, which are important components of it: Wały Chrobrego (Hakenterrasse), Jasne Błonia (Quistorpaue) and Cmentarz Centralny (Hauptfriedhof). The spatial and aesthetic qualities, the historical significance and the uniqueness of the particular elements of the aforementioned teams predestine them in our opinion to be included in the list of Historical Monuments.

It has always been of tremendous importance for latin church to protect and preserve cultural heritage which it has been collecting and creating for ages. Participants of the Polish episcopal conference and members of Diocesan synods made a considerable number of legal regulations. a church system of historic preservation service has been developed for years; an abundance of works are carried out to historic monuments and sites; there are church institutions collecting and listing properties and sites as well as supervising protection-related activities and cooperating with selected government bodies.

Value assessment of historic monuments and sites and their classification are affected by conservation works and the impact they exert on elements of historical significance. Whether a historic monument or site can be still considered evidence of a past epoch depends on the scope of conservation works carried out in this asset. Works conducted in appropriate manner provide new information about the past. Additionally, a historic monument or site is attributed new values - not only aesthetic and functional but also the historical ones. This allows for changing their classification. Therefore, the role that the results of conservation works play in classification of historic monuments and sites has been particularly emphasised. The author of this article ponders upon whether layers of the previously carried out conservation works as well as their effects can be the reason for redoing value assessment and re-classifying a historic monument or site. These deliberations provided a basis for drawing conclusions and producing recommendations pertaining to the influence that conservation works and layers created as their result exert on the actions taken by historic preservation offices supervising these works. For this reason, the present classification should include the following: – increasing the importance of historic monuments and sites which have not been transformed at all or have been slightly modified This concerns historic monuments and sites which are typical of their epoch, e.g. tenement houses, palaces, industrial plants, etc. – valuable layers and elements created in the course of conservation works, which should be preserved and, prior to issuing permits by historic preservation office and launching conservation works, assessed in terms of their values. These elements should be preserved in order to place these assets under a different class, usually of a higher rank. Preserving elements created in the course of formerly conducted conservation works and resulting in forming multiple layers is compliant with the currently applied conservation theory, which no longer accepts purist methods as a way of preserving monuments and sites. Due to this, it is possible to preserve the evidence of conservation works and take care of historic monuments and sites in order to preserve them for future generations.

This article explores the relations between the provisions of the Act on the Protection and Guardianship of Monuments and Sites and the Construction Law from the perspective of modern historic preservation. Particular emphasis is placed on the forms of direct historic preservation in the context of the record of historic monuments and sites, which, in spite of being mentioned in the said Act, is not referred to as a form of ‘preservation’. What is also highlighted in this article is the necessity to make amendments to legal acts pertaining to classification and categorisation of historic monuments and sites. The author of this article is of the opinion that this can be achieved only by standardizing administrative regulations and deleting contradictory regulations from legal acts.

In Poland, protection of historic monuments and sites is nearly one hundred years old and it has got a highly distinctive feature – the more recent the events are, the more frequent and more profound changes can be observed; the most significant ones take place in the 1990s . in general, it can be said that the organisation of historic preservation service remained constant at the turn of the 19th and 20th centuries. Administrative bodies responsible for historic preservation are still organised under the act of 23 July 2003 on Protection and Guardianship of monuments and Sites. this organisational system, however, is no longer fully effective in Poland. It is therefore necessary to change legislation under which the vertical organisational structure of conservation administration would be restored - with one General historic Preservation officer (being still the secretary or undersecretary of state in the ministry of culture and national heritage) to whom several regional historic preservation officers are directly responsible and subordinate. members of staff of the ministry of culture and national heritage undertook a legislative initiative aimed at achieving this objective. as a result, on 25 January 2016 the government decided to begin works amending the act on Protection and Guardianship of monuments and Sites.

The polychrome decorations of the Warsaw's Old Town have been recognised as the essential elements that contribute to the justification of its Outstanding Universal Value.This decision is a guideline that obliges to preserve the original polychromies and also determines the technological method of their conservation. In practice, preserving the authenticity of the traditional wall painting techniques puts contractors to task of conserving the relics of the original decorations and plasters from the 50s and 60s. The latter however, are not perceived as valuable assets. The degree of the destruction appear to be a sufficient justification for their complete removal. For that reason the elevations, being next renovated with the help of modern preparations lose their old-town character. The article raises the problem both of underestimation of the value of the original fabric created during the reconstruction of the Old Town as well as abandoning the traditional technologies employed originally in the monument.

The paper concerns issues related to the preservation and restoration of public space in Gdynia city centre designed and built mainly in the 1920s and 1930s. In 2007, major part of the city centre was entered in the register of monuments as a historic complex of urban architecture. Moreover, in 2015, the area was declared a Monument of History. The renovation protection of a complex of urban architecture covers the historic buildings, but also, among others, includes the protection of public space that is an integral part of the historic complex. Therefore, the preservation of the historic shape and design of public space in the centre of Gdynia is one of the key conservation tasks and since the protection of this type of space in the relatively young historic centres that are less than 100 years old is a new issue, as viewed from the conservational perspective, it is therefore worth analyzing. The issues of protection and restoration of public space in the centre of Gdynia have been exemplified by three historic streets, built in the late 1920s, that are located within the historic complex entered in the register of monuments and that have been the subject of varying restoration investments in the few recent years. The streets differ in terms of historic conditions, renovation requirements, social expectations and investment plans and at the developmental stage of the investment all these factors lead to different assumptions and approaches, bringing, in each case, different results.
Artykuł dotyczy problematyki zachowania i rewaloryzacji przestrzeni publicznych w śródmieściu miasta Gdyni, zaprojektowanym i zbudowanym w głównej mierze w latach 20. i 30. XX w. Znaczna część zespołu śródmieścia została w 2007 r. wpisana do rejestru zabytków jako historyczny układ urbanistyczny. Dodatkowo w 2015 r. obszar ten uznano za Pomnik Historii. Ochrona konserwatorska układu urbanistycznego obejmuje nie tylko historyczną zabudowę, ale także m.in. ochronę przestrzeni publicznych, które stanowią integralną część zespołu zabytkowego. W związku z tym zachowanie historycznego ukształtowania i wystroju przestrzeni publicznych śródmieścia Gdyni, jest jednym z kluczowych zadań konserwatorskich związanych ze sprawowaną ochroną. Ochrona tego rodzaju przestrzeni w stosunkowo młodych ośrodkach zabytkowych liczących mniej niż 100 lat, czyli takim jak śródmieście Gdyni, jest z konserwatorskiego punktu widzenia zagadnieniem nowym i dlatego wartym analizy. Problematykę ochrony i rewaloryzacji przestrzeni publicznych śródmieścia Gdyni przedstawiono na przykładzie trzech wybranych, historycznych ulic, ukształtowanych pod koniec lat 20. XX w. Wszystkie trzy są położone na terenie wpisanym do rejestru zabytków i były w ostatnich kilku latach obszarem inwestycji remontowych w różnej skali. Ulice te natomiast różnią się m.in. tym, że w przypadku każdej z nich inne były uwarunkowania historyczne, wymogi konserwatorskie, oczekiwania społeczne i także plany inwestycyjne. Te wszystkie czynniki sprawiły, że już na etapie projektu inwestycji przyjęto różne założenia i sposoby podejścia do tych przedsięwzięć, a więc w każdym z przypadków inny jest też uzyskany rezultat.

This article discusses the issue of adaptation of immovable historic monument and sites in light of the legal requirements and from the point of view of heritage protection authorities being one of the participants of the adaptation process. The initial aim is to define the concept of monument adaptation and delineate the conditions in which such a process occurs. The article describes a series of initial actions taken prior to the actual preservation and restoration works – as part of the adaptation process. These works include e.g. detailed research on a historic monument or site, including historical (historical-preservation studies), preservation, architecture, and in many cases also archaeological research. The aim of these activities is to acquire a fullest possible picture of the monument. The results of this research then constitute a basis for preparation of project documentation of the intended works. The article underlines importance of assigning an appropriate purpose to the asset undergoing the process of adaptation, which should be merged with a monument or site, i.e. respect all of its historical values and ensure the optimal utility of the asset, avoiding a series of potential negative consequences. The paper then discusses the applicable legal framework concerning protection of immovable monuments and competences of monument protection authorities resulting from the said framework. The paper’s conclusion postulates that the activities of all personnel working on historic monuments and sites should be guided by their inner conviction that monuments need to be looked after and that they have a social duty to maintain them for the sake of future generations. This duty is actually applicable to all citizens, just as the cultural heritage is the primary building block of the nation’s historical identity.

In 2012 and 2015, Zbigniew Kobyliński’s articles on valuing archaeological monuments and sites (the article of 2012 was co-authored by Jacek Wysocki) were printed in post-conference publications. Z. Kobyliński assumed that historic preservation officers can assess values of archaeological sites by basing on non-scientific criteria and the level of preservation of artifacts only. The author is also of the opinion that the criteria used for classifying and categorising both properties of special architectural and historic interest and works of arts cannot be applied to archaeological sites. This stems from the knowledge on full potential of archaeological monuments and sites being limited prior to conducting thorough analyses. According to Kobyliński, any value assessment results in negative selection of archaeological sites and therefore, it is of utmost importance to provide all resources with appropriate protection. The author of this article takes a different point of view. Assuming that there is 0.5 million sites entered into the Polish record of archaeological monuments and sites, Konopka is of the opinion that it is and will be impossible to provide all resources even with basic monitoring, not mentioning active care. He reckons that basing on the information collected by archaeologists, it is possible to nominate sites of outstanding potential. Analysing the records by applying the most innovative non-invasive methods may allow for selecting sites which should be provided with particular care in a certain region. Konopka calls for implementing a form in which past relics of outstanding historical value and features characteristic of archaeological sites would be listed. Opis:
Under the Act of 23 July 2003 on the Protection and Guardianship of Monuments, a coherent model for caring for historic monuments and sites on both central and local levels was introduced. This concept is intertwined with monitoring and flow of information. The system of managing documents is aimed at optimising actions pertaining to the protection of cultural heritage. As there is a clear hierarchy of these documents, which can also correlate with each other, there are sound reasons behind establishing a coherent protection policy – from municipal/communal level to the central one. National, regional, district, and municipal/communal programmes pertaining to care for historic monuments and sites are strategic tools which shape policy, direct actions towards specific aims, and reflect the will. In a number of cases, however, no programmes have ever been developed. Administrative and legal supervision is still the predominant model in the protection of monuments and sites. The period of 2003 - 2016 was the time to „become familiar” with the new tool applied in heritage protection and management. One should learn from these experiences and promote the idea of devising a coherent strategy aimed at protecting historic monuments and sites by implementing programmes on all administrative levels.

This article discusses practices of classification of historic monuments and sites which have been adopted in Poland so far. The author of this article presents criteria pertaining to categorising and making inventory of historic monuments and sites developed in the first half of the twentieth century by Jan Zachwatowicz, Zdzisław Bieniecki, and Michał Witwicki. Furthermore, what is also presented is classification of materials that are relevant by their use or invention, classification of modernism monuments, and classification of historic monuments and sites which was carried out in the years 19590–1962, at the time when classes 0 and 1–4 were introduced. In future, historic monuments and sites should be classified by members of different expert teams cooperating with each other on different levels (regional and supralocal). The lists must be verified by academic authorities from various communities (art and architecture historians, conservators, etc.) and all works must be carried out in compliance with currently binding regulations. The criteria should be developed in accordance with the regulations set forth in the Polish Act on Protection and Guardianship of Monuments and Sites of 23 July 2003, unless major amendments are made to it. The author of this article suggests the following criteria, compliant with the legal regulations in force: – artistic merit (art. 3.1): the form of a property or a group of properties (quality and scope of their influence – European, supraregional, and local) – scientific and academic merit (art. 3.1): authenticity of the idea, material, function as well as construction, material, and innovation on local and supraregional scale. – historical merit (art. 3.1): the value and significance of the site, people and events - European, supraregional, and local scale It is necessary to define the significance and value of historic monuments and sites of European (supranational), regional, and local importance. Classification of both single historic monuments and sites and their groups should be clear, simple, and include the smallest possible number of valuing criteria. Furthermore, it should be compliant with Polish laws in force. When applied, the classification should result in factual selection of properties and sites - not on creating new groups of properties and sites of great historical importance and new categories of values being difficult to define. It is not possible to have standardised cirtieria matching all requirements and assigning high rank to each historic monument and site.

Contemporarily, historic monuments and sites are highly diverse and vast in number. This means that each asset and property has different value and, hence, different principles and forms of historic preservation need to be applied. Diversification of historic monuments and sites should be a part of the monument protection system and based on the widely accepted and followed methodology. No single methodology allowing for assessing the value of all historic monuments and sites has been developed yet. For this reason, diversification of historic monuments and sites is not applied in the international doctrinal documents. The most comprehensive method of assesing heritage value has been implemented into UNESCO’s World Heritage system. It consists on comparing assets within a certain reference group, yet it does not involve value gradation. Within the monument protection system, historic monuments and sites can be divided into two major groups, i.e. classes (in terms of the value of an asset or property) and categories (in terms of the specific features of an asset or property). In the Polish system of historic monuments and sites, application of categorisation (typology-based groups) is justified. However, for practical reasons (a risk of protection being depreciated and weakened), classes can be applied in limited scope (valuing groups).
