Opis:: The state administration and self-government administration are the areas which are regarded the most threatened with corruption. This especially refers to processes in which a decision is made by one person or a small group of people. Persons who perform public functions are then most exposed to various kinds of attempts to impact on their impartiality in the decision-making process. That is why the state needs to take measures to reduce such situations. In his article, the author analyses the following constructs: abuse of power, bribery, false declaration and third degree. The crimes discussed in the article infringe the principle of impartiality and equal treatment of citizens, as well as negatively affect the proper functioning of state institutions.

Opis:: Abuse of power is one of the most frequent charges against public officials. In accordance with Article 231 of the Criminal Code, it relies on contravention of rights or negligence of duties by persons employed in the public administration. The Code refers to “right or duty” with regard to their contravention or negligence. It does not contain, however, any guidance to facilitate the interpretation of this provision. In his article, the author presents an analysis of the judicature that may help define the actual scope of responsibility by public officials.

Opis:: One of the most disputable issues related to the interpretation of Article 231 (1) of the Criminal Code currently in force, is the qualification of this type of a prohibited act as formal (with no consequences) or material (with consequences). It seems that the majority of the arguments support the opinion that an abuse of power should belong to the specific group of abstract exposures to danger, which are called offences of potential danger. The problem is, however, that the legislator has not clearly set out, nor provided for appropriate criteria for the court to asses, in a concrete case, a possibility to create a threat to legal interest.
