Opis:
The article is dedicated to an analysis of the control system of one of the instruments used by the state during the implementation of the programmes co-financed from the EU financial instruments. Their basic advantage is that they generate a lower risk of swindling as beneficiaries have to return the funds they have received. Beneficiaries have to provide repayment security for such instruments, e.g. bills of exchange or collaterals, and in the case of non-repayment beneficiaries can be subject to standard debt recovery proceedings. At the same time, these instruments are less advantageous to the beneficiaries than, e.g. non-returnable subsidies, since they need to return the funds invested. However, overregulation related to this kind of support and the need to return them may make beneficiaries reluctant to use them. That is why the specifics of financial instruments should be take into account when the frequency and scope of beneficiaries’ audits are set.

Opis:
Since 2014, each local self-government unit is obliged to comply with the individual limit of allowed budget burden related to payments on deficit servicing, set out in Article 243 (1) of the Act on Public Finance. Many self-governments have already reached the threshold of the allowed indebtedness set by this indicator. As a result, local authorities of some self-governments decide to use financial operations that allow for circumventing this limit in order to use the EU funds from the new financial perspective for 2014-2020. Leaseback is one of these instruments.

International financial crises, primarily that of the year 2007 related to the subprime loans market, indicated the need to introduce solutions that would supplement the area of the State’s impact on the financial market between the traditional macroeconomic policy (including fiscal and monetary issues) and macro-prudential supervision. The macro-prudential policy is aimed at providing such a solution, with its instruments being applied in many countries around the world, also in Poland. The article is an attempt to introduce the topic of macro-prudential supervision. The author presents the reasons for establishing such supervision, the main objectives of the macro-prudential policy, the most important instruments, as well as the examples of their application in Poland.

Opis:
One of the features of the European Union’s funds redistribution, based on multiannual financial perspectives, is modification of legal and organisational frameworks related to the principles for transferring support to beneficiaries at the turn of subsequent perspectives. This may result in delays in funds distribution. Currently, this is the case of funds designated for enterprise development which is the focus of the article. The basic provisions that regulate transfer of money at the EU level were published only a few days before the new financial perspective started. While the basic provisions at the national level came into force after several months since the beginning of the eligibility period. Consequently, executory provisions and individual programmes are being developed only now.

In accordance with Article 207 (1) of the Act on public finance, if resources designated for implementation of programmes co-financed from European funds are used for other purposes, if some procedures are breached, or if resources have been obtained unduly, they must be returned along with interest. The legislator, however, while introducing this principle, has not provided for all types of beneficiary support instruments, nor the specifics of the use of refundable support instruments, such as, for example, loans or guarantees. This might stem from the marginal scale of such support forms in the financial perspective for 2007 – 2013. Nowadays, however, with entering the 2014 – 2020 financial perspective, a departure can be observed among the institutions that manage European funds from subsidies to returnable assistance. Therefore, it seems necessary to disagree with the thesis that public funds designated for implementation of programmes co-financed from European funds are non-returnable by nature, and that only non-returnable support should be subject to Article 207 of the Act on public finance that sets forth the method for returning funds.
