    The article discusses proceedings before the Copyright Commission that is entitled to acknowledge royalty rates for using registered works or objects of related rights. The application of such a modality is possible only before a lawsuit is registered. A party is not obliged to use this possibility; however, if either party has applied for arbitration with the Copyright Commission, the other one may not default. Therefore, a lawsuit may not be instituted before the Commission decides a given case. If neither party uses this possibility, they can take the matter to court. It lies within the discretion of institutions that collectively manage copyrights and related rights to determine royalty rates. Only such institutions can file lawsuits; nevertheless, several organisations that collectively manage copyrights or related rights can file lawsuits, hence the appearance of more than one petitioner is possible.

    Opis:
    The article deals with procedural aspects of failure to undertake a certain type of activity, prescribed by the statute, to protect social needs, on the part of an administrative body. Also, legal mechanisms with respect to the above are discussed. Public administration was instituted with a view to securing the needs of society and should be able to undertake appropriate actions to that end. Not always, though, organs of public administration are interested in taking necessary action. Increasingly, delays in deciding cases are being observed. Accordingly, a party needs to have legal means to file a complaint regarding the inactivity of an administrative agency, which is the case under the current legal system – a person can file a complaint regarding inactivity with an administrative court.

    One principle of general administrative proceedings is the one of limited formalism. This principle does not belong to the catalogue of general principles, but is of essence to the participants of proceedings, especially the parties. According to this principle, non-compliance with formal requirements does not automatically bring about a refusal to institute proceedings, or a reply to a petition designed to institute such proceedings, or to regard a filed petition as legally effective, unless the law provides otherwise. When it is impossible to establish whether or not a petition contains a claim, a relevant organ of public administration demands the claim to be specified. When it remains unspecified or incomplete, a petition remains unheard.

    Opis:
    The article takes up the issue of necessary procedures which are to ascertain the invalidity of individual administrative acts (decisions). Invalidity of an administrative decision constitutes an extraordinary mode which is to derogate defective acts. It is an institution connected with a procedure; it was established to eliminate decisions affected by substantive-legal defects which cause the legal relation to be ill-formed both subjectively and objectively. Proceedings to ascertain invalidity of a decision constitute a separate administrative procedure which is only to determine whether a given administrative decision is affected by one of those defects that make it unlawful. In terms of ascertainment of invalidity, the competent authority may not rule on any other substantial issue. Neither can it settle the case as to its essence.
