    According to the institution of ius patronatus, catholic founders of churches and chapels gained patron enjoyed privileges and duties. A better understanding of patronus can be obtained by reference to the roman law, is which this term means somebody had regained his slave's freedom. Further meaning of this word patronus is defender (advocate). The article shows the impact of civil law on the establishment of patronage's right. This institution originates from church law in this field of its regulation but also has very close connection with civil law. Patronage is formed as a result of a “competition’s process” of private ownership right of churches' founders with ecclesiastical law. There is indicated a special nature of patronage as an exceptional institution which should not just be identified with ecclesiastical law. Church law has not separated definitely the right in property and personal law. The Author tends to lean towards the view that patronage has a “mixed” nature of ecclesiastical and secular. As a consequence patronage's right is formed by these two legal systems.

    The article entitled Law action for the right of patronage of the Lvov Cathedral in the years 1761-1765 presents the situation of the particular Church after the Council of Trent (1745-1763), whose aim it was, through its own resolutions, to revive religious life in particular local Churches. A reform of the Lvov archdiocese of the Latin rite in the spirit of the Trent resolutions was zealously undertaken by an outstanding − for those times − archbishop and metropolitan, Wacław Hieronim Sierakowski (1760-1780). He faced lack of understanding, which resulted in instituting an action against him in the Council Congregation and then in the Apostolic Signature. The present article shows the history of the action resulting from breach of the law of patronage in the Lvov Cathedral. It consists of an introduction showing the person of the steward of the archdiocese and defines the institution of patronage, describing the archbishop's work on the reform, the patrons' response and the beginning of the action that was settled out of court. In the next part there is a description of resumption of the action, the patrons' reasons, the witnesses' testimonies, and the collected documents; and it ends with the conclusion containing the decision about the dispute. The municipal authorities acted as the prosecutor, as they had the right of patronage. The action lasted four years and it concluded with acquittal of the Latin Archbishop who received a special letter from Pope Clement XIII (1758-1769) at the beginning of 1765. In the acquitting decree the Pope admitted that the Archbishop was right, and in another letter he wrote: Vade et que in corde habes fac, Dominus enim tecum est.

    However, patronage's right is a “dead letter” because it is not regulated in biding legal provisions, it is still noticeable. In the article it is described relict of patronage's right in the Code of Canon Law of 1983 that is the privilege of the presentation for an ecclesiastical offices – designation the more qualified candidates to the unfilled vacancy. The Author presents the term of patronage's right in the universal Church and in Poland both in historical and in legal dimension. The lay Christian faithful, in the Code of Canon Law of 1983, can not get privilege of the presentation for an ecclesiastical office. It was regulated in the Code of Canon Law of 1917 differently, because the institution of patronage's right was described and the privileges flowing from that rights, i.e. privilege of the presentation for an ecclesiastical office. At the same time, the legislator in the Code of Canon Law of 1917 prohibited the creation of this right in the future, regardless of legal basis.
