Instytucja ubezwłasnowolnienia, posiadająca ogromne znaczenie z punktu widzenia prawnego, społecznego i rodzinnego, wzbudza liczne kontrowersje. Niektórzy autorzy zastanawiają się, czy powinna mieć obecnie rację bytu, z racji ograniczenia zdolności do czynności prawnych osoby, której dotyczy. Z drugiej zaś strony – z perspektywy osób podejmujących się opieki nad seniorami – wydaje się być niezwykle pomocna. Chociaż pojawiają się nowe propozycje, które mogły zastąpić ubezwłasnowolnienie, pozostają one póki co na poziomie postulatów. Dlatego niniejsze opracowanie stanowi po pierwsze prezentację, a obok tego ocenę instytucji ubezwłasnowolnienia w polskim systemie prawnym. Aby mogła ona spełnić swoje przedmiotowe zadanie, a jednocześnie wykluczyć wszelkie nadużycia w jej stosowaniu, konieczne jest zachowanie stosownych przepisów prawa, które zapewnią podmiotowe traktowanie osoby i ochronę jej interesów.
An institution of incapacitation possessing a huge meaning from the legal, social and family point of view, raises numerous controversies. Some authors think consider whether it should exist due to the limitation of an ability to legal activities of the person to whom it refers. On the other hand whereas – from the perspective of the persons taking care for the seniors – it seems to be extremely helpful. Although there are new proposals which could replace the incapacitation, they remain so far on the level of postulates. Therefore, this study constitutes the presentation, first of all, and additionally an assessment of the institution of incapacitation in the Polish legal system. So as to it could fulfill its subjective task and at the same time exclude all abuses in using thereof, it is necessary to preserve proper law provisions which will assure subjective treating the person and protection of their interests.

It is doubtless that theology first of all puts questions about God and man. However, for ages theologians have been also asking questions about the meaning of their own work. One may speak about a peculiar meta-theology that tries to show the role and significance of theology in the life of the Church. The most frequently given answers to the questions about the meaning and character of theology oscillate around the concept of rationality. In such a view theology is a normal human process of making revealed truths understandable for people of a given epoch. However, it seems that such a vision of theology is tantamount to extremely simplifying it and to making it superficial. The question about the significance of theology may only be answered in the light of faith. This light allows seeing theology as a God’s gift, a charisma that helps the Church read the signs of the times and prophetically interpret the Biblical Revelation for a given epoch and culture. A theologian participates in a special charisma, so he should be perceived first of all as one who performs a special service of the word in the Church, and only then as a scholar. Such a charismatic position of theology allows reminding with full strength that the first and fundamental theologian is the Holy Spirit.

Teologia bez wątpienia stawia przede wszystkim pytania o Boga i człowieka. Jednak od wieków teologowie pytali także o znaczenie swojej własnej pracy. Można mówić o swoistej meta-teologii, która próbuje pokazać rolę i znaczenie teologii w życiu Kościoła. Najczęstsze odpowiedzi na pytania o sens i charakter teologii oscylują wokół pojęcia racjonalności. W takim spojrzeniu teologia jest zwykłym ludzkim procesem czynienia prawd objawionych zrozumiałymi dla ludzi danej epoki. Wydaje się jednak, że taka wizja teologii jest skrajnym uproszczeniem i spłyceniem sprawy. Na pytanie o znaczenie teologii można dobrze odpowiedzieć tylko w świetle wiary. To światło pozwala ujrzeć w teologii Boży dar, charyzmat, który pomaga Kościołowi odczytywać znaki czasu i proroczo interpretować Objawienie biblijne dla danej epoki i kultury. Teolog ma udział w specjalnym charyzmacie, a więc należałoby go postrzegać najpierw jako pełniącego specjalną posługę słowa w Kościele, a dopiero po wtóre jako naukowca. Takie charyzmatyczne ustawienie teologii pozwala przypomnieć sobie z całą mocą, że pierwszym i podstawowym teologiem jest Duch Święty.

Zazdrość jest adaptacyjną reakcją emocjonalną, która sygnalizuje zagrożenie dla aktualnej relacji romantycznej i wzbudza motywację do jej obrony. Uznając zazdrość za mechanizm wrażliwości na sygnały zagrożenia relacji, przewidywano, że wrażliwość biologicznych systemów walki-ucieczki-znieruchomienia (FFFS) oraz behawioralnego systemu hamowania (BIS) będzie dodatnio skorelowana z intensywnością doświadczania zazdrości. Spodziewano się, że związki te będą silniejsze wśród osób bardziej zaangażowanych w relację. Analizowano także orientację na dążenie i unikanie w bliskim związku romantycznym jako mediatory relacji między wrażliwością FFFS, BIS i behawioralnego systemu aktywacji (BAS) a intensywnością doświadczania zazdrości. Badania prowadzono wśród 217 osób w wieku od 17 do 36 roku życia, pozostających w związkach romantycznych. Wykazano, że wrażliwość BIS i FFFS dodatnio koreluje z intensywnością doświadczania zazdrości. Zaangażowanie w związek moderowało zależności między wrażliwością FFFS a intensywnością zazdrości. Orientacja na unikanie w bliskim związku była zaś mediatorem relacji między wrażliwością BIS a doświadczaniem zazdrości.

Previous studies show that maladaptive metacognitive beliefs may constitute the psychopathological core of anxiety and depression. Recent findings also indicate that anxiety exacerbates the severity of depression. We investigated the hypothesis that anxiety mediates the relationship between faulty metacognitive beliefs and depressive symptoms in normal subjects. Two hundred and eight normal participants completed the Metacognitions Questionnaire (MCQ), the State-Trait Anxiety Inventory(STAI), and the Beck Depression Inventory (BDI). We performed mediation analysis to explore the relationships between metacognition, depression, and trait anxiety as a mediator. Our study showed that positive beliefs about worry, negative beliefs about uncontrollability and danger, low cognitive confidence, and negative beliefs about the need to control thoughts, and cognitive self-consciousness were mediated by the level of anxiety associated withthe severity of depression. Moreover, the mediation analysis indicated that only cognitive confidence beliefs directly influenced the intensity of depressive symptoms.

The study discusses the question at which procedural stage a party is to be declared absent in a cause if the party does not respond to the summons. The provisions of the Code of Canon Law, adopted and rendered more precise by Article 138 of the Dignitas connubii instruction, seem to be unequivocal, however a more attentive reading of the Instruction will raise some doubts. In order to resolve this question, the Authors analyse a legal argument which favours a relatively immediate declaration of absence, which however seems weak in the light of Canon 1691. Then article focuses on the right to defence and the principium contradictorii determination of truth as the goal of the proceedings (which favours the declaration of absence to be delayed as late as possible), and finally the economy of the process. The Authors postulate it necessary to avoid the imposition in the citation of an absolute obligation upon the respondent either to provide a reply or to appear in the Tribunal. In the event of the party’s non-appearance it is correct declare it absent from the proceedings only when all attempts to induce participation have failed.

The article is an analysis of Patriarch Kirill’s speech at the assembly of the Inter-‑Parliamentary Union (IPU) in St. Petersburg. It primarily discusses the demand for moral consensus, which is a condition for just laws and true peace. The article starts with a presentation of the specific political and religious context affecting the interpretation of both the IPU assembly in St. Petersburg and Patriarch Kirill’s speech. Subsequently, the author presents the Patriarch’s criticism of the liberal system of values and the conditions of genuine moral consensus; he also discusses the role of religion in reaching this consensus.

Opis:
Anselm of Canterbury’s method to avoid antinomies in theology is presented and analyzed. In Monologion Anselm argues in favour of God’s existing at every time and every place on one side, and in favour of God’s existing at no time and no place on the other side. But this constitutes an antinomy, because e.g. for any time  God’s existing at the time  and God’s not existing at the time  are equally provable. Anselm claims ambivalence of terms of natural languages to be responsible for the antinomy. Anselm’s solution is to introduce to theological discourse two artifical terms: „existing at a time” and „coexisting with a time”. Those terms are provided with precise meaning, which constitutes deductional relationship between them. For any  and  if  is existing at a time then  is coexisting with the time  The converse is, however, not valid. This Allows Anselm to avoid the antinomy. The anticipation of Duns Scotus’ theory of univocity and some contemporary ideas of non-classical logics is also discussed.
