    Opis:
    The value of consultative democracy can not be overestimated, especially considering the local and supra-local administration gradually bringing the resident closer to self-government communities. Therefore, this issue is important and still requires improvement in the area of mutual relations between self-government authorities and residents of communes, districts/departments, voivodeships/regions. The search for common relations in participating in the management of the self-government community is a current challenge facing the territorial self-government in both legal orders. The comparative perspective in the scope of the functioning of commissions and consultative bodies of an obligatory nature is aimed at getting acquainted with the consultative administration in the territorial self-government in both legal orders and proposing directions of changes to Polish legal regulations in this area to improve the consultative dialogue and its normative tools.

    Celem opracowania jest zwrócenie uwagi na nowe formy demokracji, które dekomponują współczesnyparlamentaryzm. Rozrywają one związek pomiędzy wyłanianiem ciał przedstawicielskich (parlamentów)z wyborami powszechnymi. Wprowadzane formy reprezentacji obywateli opierają się na metodzie losowania.Jest to powrót do korzeni demokracji ateńskiej i politycznej praktyki suwerenności narodu. Do tych nowatorskichform należy zaliczyć demokrację deliberatywną i demokrację uczestniczącą. Najbardziej znaną formą demokracjideliberatywnej są panele obywatelskie. Celem paneli obywatelskich jest wypracowanie konsensusuoraz przywrócenie zaufania do pozapartyjnego sposobu podejmowania decyzji politycznych. Starają się onerozwiązywać ważne problemy społeczne i polityczne. W Irlandii doprowadziły do zmiany konstytucji. Był to, nietylko medialny, sukces tej nowej formy reprezentacji obywateli.Stosowanie najnowszych technologii informatycznych i komunikacyjnych znajduje swoje odzwierciedlenietakże we współczesnym parlamentaryzmie. Przyczyniają się one do kumulowania informacji w rękach rządu, cozwiększa jego nieformalną pozycję. Pojawiają się tu pojęcia demokracji medialnej i demokracji smartfonowej. Tenowe zjawiska przyczyniają się także do dekompozycji parlamentaryzmu naszych czasów.
    The aim of the study is to draw attention to new forms of democracy that are decomposing modern parliamentarism. They break the link between the election of representative bodies (parliaments) and general elections. The introduced forms of citizen representation are based on the sampling method. It is a return to the roots of Athenian democracy and the political practice of national sovereignty. These innovative forms include deliberative democracy and participatory democracy. The most famous form of deliberative democracy are citizens' assemblies. The aim of citizens' assemblies is to develop a consensus and restore confidence in the non-party way of making political decisions. They try to solve important social and political problems. In Ireland, they led to a constitutional amendment. It was not only the media success of this new form of citizen representation.      The use of the latest information and communication technologies is also reflected in contemporary parliamentarism. They contribute to the accumulation of information in the hands of the government. This increases its informal position. Against this background, the concepts of media democracy and smartphone democracy appear. These new phenomena also contribute to the decomposition of the parliamentarism of our time.

    In December 2019, the Court of Justice issued a judgment in Case C-418/18 P. Puppinck and Others v. European Commission, ending a long-standing dispute between the organizers of the European Citizens’ Initiative “One of Us” and the EuropeanCommission. Ruling in the appeal proceedings, the CJEU dismissed in its entirety the application to set aside the judgment of the General Court of the European Union of 23 April 2018 in case T 561/14 One of Us and Others v. Commission. The “One of Us” organizing committee requested the repeal of the European Commission’s communication following the public initiative on the grounds that it lacked follow-up. The aim of the “One of Us” initiative was to strengthen the protection of dignity, the right to life and the integrity of every human being from conception in the EU’s areas of competence. The initiative proposed amendments to three legislative acts on research, humanitarian cooperation and their funding. The judgment under discussion is important for the interpretation of EU law in two areas. First, this is the first judgment that interprets the systemic position of the European Citizens’ Initiative in such a comprehensive manner. The case confirms that the ECI is an autonomous institution of EU law, whose systemic position is shaped by the principle of institutional balance and participatory democracy. The ECI is a form of emanation of deliberative democracy. Second, the judgment may be considered as confirming the exclusive competence of the Member States in the area of protecting human life at the prenatal stage. On the one hand, this means that EU law cannot impose its own standards on the right to life on Member States. On the other hand, in the area of its competences, it seems that the EU can have its own ethical position, allowing, while respecting the triple lock system, research involving the use of human embryonic stem cells and financing abortions as part of the package of medical assistance offered to the developing countries.
