    In the proposed draft position the author claims that the challenged provisions of the Act of 13 October 1998 on Social Insurance, insofar as it takes no account of the situation in which the day of death of the decedent was considered to be the date when the court decision declaring the person (for whom social security contributions were collected) dead was made, do not conform with the Constitution. In her opinion, in order to achieve compliance of the above-mentioned Act with the Constitution it would be sufficient to take into account – as a precondition – the suspension of the limitation period due to the death of the decedent. The author notes that in would be at risk of irrationality for the Constitutional Tribunal to adjudicate on both examined provisions, as it is difficult to consider the issue of suspension of the limitation period in relation to the claim for undue contributions when the limitation period has not yet started.

    Opis:
    Provisions of the Act on Pensions from the Social Insurance Fund are contested by a citizen in an the extent that they grant the right to working disability pension not earlier than from a month in which the application was submitted, conform to the Constitution. A contradiction with Article 67 para. 1 of the Constitution, is perceived by the complainant in the assumption that the date from which the claim for payment of social security benefits may be requested, is the date of submission of the application instead of the date of an invalidity and the resulting working disability. In the complainant’s case there was a large difference between the time when the terms of acquiring the right to a pension were fulfilled and the moment in which when the application for the benefit was submitted. The legislator, in the case of retirement benefits, including permanent disability pensions, assumed as a rule that the right to retirement and working disability benefits arises from the date of meeting the conditions required to acquire that right

    Opis:
    The introduction of a one-off cash benefit for pensioners and disability pensioners in 2019 is aimed at reducing income disparities in society. The group of beneficiaries specified in the Act includes various groups of pensioners and is broader than the group pensioners specified in the title of the Act. The author notes that the right to a one-off cash benefit for all pensioners, regardless of their individual pension amount, is a very favourable solution for persons with lower benefits.

    Opis:
    The governmental bill implements of the announced, socalled “thirteenth” pension benefit for each retired citizen. The author estimates that the act aims at reducing income disparities in society, and the government’s bill effectively implements this social objective. This law has far-reaching financial consequences, which may cause the need for transfers in the budget and financial plans of state special purpose funds. In the author’s opinion, this may lead to an amendment of the budget law increasing the level of the budget deficit, especially if other electoral promises will be implemented or economic downturn will occur.

    In the author’s opinion, when taking the decision the examining physician should take into account the general criteria indicated in the definition, i.e., “a violation of the body’s efficiency to the extent that it requires constant or long-term care and help of another person in satisfying basic life needs”. Decision criteria are not specified by other provisions. Determining the occurrence of incapacity for independent existence is made in specific cases by certifying doctors or medical boards of the Social Insurance Institution (ZUS) or by courts examining appeals against ZUS decisions.

    The aim of the paper is to analyse controversial situations in the Polish judicial practice relating to performing incidental paid activities in times of sick leave, both by the insured – employees and persons not being employees, especially entrepreneurs. According to the Author’s opinion only social activities or incidental and mainly formal occupational activities can be qualified as the exceptions from the rule of the loss of the right to sickness benefit. Such view is justified by the public character and formality of the system of social security. Situations resulting in a possible loss of sickness benefit should be assessed each time in the context of the principle of proportionality.

    In the presented project of a position, the author indicates that listed provisions of the act on pensions and allowances from the Fund of Social Insurances are compliant with Article 32 para. 1 of Polish Constitution concerning situation of persons born before the 1st January 1949. The author notes that the differentiating criterion is a presence in one of two separated by a date of birth legal systems of social insurance. The legislator could differentiate legal situation of persons receiving benefits in the system of defined benefit and persons insured, whose pensions shall be paid in a system of defined contribution. In accordance with argumentation “ad maiori ad minus”, if the Constitution allows for a creation of a less favorable legal situation of some insured persons distinguished by their age, a change in favor of insured persons concerning rules of qualifying the time when they did not work, but cared for their children should also be acceptable.

    Opis:
    The proposed bill provides for the amendment of Article 141 of the above-mentioned Act which specifies the limits of enforcement deductions from pension benefits. In the author’s opinion, the entry into force of the rules providing for the lack of opportunities for enforcement of deductions from pension benefits in the lowest amount may lead to adverse consequences for that group of beneficiaries in relation to access to financial services. These institutions may treat such pensioners as people with a low level of solvency, since it is not possible to carry out enforcement deduction directly from periodic benefits they receive. Moreover, a 14-day period of vacatio legis specified in the bill seems too short in the context of the substance of the proposed amendment.

    Opis:
    Demographic changes affect practically all dimensions of socio-economic life. Dynamic ageing of the Polish population and double ageing create new challenges, both in the individual and collective dimensions, in the field of preparation for old age. The emergence of new social issues and intensification of the existing ones make it necessary to implement new solutions. The increased and constantly growing percentage of old people and the oldest old creates many new challenges not only for public authorities, but also for entrepreneurs and employers. Due to the complexity of the consequences of the demographic changes, the subject of the article are the consequences for four selected areas: the labour market, social security, health care, and long-term care.

    The article shows the role of comprehensive rehabilitation in restoring good health, ability and in social and professional activation of the growing population of the disabled. The author discusses changes that have occurred in the approach to disability over time. The paper stresses the importance of comprehensive rehabilitation including medical, social and professional rehabilitation due to the fact that rehabilitation results depend on the work of a team of professionals from different fields working under the direction of a doctor specialised in rehabilitation medicine. It also presents acts of international and domestic law pursuant to which Poland should provide the disabled with equal and quick access to comprehensive rehabilitation, thus enabling them to participate in all aspects of life as fully as possible.

    The paper presents and assesses the Polish regulations related to Agricultural Social Insurance in the context of family legal protection. The particular attention is given to the rules which stipulate the benefits and range of recipients of this insurance. According to the academic literature, social security law plays an important role in the field of legal protection of the family. The author seeks to answer the question whether the existing normative solutions of the insurance are fulfilling this condition. The paper concludes with a presentation of key changes recommended by the author.

    The author of the draft claims that the challenged Article 80 paragraph 1 of the Act is in compliance with Article 31, in conjunction with Article 18, of the Constitution. Furthermore, the author requests that the case be discontinued pursuant to Article 39 paragraph 1(3) of the Constitutional Tribunal Act owing to the fact that the challenged provisions had ceased to have effect (Article 244 paragraph 1 and Article 245 paragraph 1 of the above mentioned Act) before the Constitutional Tribunal passed its judgment.
