Opis:
Polish Patient Ombudsman (PPO) was established to protect individual and collective patients’ rights. Contrary to original plans, it was established as an organ of central government administration. Therefore, the name may be confusing, as it suggests that PPO belongs to the group of entities similar to traditional ombudsmen. In fact, it implements government policy. This lack of independence is associated with the necessity of giving PPO the power to impose penalties for breach of the so called “collective patients’ rights”. Accordingly, PPO can be considered as a kind of “subtype” of the Ombudsman only from the perspective of competencies in relation to violation of the individual patient’s rights. The article analyzes the origins of the Patient Ombudsman institution in Poland, its place in Polish polity and its legal prerogatives in comparison to other bodies that offer protection of patient’s rights. The authors analyze in detail the competence of the Patient Ombudsman in case of violation of individual and collective patients’ rights.

Opis:
The development of biomedicine causes a situation when health care providers are compelled to decide on various medical, moral or even religious matters. The conflict between their conscience (their beliefs and views on what is right and what is wrong) and the duty that they are under, has appeared increasingly in the recent years. The especially difficult situation occurs when their duties are conflicting with their perceptions of the nature of medical services, including abortion and euthanasia. To conclude – the question arises as to whether the medical doctor is a servant (or hostage) of patients or he has the right to refuse to treat a patient when he believes that the requested treatment is morally wrong (conscientious objection). The main theme of the article is an analysis of the regulations of Council of Europe in the matter of conscientious objection.

Opis:
The purpose of this opinion is to explain two legal issues relating to rules of concluding such contracts and control their execution by the National Health Fund. The author claims that the National Health Fund can shape content of contest notice and intention of obligations relationship to provide more than minimum required by the law number of employees in institution, where such health services are supplied. In the author’s view, control of the execution of contracts for performance of basic health services, carried out at night or during the holidays is allowed in any time without prior notice to the performer.

Although the constitutional right to health care itself has not been subject to legislative changes, the emergence of some other legal regulations and their impact on the current state of the healthcare system justifies additional examination. The authors of the article indicate, among others, areas where the most significant changes to the Polish healthcare system took place in the recent years, and wherever possible, they also assess the current situation. The analysis of the current legal basis of the right to health protection focuses particularly on such important values as: equality in access to health and solidarity, human dignity and patient rights, and professional ethics of person providing benefits.

The author of the opinion claims that Polish legislation is not fully consistent with the provisions of the Convention. There is no guarantee for the implementation of the commitments adopted by Poland because of the lack of adjustment of Polish legislation prior to ratification. The Convention meets only the minimum requirements for the protection of human rights and the dignity of human being. Nevertheless, the Constitution establishes higher standard of protection of human rights and the dignity of human beings than that provided for in the convention. Ratification of the Convention cannot lead to decrease the constitutional standard. The use of classical instruments of international law enshrined in the Convention (reservations and declaration of interpretation) may help remove the inconsistency between domestic law and the Convention.
