Opis:
Joint committee meetings are a form of cooperation between two separate bodies of the Sejm. In accordance with Article 163 Paragraph 1 of the Standing Orders of the Sejm of the Republic of Poland, the joint meetings are chaired by one of the chairmen of committees. If a consensus on the issues of determining the guest list and indicating a chairperson cannot be reached, the Rules of Parliamentary procedure contain points preventing the effective block of the work of parliamentary committees.

Opis:
The author states that a Deputy does not have an obligation to make available document received from a private person, regardless the content of the document. Parliamentary immunity, according to the author, does not release the Deputy from an obligation to testify as a witness or does not release the Deputy from an obligation to provide public authorities with a document which may serve as an evidence. However, pursuant to Article 21 the Act on the Exercise of the Mandate of a Deputy or Senator, the Deputy might refuse to provide information about a person who has provided an information to a deputy. This principle applies to civil procedure, criminal procedure and other investigative procedures that include an obligation to testify. The scope of this privilege contains also the possibility of refusing to issue a document received within limits of exercising of the mandate whose content would reveal information of a deputy’s informer.

In the light of Article 163a Paragraph 2 of the Standing Orders of the Sejm of the Republic of Poland the motion to adjourn the examination of the matter by a parliamentary committee is a procedural proposal, since it concerns the conduct of the committee that is hearing the case and does not lead to a decision on the merits. Although the rules of the Parliament don’t define the issue of “postponing” of the work of parliamentary committees, the deadline for the return to the matter should be clarified in some way. In this case the request for deferral of consideration by the committee, pending the outcome of the court. Although it does not indicate a specific date, it specifies a time of return.

In the opinion it was stated that although examining identity documents is associated with a temporary restriction of freedom of a Deputy by an authorized body, it does not constitute a violation of the privilege of parliamentary inviolability. Undertaking Deputy’s activities related to the exercise of the mandate in a border zone, does not require an appropriate consent. The privilege of inviolability does not absolve the Deputy from the obligation to respect the law. As a rule, a Border Guard officer cannot detain the Deputy during performing activities falling within the scope of the parliamentary mandate in the border zone. Deputies may be detained only in the event of joint fulfillment of requirements provided in the Article 105 para. 5 of the Constitution.

The author indicates that according to the provisions of the Act on the Exercise of the Mandate of a Deputy or Senator, only Deputies and Senators may form parliamentary groupings. The author analyzes the possibilities and consequences of the disclosure of classified information by a person covered by the motion for waiver of immunity at a sitting of the Sejm, in the course of examination of the motion. He claims that a person to whom the motion to waive immunity pertains is entitled to comment the information contained therein, including the use of classified information, insofar as they relate to the circumstances of the case and the allegations formulated in the motion. This is a guarantee of the right to defence in the course of proceedings relating to waiver of immunity. The author points out that such proceedings must respect basic procedural standards and, in particular, take into account the constitutional right to defence.

The obligation to submit to the Marshal of the Sejm certain information relates to data on every person who actually performs a specific job for a Deputy, irre‑ spective of its formal classification as a parliamentary office worker or a parliamentary assistant. The duty arises from Article 23 para. 4a of the Act on Exercise of the Mandate of a Deputy and Senator. If the mandatary defaulted on its obligations, the Deputy still has to perform an obligation stemming from Article 23 paragraph 4a of the Act on Exercise of the Mandate of a Deputy and Senator. Consequently, regardless of the time elapsed since the contract was concluded, the Deputy should fulfill this obligation and submit the information about a co-worker to the Marshal of the Sejm.

In the opinion of the author, Deputies have the right to exercise their powers of control over government and local government administration bodies pursuant to the provisions of the Act on the Exercise of the Member’s and Senator’s Mandate. The author points herein to companies with the State Treasury’s shareholding, state and local government establishments and enterprises as well as social organisations and non-state economy units. The analysed regulations do not explicitly name foundations among these entities. On the other hand, the subjective scope of Deputy’s control covers State Treasury foundations established on the basis of statutes, and the scope of control of State Treasury foundations is determined by the contents of binding statutory rules and internal statutes of such foundations.

The author claims that applications for waiving the so‑called formal parliamentary immunity (Article 105 para. 2 of the Constitution) are examples of information about the activities of organs of public authority, regulated by Article 61 of the Constitution (public information). Therefore each citizen possesses the right to acquire access to such applications. However, it does not mean that each of applications may be disclosed. In some cases applications may include information that may be classified as secret under the relevant legislation or whose disclosure would violate the constitutional right to privacy. In case it happens, an application cannot be disclosed – due to the prohibition of granting access to such information provided by Article 5 of the Act on Access to Public Information.

Members of the European Parliament are entitled to a transitional allowance in the amount of their salary for the period of one month for each year in which their mandate has been exercised. In case of exercising the mandate of a Deputy to the Sejm of the Republic of Poland, the allowance should be reduced by the amount of the Deputy’s salary. Should a former MEP be entitled simultaneously to the payment of the transitional allowance and the old-age pension, he or she must choose one or the other. While exercising the mandate of a Deputy to the Sejm the European Parliament old-age pension is reduced by the amount of the Deputy’s salary.

Under the law, in relation to expiry of the mandate a parliamentarian is entitled to a severance pay in the amount of three salaries. The right does not apply to a Deputy or Senator who has been elected for the next term or who has resigned. A Deputy retains the right to the allowance also in a situation where he/she does not take advantage of an unpaid leave and does not possess the status of the so-called professional MP. The protection of the durability of the employment relationship, based on Article 31 para. 2 of the Act, covers only Deputies who took on unpaid leave due to the performance of their mandate.

Membership of a Deputy in the parliamentary team is not considered a type of service or work the pursuit of which requires access to classified information. This is due to the fact that the parliamentary teams are established in order to promote certain values and attitudes, and serve to achieve cross‑party public purposes. The author explains that the exercise of a Deputy’s mandate may require the use of classified information, but each time is it a consequence of the Sejm’s decision.

A former Deputy to the Sejm of the Republic of Poland, and at the same time a former member of the Parliamentary Assembly of the Council of Europe (PACE), cannot be held responsible to the Sejm. Potentially, bringing the above-mentioned person to a criminal liability may be considered, because, according to the author, in the analyzed case, that person was not protected by immunity privileges granted under international law to the members of PACE. A possible launch of this type of legal responsibility would, however, require determining of a few strictly criminal-law matters described in the opinion.

In the author’s opinion, the following provisions (sections) of a bill project referred to committee should not become subjects of voting by the committee, but the committee should vote only on motions aimed at their modification (substantive and editorial amendments and motions for deletion of a provision). A different manner of work of the committee may lead to the deletion of a given provision, if the provision is not approved in voting, even in case of the lack of motion to delete it. The Sejm should decide upon legislative motions and legislative postulates included in the committee’s report on the bill, prepared in the form of a consolidated text.
