    Opis:
    A former Deputy to the Sejm of the Republic of Poland, and at the same time a former member of the Parliamentary Assembly of the Council of Europe (PACE), cannot be held responsible to the Sejm. Potentially, bringing the above-mentioned person to a criminal liability may be considered, because, according to the author, in the analyzed case, that person was not protected by immunity privileges granted under international law to the members of PACE. A possible launch of this type of legal responsibility would, however, require determining of a few strictly criminal-law matters described in the opinion.

    Opis:
    The article focuses on issues related to ratification of the Council of Europe Convention on preventing and combating violence against women and domestic violence. It includes an analysis of constitutionality of the Convention itself and, then, of an international monitoring mechanism of its implementation (The Group of experts on action against violence against women and domestic violence, “GREVIO”). It also examines the possibility of ratification of the Convention without prior ratification of international law instruments referred to in its Preamble (e.g. the Council of Europe Convention on the Protection of Children against Sexual Exploitation and Sexual Abuse). In the author’s view, the Convention does not contain any provisions inconsistent with the Constitution. However, he claims that proper interpretation of this document requires analysis of its authentic texts in English and French. He does not find it necessary to accede to other international agreements specified in the Preamble of the Convention, since the Convention is a comprehensive and autonomous instrument whose proper application does not depend on implementation of other acts.

    Opis:
    The development of biomedicine causes a situation when health care providers are compelled to decide on various medical, moral or even religious matters. The conflict between their conscience (their beliefs and views on what is right and what is wrong) and the duty that they are under, has appeared increasingly in the recent years. The especially difficult situation occurs when their duties are conflicting with their perceptions of the nature of medical services, including abortion and euthanasia. To conclude – the question arises as to whether the medical doctor is a servant (or hostage) of patients or he has the right to refuse to treat a patient when he believes that the requested treatment is morally wrong (conscientious objection). The main theme of the article is an analysis of the regulations of Council of Europe in the matter of conscientious objection.

    Opis:
    The author acknowledges the necessity for a comprehensive regulation of the implementation of judgments of the European Court of Human Rights in Polish law. However, he remains critical towards the bill in question. He considers the solutions concerning the concept of implementing judgments to be defective. The author also indicates errors related to the proposed manner of implementing judgments, in particular to the problem of issue of individual and general measures, the so-called just satisfaction, as well as to determining the scope of executive duties of the state.
