    The aim of the article is to assess the possible effects of joining the eurozone by Poland for its financial market. Special attention is paid to banking and capital markets. The author emphasises the necessity of incurring additional fees by banks, loss of some income (directly related to currency exchange) and opportunity to obtain additional income (resulting from higher loan margins). Next, the author discusses opportunities and challenges related to capital market development, including the risk of reducing turnover in certain segments (for example: derivatives market).

    Draft Regulation of the Council of Ministers establishes the principles of the application by Poland of the possibility of rescheduling payment of the levies provided for in Regulation No 595/2004. In accordance with § 4 of the draft regulation of the Council of Ministers aid provided for therein has the character of de minimis aid, and should be provided in accordance with the provisions of Regulation 1408/2013. This draft regulation does not go beyond the legal framework determined by Regulation 595/2004 in relation to the preamble to the Regulation 2015/517. Consequently, it must be considered not to be inconsistent with Commission Regulation (EC) No 595/2004

    Article 12a (1) of the Act on the Agricultural Market Agency and Organization of Certain Agricultural Markets may provide a basis of the relevant regulation on granting aid under the de minimis conditions since it would be implementation of the provisions of Regulation 595/2004. You cannot unequivocally determine whether this provision could also serve as a legal basis for the Regulation making it possible to grant public aid under different conditions, as detailed assumptions regarding such assistance are unknown.

    The Author claims that the state monopoly in the field of some sorts of gambling as well as obligation to organize certain sorts of gambling only in casinos are restrictions on the freedoms of the internal market (freedom of establishment and freedom to provide services). Referring to the applicable case-law of the Court of Justice, the Author underlines that such solution is justified by an over-riding reason relating to the public interest. Moreover the relevant provisions of law are appropriate and proportionate to the intended object. They are not applied in a discriminatory manner. Due to that, the bill is compliant with the European Union law.

    Opis:
    There are taking place fundamental changes in the architecture of financial market supervision (ESFS, EUB, CMU) in the European Union. These changes are associated with respect for prudential rules. Such situation in fact is a return to the era of once criticized interventionism and the maximum state regulation. The most frequently cited nowadays objectives of the rules related to the single EU financial market (e.g. financial stability, consumer protection and the prevention of market abuse) come down to establish uniform rules of conduct for all with consideration of general welfare (according to principle: the single market = unified supervision = uniform regulations). However the only problem is that the strong integration of the legal systems of EU member states may restrict competition (their economies), inhibit innovation and increase systemic risk that constitutes a denial implemented since 2000 the idea of European financial market integration. The process of Europeanisation of regulation and supervision of the EU financial market is inevitable, nevertheless it requires a constant search for equilibrium point between efficiency and wider security and not from the point of view of euro zone, but a common European system.

    In recent years, the use of new, innovative services, constituting a convenient alternative to traditional credit card payments or to standard account information services offered by banks has significantly increased. These changes demanded a more inclusive regulation of this market which would guarantee security to consumers and more clarity to the new providers of financial services. The Directive in question along with the Regulation introduce these changes, open the market and extend the regulation to many new providers of financial services. In the paper the bases for implementing the EU regulations are presented, as well as the most important of the introduced changes.

    Opis:
    The aim of the proposal is to provide a uniform way to fill the current legal gap in those EU Member States which have not yet adopted legislation specifically on supply of digital content, and the harmonization of the legal systems of those countries that have already adopted such a legislation. Its entry into force will prevent particularization of national rules on liability for failure to perform the obligations arising from contracts for the supply of digital content and for the improper performance of obligation, including the lack of conformity of the digital content with the contract. As a result, it will prevent fragmentation of the digital content market. Entry into force of the proposed directive should improve legal protection of consumers in the event of non-compliance with the contract of digital content received from their suppliers. The proposed directive will have a significant impact on the legal situation of suppliers of digital content. Worth consideration is the removal of defects identified in the opinion that raise doubt as to its legislative correctness.

    Opis:
    The aim of the proposed directive is full harmonization of national legislation on consumer goods in relation to conformity with the contract for distance sale, the seller’s liability for lack of conformity of goods with such contract and under the commercial guarantees. The proposal causes no legislative objections. Its entry into force requires implementation through an amendment of the Civil Code. The implementation of the directive may lead to re-fragmentation of the legal system as concerns the liability for the lack of conformity of goods with the contract. In the case, indeed, the implementation of the proposal will mean the creation of a specific rules relating solely to consumer contracts for a distance sale, and will result in establishing a particular legal regime governing the seller’s liability for one of the many types of sales contracts, distinguished upon the way of its conclusion.
