Opis:
The article presents selected concepts related to integration of government debt of Economic and Monetary Union (EMU) member states by issuing common bonds. In order to evaluate the possible implementation and value of eurozone bonds, the author applies two methods. The first one is cost and benefits analysis (CBA), the second is simulations based on historical data on government debt sourced from Eurostat. Next, the author discusses solutions already implemented and prospects for changes.

The complexity and uncertainty in the application of the European system of financial supervision is due to the fact that its particular concepts were implemented at different times. First, it was the system of European financial supervisors (EBA, EIOPA, ESMA), which was primarily aimed at coordination of national activities. Then, the European Banking Union was established, comprised of the Single Supervisory Mechanism (SSM), and the Single Resolution Mechanism (SRM), as well as the European Stability Mechanism (ESM) which must also be seen in the context of assistance to troubled banks. Difficulties of interpretation are further compounded by a lack of consistency in approach to the institutions subject to examination. Should they include only the euro zone, or the whole EU, only the banks or other institutions as well? If you take into account the SSM, SRM or ESM, it is often not very clear who and when should act what tools should be applied, For example, when the ECB may, and should, correct decisions of national supervisors and what, in the context of increasing involvement of the ECB in the banking union, is the role of the ESRB; whether and when banks can possibly challenge decisions eg. on establishing a capital buffer or inclusion on the SIFI list, etc. Also unclear is the role of the EBA and ESMA in the context of the creation of a banking union, SSM, SRM and ESM and delegation of regulatory powers of ECB and the Commission to regulatory agencies (Meroni doctrine) or creation of regulatory agencies beyond the Treaty (Pringle doctrine).

The aim of the article is to present activities undertaken at the EU level to ensure financial stability, and to assess the degree of stability of the EU financial system on the basis of selected indicators. The first part of the article introduces the concept of financial system stability and describes its importance in the modern economy and the methods of estimating the stability of the financial system. The second part of the article is devoted to the presentation of activities undertaken by the EU to increase the stability of the financial system, and the assessment of financial stability on the basis of two indicators: the Z-score indicator, used to assess the stability of the banking system, and the Stock Price Volatility index, showing the stability of the capital market.

European Supervisory Authorities’ decisions were, from the outset, of particular doctrinal interest, especially in the context of the formal legitimacy to issue them. There are questions as to whether the Agency’s competences in this field should be more on a clearer (than Article 114 TFEU) basis in the primary law of the European Union. It is not surprising that, in 2012, the Court of Justice of the European Union received an action for annulment of the provision of secondary legislation authorizing European Securities and Markets Authority to issue binding decisions prohibiting or restricting short selling of certain financial instruments. Although the proceedings in the case C‑270/12 were completed, it is necessary to make a few comments on the direction of the settlement. The starting point of this is the Court of Justice of the European Union decision in the case Pringle – a key judgment relating to the EU system.

Opis:
The article deals with reforms aimed at strengthening the financial stability of the eurozone and the EU. First, it refers to the “original sin” of the eurozone and the errors committed during its construction in the early 1990s. Then, the lessons from the double crisis of 2007–2009 and 2010–2012 are analysed, and the four main dilemmas that the EU faces in the area of institutional reforms are formulated. The overview of the implemented reforms and their proven impact on the macroeconomic imbalances leads to the conclusion that – although the above-mentioned double crisis combined with the global pandemic crisis have already mobilised the EU to introduce many important changes – the reform agenda is still not finished.
