    In the author’s opinion, in the light of the current provisions of the Act on Petitions and the Act on Municipal Self-Government, it cannot be considered that municipal councils of senior citizens have the legitimacy to submit a petition to the Sejm. In particular, the study notes that the mu‑ nicipal council of seniors is neither a natural person, nor a legal entity. Moreover, it is also not an organisational unit that is not a legal person within the meaning of the Act on Petitions. It was also emphasised that the functions of the municipal council of seniors are, strictly speaking, of an internal nature and it does not have competences that would allow it to represent the municipality externally, including submitting a petition to the Sejm.

    The article provides a comprehensive analysis of the right of petition and the need for regulation of this field by statute. The author examines the right of petition both in historical context and by way of reference to the existing regulations and views of legal theorists. She comes to an unequivocal conclusion that there is need for statutory regulation of the right of petition, that would lead to an elevation of the status of that right which, in practice, has been reduced to the right to make requests and complaints in the form that existed prior to the adoption of the Constitution. Moreover, a separate law devoted to the right of petition would encourage citizens to make use of this form of dialogue with the government and make it possible to comprehensively regulate the issue of petition and to ultimately solve many problems with establishing the mutual relations between petitions, complaints and requests.

    Article addresses the problem of working conditions changes in employment of people with disabilities from the perspective of employers in the open labor market. Shows the structure and dynamics of the disabled people employment in Poland, indicating the barriers, which draw attention of employers – diagnosed on research and analysis. Article refers results of research on successful practices in the employment of disabled workers in enterprises and institutions and the conditions for the implementation of advisable organizational solutions. Also presents the argument of limited effectiveness of economic instruments to motivate employers for employing people with disabilities. Submit proposals for social policy, pointing the growing educational and professional potential of people with disabilities and their expectations to create a more individualized social policy towards this category of citizens and workers.

    This opinion indicates that Polish citizens deprived of freedom and staying in prisons or remand centers, who have the right to vote in elections to the Sejm and are entitled to fully enjoy civil and political rights, therefore have a full right to participate in the submission of a bill initiated by citizens, as referred to in Article 118 para. 2 of the Constitution. In particular, they may establish a legislative initiative committee, and act as an agent of such a committee or his/her deputy. The exercise of this right cannot, however, lead to evade disadvantages related to the actual situation of the convicted person or a person suspected of committing a crime.

    Opis:
    The opinion provides an analysis of advisability and constitutionality of a bill initiated by citizens. The author claims that, pursuant to Article 176 (2) of the Constitution, the organizational structure and jurisdiction of particular types of courts must be specified by statute. However, a statute is not required for the creation of courts. But, in his view, the powers of legislative branch of government to establish and to dissolve the courts and to determine their seats and the boundaries of judicial districts are not at all limited. The author is afraid that after the adoption of the proposal the Act – System of Common Courts Law will cease to meet the requirement of comprehensive regulation of this particular sphere, as its essential elements are regulated in a separate statute. Moreover, the adoption of the bill could result in inconsistency of the provisions concerning creation and dissolution of courts in relation to administrative and military courts which regulations would still be applied. The author also points out numerous defects of the bill of a legislative technical nature.

    The article provides an analysis of the role of urban social movements in the process of democratisation of cities in Poland. The author draws on his research carried out in 2017–2018, during which 30 in-depth interviews with leaders in 16 cities were conducted. The article begins with the history of forming urban social movements and shaping their identity. Next, the author focuses on their role in the processes of democratisation of cities and shaping new city policies. In this context, the pioneer role of urban social movements in promoting participatory tools, such as participatory budgeting and citizens’ assembly, is highlighted.

    Opis:
    The aim of the article is to explore how the Polish Constitution affects lawmaking of the personal income tax (PIT). The main focus is put on the introduction of the material structure of PIT. The first section examines whether the Constitution imposes restrictions on the legislator in this regard. Next, the author states that the provisions of the Constitution on freedoms and rights of persons and citizens should set the direction for the legislator how to distribute the burden of PIT. These are, in particular, the provisions which protect the good of the family. Equality before the law is also important. The author argues that these values should be taken into account when establishing tax reliefs in PIT.
