Opis:
The constitutional complaint under review questioned the constitutionality of a provision of the Act on Detective Services which stipulates that a person who in the course of providing detective services performs activities statutorily reserved for state bodies and institutions is liable to a fine. In the opinion of the author, the questioned provision does not violate the principle of definiteness of criminal law provisions. The use of a GPS locator by a detective may be treated as secret acquisition and recording of data contained in computer data carriers. The challenged provision was assessed as conforming to the Constitution.

Opis:
The proceedings before the Constitutional Court (Ref. No. SK 13/13) deals with two distinct issues related to the criminal proceedings: first, compliance with the constitutional principle of exclusivity of the Act concerning the limitation of constitutional rights and freedoms, Article 275 § 2 of the Code of Criminal Procedure (CCP) in the expired version, insofar as – taking into account open catalogue of forms of limitation of freedom of the individual delivered into the custody of the police – it enables to commit that individual to refrain from entering certain places and contact with certain people and, second, the compliance with the constitutional principles of a right to court and the right to defence of Article 156 § 5 CCP to the extent that the provision – making access to the material of the pre‑trial proceedings (justifying the application of preventive measures) dependent on the consent of a person conducting the pre‑trial proceedings, does not specify the grounds for refusal to give such permit. The Sejm, sharing the complainant’s allegations, found in this case that both analyzed regulations are inconsistent with the relevant provisions of the Constitution.

Opis:
Provisions of the Act on Pensions from the Social Insurance Fund are contested by a citizen in an the extent that they grant the right to working disability pension not earlier than from a month in which the application was submitted, conform to the Constitution. A contradiction with Article 67 para. 1 of the Constitution, is perceived by the complainant in the assumption that the date from which the claim for payment of social security benefits may be requested, is the date of submission of the application instead of the date of an invalidity and the resulting working disability. In the complainant’s case there was a large difference between the time when the terms of acquiring the right to a pension were fulfilled and the moment in which when the application for the benefit was submitted. The legislator, in the case of retirement benefits, including permanent disability pensions, assumed as a rule that the right to retirement and working disability benefits arises from the date of meeting the conditions required to acquire that right

In his position, the Sejm requested the Constitutional Tribunal to state that to the extent, in which provisions of the Code of Civil Procedure provide for a three-month period for filing complaint concerning the resumption of proceedings in case the judgment was based on a counterfeit or falsified document, and to the extent that the failure to meet this deadline results in the rejection of the complaint, conform to the Constitution. In the opinion of the Sejm, an allegation of a disproportionately short deadline is unjustified, as the deadline of three months to perform a specific procedural activity is one of the longest ones provided for in the Polish civil procedure and does not differ from the ones provided for in the civil procedural laws of other European countries. The practice of application by common courts of the provision in question also justifies the position indicating conformity to the Constitution.

Opis:
According to the author of the proposed Sejm’s draft position the indicated provision, being the subject of the Warsaw District Court’s question of law, conforms to the Constitution. Court referendaries perform tasks related to legal protection, other than in administration of justice. In case of filling a complaint against a court referendary’s decision in enforcement proceedings, the court shall hear the case as a court of second instance, in accordance with the provisions on appeals. The complaint against the decision may be appealed only in cases, in which a court decision may be appealed. Proceeding complaints against bailiff’s activities does not constitute “a case” with the meaning of Article 45 para. 1 of the Constitution. The legal norm, pursuant to which it is not possible to appeal against the court referendary’s decision on the complaint regarding bailiff’s activities, does not infringe the constitutional principle of procedural /justice.
