Opis:: The provisions subject to the Constitutional Tribunal’s assessment concern, inter alia, the employment on high rank positions in the Civil Service, the establishment of an employment relationship on the basis of appointment and the conditions and time requirements of work in the context of senior official positions related to the executive power. After analysing the proposed provisions, the author states that they all fully conform to the Polish Constitution.

Opis:: The opinion presents the principle of protection of citizens’ confidence in the state, which is one of the foundations of the constitutional principle of the democratic state ruled by law. Attention was drawn to the specific requirements covered by this principle, such as the guarantee of legal certainty for the individual, the prohibition of retroactivity of the law, or the order to protect acquired rights. Forms of implementation of this principle at the statutory level are presented, as well as its relationship to the so-called right to good administration.

Opis:: This paper presents the principles forming the basis for the present model of the organization of allotment gardens in Poland and their constitutional evaluation as it was presented by the Constitutional Tribunal in its judgments relating to the Act of 6 May 1981 on Workers’ Allotment Gardens and the Act of 8 July 2005 on the Family Allotment Gardens. On the basis of the conclusions of the decisions of the Constitutional Tribunal contesting the constitutionality of several provisions of the current law, the author distinguishes key issues for the future regulation concerning allotments and presents his conclusions de lege ferenda in this regard.
