Opis:
The paper concerns selected issues related to parliamentary procedures. The primary aim is to investigate a particular category of motions, defined by rules of procedure of the Polish parliament as points of order (literally “formal motions”). In Poland, points of order are recognised as a separate category of motions. They may be submitted only in respect of matters being the subject of the orders of the day or the proceedings in a sitting and include, inter alia, motions to: suspend, postpone or close the sitting; close the discussion; alter the procedure of the discussion; close the list of speakers; limit the time of speeches; confirm a quorum. The authors examine how motions of similar subject scope are regulated in foreign national parliaments.

Opis:
The opinion deals with the interpretation of the provision which states that the Marshal (Speaker) of the Sejm may request the committee to express its attitude to the conclusions and remarks made by the legal services of the Chancellery of the Sejm, which have not been taken into consideration, and whether – in this context – it is possible to change the report adopted by the committee. The author argues that the provisions of the Standing Orders of the Sejm provide no grounds for claim that expressing by the committee of its attitude to the conclusions and remarks could take place by way of modification of the report already adopted by the committee. In this situation, it seems that it could only be admissible that the Deputy Rapporteur takes position at the sitting of the Sejm considering the bill or draft resolution in the second reading.

Opis:
The opinion analyses the possibility of removal from office of the Marshal (Speaker) and Vice-Marshals (Deputy Speakers) of the Sejm. In the author’s view, the provision contained in the amendment to the Standing Orders (2008) making possible such a remove is not compatible with Article 110 (1) of the Constitution, which does not relate to appointment of a Marshal or Vice-marshals, but rather deals with the “election” of a Marshal (which would imply his/her irremovability during the term of parliament). He also points to the controversies relating to the possibility of an appropriate application of the provision on resignation from the function of Marshal when the Vice-Marshal has been removed from office. Such an interpretation seems to be abuse of law, since an appropriate application of the provisions in similar situations cannot be assumed, but should rather be expressly formulated in a legal provision. From an analysis of Article 10a (5) of the Standing Orders of the Sejm it follows that the future regulation should be made more specific, particularly by the inclusion of the case of death and the conditions of resignation of the Vice-Marshal.

Opis:
The purpose of this opinion is to explain the legal basis of a “red card” procedure and the legal basis for the cooperation between the national parliaments of EU Member States, including the Sejm of the Republic of Poland, in relation to this procedure. The “red card” procedure involves scrutiny of the compatibility of EU draft legislative acts with the principle of subsidiarity and is operatively associated with the treatybased mechanism for submission by national parliaments of reasoned opinions on the non-compliance of draft legislation with the principle of subsidiarity. The possible concerted action of national parliaments on the “red card” procedure will have the same scope as that applied for “yellow card” and “orange card” procedures. According to the authors, decisions to be taken under “red card” procedure are not inconsistent with the Treaties, do not interfere with the procedures of “yellow card” and “orange card” and would not require changes to the Standing Orders of the Sejm. The legal basis (in both EU law and national law) for cooperation between national parliaments will be the same as the legal basis for their cooperation in the process of submitting reasoned opinions on the non- compliance of EU draft legislative acts with the principle of subsidiarity.
