    Opis:
    The author assesses that it is a legitimate intention to introduce into the legal system regulations providing for the possibility of an effective reaction of selfgovernment bodies to extreme cases of unjustified differentiation of the legal situation and, consequently, the financial one of individual owners of properties on which the adjacency fee is imposed. However, there are serious doubts as to the purposefulness of proceeding the bill, what results from a parallel legislative process, regarding a governmental bill which also covers the issue of the application of reliefs in connection with the imposition of an adjacency fee. The author points out that the legal means planned by the authors of the amendment are inappropriate with regard to the purpose of the statute, because they are connected to norms applied only in relation to civil law receivables, in a situation where the adjacency fee is strictly of a public law nature.

    Opis:
    In the author’s opinion, with regard to the use of reliefs in connection with the imposition of the adjacency fee the bill is insufficiently consistent with constitutional principles, in particular with the constitutional principle of equality before the law. De lege ferenda the provisions of this bill should optimize the implementation of relevant constitutional standards. However, the author points out, that the committee’s bill is consistent with the provisions of the European Union law concerning state aid. It is also emphasized in the article that the provisions of the bill contain many technical and legislative defects, which de lege ferenda should be eliminated.

    The proposed provisions will affect the legal situation of employees (and job candidates) and employers, with some of the legal effects not sufficiently explained in explanatory statement. The proposed amendment to the Labour Code may affect the content of salary regulations and collective labour agreements; it may also constitute the basis for the application of sanctions provided for in labour law for the underestimating or inflating an individual salary.

    The proposed bill contains a new solution regarding “including information on the proposed amount of gross salary” (or indicating the so-called pay range) in the offers of employment for an employee in a given position. Some of the proposed provisions may be controversial or require additional analysis due to their possible effects or possible interpretational problems. The bill will not have direct consequences for public finances, however, it may have social and economic effects as well as financial effects of a microeconomic scope.

    Opis:
    The aim of the bill - indicated by the applicant - is to prevent bypassing the stabilizing expenditure rule (SER) by shifting various categories of current budget expenditure to public institutions not covered by the SER operation. The result of the bill may be, among others, hindering the payment of additional pensions in the future, but also a stronger guarantee of support for people with disabilities. In addition, the proposed amendment may discourage reducing the value of the Demographic Reserve Fund, which had been planned as a damper for adverse phenomena in the pension system. In the author’s opinion, there is a need to review the operation of the SER and to further seal this rule, so that it can affect the sustainability of public finances in the long run.

    The main assumption of the Bill is to reduce the phenomenon of drought. The Bill may contribute to slowing down the outflow of water, water retention in the catchment area, retention of rainwater, protection of aquatic animal species. However, in the author’s opinion, the Bill may at the same time raise doubts, as it may threaten the achievement of other important objectives of the Water Law and other acts. The proposed changes may, inter alia, negatively affect the efficient conduct of administrative proceedings in the field of water management investments, including the development of water energy. The proposed regulations may threaten the protection of life, health, safety of the community against floods, and the achievement of EU renewable energy targets.

    According to the author, the proposed solutions should be considered in conjunction with other provisions which, within the current legal framework, in many areas favour people who conduct non-agricultural activities versus employees. Otherwise, they could be perceived as increasing an unequal treatment of these groups. In his opinion, the financial effects of the proposed regulations are difficult to estimate. Nevertheless, a slight increase in employers’ expenses may be expected due to the increased seniority bonuses and the need for accelerated payments of jubilee awards.

    This article discusses the current position of the supreme nuclear regulatory authority in Poland – the President of the National Atomic Energy Agency (PAA President) in the structure of government administration in the light of provisions of the Polish Constitution and of international and European law, taking into account the principle of independence of nuclear regulatory authorities. A particular attention was paid to the critical analysis of the current subordination of the PAA President to the supervision of the minister responsible for the environment. Based on the arguments relating to the importance of the tasks of the PAA President and their importance for national security, their multifaceted character in relation to various sectors of government administration, as well as on the basis of comparative and historical ones, it is postulated to restore the supervision of the Prime Minister over the PAA President.
