    The opinion describes the procedures for mergers of political parties and all the accompanying reporting obligations. It presents the thesis that in the course of takeover of a party the universal succession applies, but in Polish law there is a lacuna as concerns the principles for succession of public-law rights and obligations of political parties. The author provide a thorough analysis of the obligation to submit financial statements to the National Electoral Commission, on pain of deprivation of subsidies and membership in the case of takeover of a party.

    In a situation when a political party divides into two (or more) formally „new” parties, the law does not provide for the division of subsidies from the state budget for statutory activities of the party. It s not acceptable for the new parties to receive subsidies granted to the predecessing party. In a situation of „separation” from the existing political party, the earlier existing party remains a subject of rights and obligations of a financial nature, including the right to receive subsidies for its statutory activity. If a political party is divided and dissolved, the subsidy is paid until the end of the month in which the party decides to „dissolve itself”.

    The opinion emphasizes that the sanction of deprivation of the right to receive subsidies by political parties constitute an ailment resulting from the violation of legal standards concerning financial reporting of a political party for a calendar year. The Act on Political Parties provides for the possibility of different interpretations of Article 38d governing the reception of subsidies from the state budget by political parties. However, the author claims that a three-year period after which a political party loses the right to receive subsidies, runs irrespective of the termination or shortening of the term of the Sejm.

    Opis:
    A person employed as secretary of the commune (county, province), who has been granted unpaid leave in connection with the assumption of a seat in parliament, is still subject to the statutory prohibition on the creation of, and membership in, political parties. Membership in a political party of a person who is in this situation, existing at the end of unpaid leave must be considered as the basis for the refusal to allow such a person to perform the duties for the position held and for recruitment to other equivalent position. If membership in a political party would expire before returning to his/her duties in the office of the commune, it could be by the employer as a basis for changing conditions employment (change in position), but there is no such necessity.

    The opinion deals with the question of an increasing number Deputies’ (parliamentary) groupings, which poses a real problem for the functioning of the Sejm. It provides a thesis, according to which the governing bodies of the Sejm and the Senate should consider a reform of the rules governing the procedure for the foundation of parliamentary (non-political) groupings. The author proposes changes in the rules of procedure of both chambers and in the Act on the Exercise of the Mandate of a Deputy or Senator in this respect.

    Opis:
    The Supreme Court’s question of law concerns conformity to the Polish Constitution of provisions providing an obligation of the National Electoral Commission to reject a political party’s financial report in any case when financial resources of the party have been collected or spent for election campaigns with an omission of the Election Fund, notwithstanding circumstances, reasons and scale of the infringement of provisions regulating the financing of electoral campaigns. The draft’s author claims that the rule in question does not conform to the principle of proportionality of legislative measures in relation to the expected aims of regulation, flowing from Article 2 of the Polish Constitution. With regard to the assessment of constitutionality of sanction for violation of rules concerning financing of electoral campaigns, i.e. the loss of the right to receive the subsidy within the following 3 years, during which the party is entitled to receive it, the author is of the opinion that this provision conforms to the ne bis in idem principle set out in Article 2 of the Constitution, as well as to the constitutional principle of freedom for the creation and functioning of political parties.

    Opis:
    Political parties may legitimately undertake public activities (including the so-called social campaigns) aimed at encouraging citizens to provide financial support, in the form of pecuniary donations, to monetary works aimed at the implementation of a specific activity of a party within the framework of “influencing with democratic methods the state policy” and statutory goals of a given party. Such activities cannot take the form of a public collection, i.e. involve the collection of funds in cash or in kind in public places or encourage such activities. Payments to political parties made in connection with a specific purpose (e.g. preparation of a bill) are subject to the subjective and quota restrictions set out in the Act on Political Parties.
