The author claims that non‑accountability or non‑liability (parliamentary privilege) provided for in the Act on the Exercise of the Mandate of a Deputy or Senator protects a Deputy (a Senator) only in relation to his/her activity falling with the scope of the exercise of his/her mandate. This privilege is a so‑called permanent immunity, and covers all types of MPs’ liability before the courts, including civil liability. The Act on the Exercise of the Mandate of a Deputy or Senator provides that A Deputy and Senator is entitled to a limp sum to cover the costs related to the functioning of the offices, according to the principles and in amount specified, respectively, by the Marshals of both chambers. These funds cannot be spent for purposes other than those specified above. The absence of insurance (a widely known category of costs) in the list of expenses specified in §9 (1) of the Order No. 8 of the Marshal of the Sejm does not seem to be incidental. In the author’s view, it is deliberately and intentionally omitted in the Order. Civil liability insurance would relate only to organisational and technical aspects of the functioning of a Deputy’s office, but not to the exercise by a Deputy of his/her mandate (i.e. parliamentary duties) in a Deputy’s office

The author points out that the list of rights and duties ensuing from the functioning and dissolution of the Deputy’s office, transferred to the Marshal of the Sejm may include a duty to redress the damage, if that duty arises “in connection with” – and not only “as a side affect” of – the functioning of the Deputy’s office. According to the author, the provision of Article 23 para. 10a of the Act does not limit the amount of obligations of the deceased Deputy that are accepted by the Marshal of the Sejm. If the duty to redress the damage has arisen in the course of running the office after the death of the Deputy, the Marshal of the Sejm is liable for the entire damage including compensation for a real injury and for lost benefits. Nevertheless, the author points out that the damage caused by his action (e.g. causing a road accident) are not connected with the running of the Deputy’s office and, therefore, the Marshal of the Sejm is not liable for them.

Under the Polish legal system, the State Treasury, as a legal counterpart of the state acting in the sphere of legal relationships pertaining to property, participates in broadly defined business transactions as, inter alia, a shareholder in limited liability companies. The author of this article makes an attempt at a comprehensive presentation of legal regulations relating to the issues of liability of the State Treasury acting in its capacity as a shareholder of such a company, while indicating the State Treasury’s liability for civil law obligations of a company in organisation; for third party damage caused by the company in the course of its operation; for the breach of obligations relating to the State Treasury’s status as the company’s shareholder; for the non performance or improper performance of contractual obligations undertaken by the company; and for the breach of EU laws, with the latter, however, arising not directly from EU laws, but from the jurisprudence of the European Court of Justice.

The author denotes that educational activities, carried out on the basis of the Act of the system of education, is subject to a supervision of a curator. Responsibility of a body running a school for a damage done because of unlawful actions of educational staff during a time of performing their duties is not related with a fault. Educational activity, not including running a school, an educational post, a complex or other form of pre-school education, can be conducted in accordance with rules stipulated in the act on freedom of establishment, as an economic activity. In such cases provisions from the Act on System of Education do not find application. Business entities conducting classes with children are not absolved from responsibility for children during such events. Such responsibility is formed on basic rules, interpreted from civil law and a contract between the entity and a child’s parents. A responsibility described in provisions of penal law is also possible in case of certain circumstances justifying it.

The author claims that neither the Sejm nor any of its bodies is competent to reply to the notice. Due to the general and hypothetical nature of the allegations regarding the alleged damages suffered by the Investor, referring to them at this stage should be regarded as premature. From the statements contained in the notice it follows that the procedure for the resolution of disputes specified in Article 9 para. 2 of the Agreement of 1 May 1990 cannot be used in this respect. The indicated three-month time limit for resolving the dispute through negotiation is devoid of legal basis and, as such, not binding. If the dispute is described in the notice will be the subject of court proceedings, differences in the answers given by each recipient of the notice may be used against Poland or the State Treasury. For this reason, it is worth considering coordinating the preparation of response to the notice by all its recipients to prevent a disparity between them.

In the light of existing international law it is not possible to hold the Minister of Defense of the Russian Federation criminally or civilly responsible before the courts of other countries (except for an action before the Russian courts) or the International Criminal Court. Claiming compensation from the Russian Federation for shooting the Malaysia Airlines aircraft is available before the Russian in compliance with Russian law, or before international courts only through interstate litigation, provided that the parties agree to accept the jurisdiction of the International Court of Justice or international arbitration and that the preconditions of responsibility are fulfilled. Claiming is also possible in the context of diplomatic protection, and – in case of actions by individuals against Russia – only before the European Court of Human Rights, after exhaustion of domestic legal remedies and demonstrating that Russia has committed a violation of the rights protected by the European Convention of Human Rights of 1950.

The obligation to submit preventive vaccination is stipulated in provisions of the Act on Preventing and Combating Infections and Infectious Diseases among People. A producer of a vaccine may be liable for damage caused by a hazardous product. It is possible to claim compensation for damages against a doctor, a nurse, a pharmacist or a producer under provisions regarding tort liability. The State Treasury could be liable since the vaccinations are mandatory, and since the State Treasury acts in an authoritative in the sphere of medical service. Determining the scope of legal responsibility of a particular entity requires an analysis of all circumstances of a given caser and may usually require filling a statement of claim.

Opis:
The purpose of this article is to synthesize the basic acts of the so-called model contract law and the relations between the solutions adopted in them and the regulation of contractual penalty applicable in Polish law. Particular emphasis was puted on the analysis of conditions for a claim for payment of a contractual penalty and acceptable limits of modification of a debtor’s liability in Polish and model law. On the basis of model law, it was proposed to resolve the most frequent doubts in Polish doctrine. The comparative conclusions drawn in relation to the contractual penalty are also an example of evaluation of the Polish regulation from the point of view of the progressing process of European private law harmonisation.
