In the opinion it was stated that although examining identity documents is associated with a temporary restriction of freedom of a Deputy by an authorized body, it does not constitute a violation of the privilege of parliamentary inviolability. Undertaking Deputy’s activities related to the exercise of the mandate in a border zone, does not require an appropriate consent. The privilege of inviolability does not absolve the Deputy from the obligation to respect the law. As a rule, a Border Guard officer cannot detain the Deputy during performing activities falling within the scope of the parliamentary mandate in the border zone. Deputies may be detained only in the event of joint fulfillment of requirements provided in the Article 105 para. 5 of the Constitution.

The issue under analysis concerns the anonymisation of the data of a natural person to whom the Deputy has a financial obligation. After analysing the provisions of the GDPR, the author concludes that they do not preclude the disclosure of the name of the natural person with regard to whom the liability has arisen and do not provide a legal basis for effectively requesting the Marshal of the Sejm to anonymise the data of private individuals with regard to whom the liability has arisen in the declaration of assets.

In the author’s opinion, the bankrupt trustee may be an addressee of a Deputy’s request for information pursuant to Article 19 para. 1 of the Act on the Exercise of the Mandate of a Deputy or Senator as a manifestation of an extra-parliamentary (local) sphere of performing the mandate. However, obtaining information by the Deputy from the trustee in this manner seems possible only when the bankruptcy proceedings concern a company with a share of the State Treasury, a state enterprise or a local government enterprise.

The subject of the opinion is the issue, whether a Deputy as a natural person could process personal data and whether processing the data must be notified to the Inspector General for Personal Data Protection. The author claims that parliamentary activities might involve processing personal data. However, in most situations the possibility of processing of sensitive data by a Deputy must be excluded. The duty to register a set of personal data concerns these Deputies who process such data under statutory rules beyond indicated exceptions.

Standing Orders of the Sejm
Opis:
Suspension of the membership in Deputies’ (parliamentary) club is not the same as loss of membership, hence it does not cause changes in the composition of a club. Due to the fact that the Standing Orders of the Sejm do not include any provisions concerning the status of a Deputy, whose membership in the club has been suspended, effects of such suspension should be perceived solely in the sphere of club’s internal matters. The suspended Deputy, until a information about a loss of his/her club membership is submitted to the Marshal of the Sejm, shall be treated by Sejm authorities as a member of the club.

Opis:
The Act on the Exercise of the Mandate of a Deputy or Senator constitutes legal basis for requiring by the Deputy the access to recordings from the session of a communal council. However, there are no sanctions in case of local self-government unit’s infringement of such an obligation towards Deputies and Senators. The lack of specific legal instruments does not exclude the possibility of taking action on general terms, i.e. on the basis of provisions concerning control and supervision over local self-government. A Deputy may demand, from the chairperson of the council, an explanation of reasons for the inability of the realization of such right.

Deputies’ offices do not constitute an economic activity of deputies, but are used to perform public functions. Therefore, the obligation to establish employee capital plans does not apply to Deputies. Moreover, MP’s cannot set up such plans voluntarily for their staff. The author of the opinion considers that the income and revenue included in Deputies’ financial statements should be equated with the income and revenue within the meaning of the tax law. A Deputy is obliged to disclose in his or her financial statements both the income and the revenue from an agricultural holding, whereby the revenue should be understood as cash inflows obtained by the holder of a farm in a calendar year, while the income should be understood as revenue decreased by the sum of costs of its acquisition, i.e. those types of costs which may be deducted by the taxpayer from the revenue obtained.

The opinion concerns Deputy’s entitlement to oversighting and intervening in establishments and enterprises on the basis of Article 19 and 20 of the Act on the Exercise of the Mandate of a Deputy or Senator. It was stated that a Deputy has a right of access to documents (insight into operations). It has been observed that providing information is is not equivalent to “access to documents”. The Deputy has a right to obtain information and explanations, but not to get an access to documents. The indicated provisions are examples of the so-called leges imperfectae, because the Act does not provide any consequences of non-compliance with them.

The author points out that a Deputy may receive a severance pay in connection with retirement, if the retirement pension right existed before the acquirement of the status of a Deputy and the payment of the retirement pension was initiated later, after completion of the age specified by law. The severance pay in connection with retirement is due only if the Deputy has not received this benefit based on other rules. If a Deputy possesses several such rights, he/she must choose one of them.

All activities of Deputy – author of the Patronite website constitute non-parliamentary activity, which is only partly subject to copyright and related rights, and therefore affects the Deputy’s right to receive parliamentary salary. The Deputy is subject to an obligation to notify such activity to the Marshal of the Sejm. Income, other financial benefits and donations, which Deputy registered as an author on the Patronite website receives from the patrons of this website, are subject to disclosure in the declaration of financial status and appropriate notification to the Register of Benefits. As a part of activities resulting from the status of author of the Patronite website, a Deputy may not directly or indirectly refer to his parliamentary mandate or use the title of deputy.

A deputy of the European Parliament is obliged to submit an asset declaration to both the Mar‑ shal of the Sejm and the President of the European Parliament. Opis:
A person employed as secretary of the commune (county, province), who has been granted unpaid leave in connection with the assumption of a seat in parliament, is still subject to the statutory prohibition on the creation of, and membership in, political parties. Membership in a political party of a person who is in this situation, existing at the end of unpaid leave must be considered as the basis for the refusal to allow such a person to perform the duties for the position held and for recruitment to other equivalent position. If membership in a political party would expire before returning to his/her duties in the office of the commune, it could be by the employer as a basis for changing conditions employment (change in position), but there is no such necessity.

Membership in international organizations does not fall into the category of additional engagement referred to in Article 33 para. 1 and 2 of the Act on the Exercise of the Mandate of a Deputy or and Senator. Consequently, the Deputy is not obliged to notify the Marshal of the Sejm his/her intention of becoming a member of a particular international social organization. The author notes, however, that in the case where that organization runs business activity and when membership would entail participation in its governing bodies, then such participation should be notified to the Marshal of the Sejm.
