Opis:
The opinion concerns formation of the new Deputies’ Club of the Polish People’s Party and the Union of European Democrats composed of Deputies from different political parties. The principle, which implies that these independent parties retain their organisational and programmatic difference, is politically binding for the new club and it is not contrary to the Standing Orders of the Sejm or other acts. Deputies’, Senate and parliamentary associations may be only composed of Deputies and Senators, thus the provision of club’s rules of procedure which states that Members of the European Parliament (chosen from the Polish People’s Party’s list) could be members of the Deputies’ Club of the Polish People’s Party and the Union of European Democrats, does not conform to binding legal provisions

The subject of the opinion is an assessment whether the Deputies’ Ethics Committee should examine cases concerning violating the Rules of Deputies’ Ethics by former Deputies. According to the author – and the rule of discontinuation – proceedings started in the former term of the Sejm and not concluded with a decision of the Committee might not be examined by the Committee in the following term. Competences of the Committee involve only Deputies of the term in which it was formed, and they concern only actions (delicts) committed in the course of this term.

Opis:
Suspension of the membership in Deputies’ (parliamentary) club is not the same as loss of membership, hence it does not cause changes in the composition of a club. Due to the fact that the Standing Orders of the Sejm do not include any provisions concerning the status of a Deputy, whose membership in the club has been suspended, effects of such suspension should be perceived solely in the sphere of club’s internal matters. The suspended Deputy, until a information about a loss of his/her club membership is submitted to the Marshal of the Sejm, shall be treated by Sejm authorities as a member of the club.

Opis:
The considerations concern the issue of legality of replies of National Prosecutor to interpellations and Deputies questions on matters related to activities of the prosecution. A reply made by the National Prosecutor is possible in case when he was equipped with a special authorization of the Minister of Justice. It does satisfy the constitutional requirement for submitting these replies by members of the government. Replies provided by the National Prosecutor do not detract from the dignity of parliamentary institutions. The author shows that such replies are in full compliance with the Constitution.

The amendment is aimed at preventing situations where, on the basis of unfounded allegations, a teacher or school head is suspended in the performance of his/her duties. In the author’s opinion, the source of the problem, which the draft regulation is intended to solve, has not been properly identified, because sufficient justification of the charges against a teacher depends on the practice of bodies applying the law, and not on the applicable regulations. In the proposed shape, the regulations may impede the detection and punishment of disciplinary torts concerning violation of children’s rights and interests. The author also postulates a change in editorial rules.

The author analyses the proposed amendments to the Criminal Code. She considers the introduction of the concept of “sexual autonomy” proposed in the bill as unnecessary, due to the existence of the notion of human freedom in the sexual sphere, considered both on a negative and positive level. The bill assumes, inter alia, a change in the statutory features of the crime of rape, which may result in decriminalization of certain cases that are currently covered by the “deception” features in the crime of rape. The author raises substantive doubts about the bill, which in her opinion require further legislative work.

The bill provides for the introduction of regulations allowing same-sex marriages. In the author’s opinion, it is inconsistent with the provision of the Polish Constitution, in which the legislator decided that marriage is a relationship between a woman and a man. The presented interpretation of Article 18 of the Constitution is confirmed, inter alia, by the course of the work of the Constitutional Committee of the National Assembly, which shows that the intention of the legislator was to exclude the admissibility of introducing a regulation providing for the possibility of marriage by persons of the same sex.

In the opinion of the author, the draft provisions duplicate the existing regulations in the field of taxpayer’s rights arising from the Constitution of the Republic of Poland and the Tax Ordinance. However, the implementation of the goal assumed by sponsors of the bill is desirable and would certainly meet with a positive public perception. The author emphasizes that an alternative solution could be the development of an act constituting an exhaustive set of taxpayers’ rights and the corresponding obligations of tax authorities, on a legal basis arising from the Constitution or laws.

The Deputies’ Bill on Marital Equality provides for the possibility of marriage between two people regardless of their sex. It introduces the possibility of adopting children by a single-sex couple. It does not regulate matrimonial property relationships. The opinion presents the jurisprudence of the ECtHR and international regulations which indicate that they do not contain a clear and commonly accepted definition of marriage. As a result, it cannot be claimed that the parliamentary draft law breaches, international law.

The bill provides for the replacement of the current Act on Arms and Ammunition with a new statute containing, inter alia, more detailed definitions of types of weapons, changes regarding the system of issuing weapon permits and new rules on the location of shooting ranges. The author has reservations about the constitutionality of the proposed use, in the criminal provisions, of references to entire chapters of the bill, which may make it impossible to clearly define what behaviour will constitute a criminal offence.
