Opis:
“Smart village” is defined as a region or local community that uses digital technologies and innovations in everyday life, thus improving its quality, the standard of public services and the use of local resources. The European Union supports projects implementing this concept – they are implemented as part of the EU’s rural development policy (Common Agricultural Policy) and financed from the EU budget, the European Agricultural Fund for Rural Development. At national level, the objectives and rules for the implementation of the “intelligent rural areas” concept are defined by Member States in their strategic plans for the Common Agricultural Policy. The Polish Strategic Plan provides for the implementation of such projects, defines the objectives that they are to achieve and the principles of their implementation and financing.

The article examines the legal consequences of Protocol (No 30) on the application of the Charter of Fundamental Rights of the European Union to Poland and to the United Kingdom. The author notes that the Charter does not merely confirm the fundamental rights previously recognized in EU law, but also introduces new ones. In the light of this statement it is proposed, that – according to article 1(1) of the Protocol – the Charter does not extend the ability of given courts to examine the compliance of laws and practices of Poland and the UK with the Charter, as far as it introduces these new rights. Article 1(2) of the Protocol excludes the possibility of litigation based on provisions of title IV of the Charter. Article 2 of the Protocol aims at preventing the EU from imposing changes of national laws and practices in certain areas. In the light of provisions of the Charter (particularly article 52(6)) it is however doubtful, whether article 2 constitutes any genuine modification of legal obligations. Finally, the author notes, that according to the predominant view it would be theoretically possible for the Court of Justice of the EU to diminish or even deprive the Protocol of actual practical consequences by making use of general principles of EU law. This however might be regarded as a circumvention of primary EU law and as such deserves negative opinion.

The authors discuss the Parliament’s tasks in relation to the accession process, which can be divided into several basic areas. The first is the creation of the constitutional framework to provide a national legal basis for the membership in the European Union. The Sejm also decided on the method of ratification of the Accession Treaty in the form of a referendum, having previously adopted the necessary provisions for its execution. The power of parliamentary scrutiny over the accession process was actively exercised. The Sejm conducted political supervision of the accession negotiation process, analysed the state budget and its implementation with a special focus on expenditures on integration aims, and monitored the use of pre-accession funds. Another area of the Sejm’s activity was the preparation of the legal framework for functioning after accession to the EU. The Sejm also participated in the process of European integration through its activities in the field of parliamentary diplomacy.

The influence of the latest technologies on the lawmaking process is undoubtedly significant and with the growing popularity of technological phenomena (artificial intelligence, the Internet of Things, Big Data) it is becoming larger. It is important that rules adapt to natural behavior in the information society, and not vice versa. The development of modern technologies contributes to changing existing business models and consumer behavior – inter alia the draft directive on copyright in the digital single market indicates difficulties concerning legal regulating of these phenomena. On the other hand an example of regulating legal status of machine datashows that the establishment of another exclusive right can have disastrous consequences for innovation.

The treaty is aimed at strengthening the economic pillar of the economic and monetary union by solution which requires national governments to have budgets in balance or in surplus. The author claims that those provisions of the Fiscal Stability Treaty which contain more rigorous solutions than those provided in the Treaty on the Functioning of the European Union are contrary to that Treaty. He also claims that several proposals are vague and can raise doubts about their accordance with the Law of European union. Proposals that multiplies solutions of primary law are in comply with the Law of European Union. In the author’s view ratification procedure of this Treaty should be taken in accordance with the provisions of Article 90 of the Constitution of the Republic of Poland.

A legal education program, as a general rule, is implemented in the educational systems of all European countries analysed in this article. Most often, however, as it is in Poland, it is not a separate school course, but legal topics are integrated with various school subjects. If a separate school subject called “Legal education” appears in school curricula, it is most often taught in general education schools as an optional course or in vocational and technical secondary schools - as a course supplementing the knowledge of the future graduate about the legal aspects of the profession taught.

The subject of this opinion is to discuss the powers of the European Union Affairs Committee of the Sejm addressed to the Council of Ministers under the provisions of the Treaty and the Standing Orders of the Sejm. According to the author, the Committee is entitled to request information from the representative of the Council of Ministers on the draft acts on the agenda of the European Council, whereas it may not request information on the specific position to be taken by the Prime Minister during a meeting of the European Council.

This opinion concerns the possibility of appending a dissenting opinion to the opinion passed by the European Union Affairs Committee. The author claims that opinion of the Committee should be regarded as the position of the competent authority of the Sejm. Article 148c paragraph 2 defines the subject of a Committee opinion. The constitutive element of such opinion is an assessment of the position of the Council of Ministers, expressed in its acceptance or rejection by the Committee. The author stressed that Article 148c sets the subject of the opinion but does not provide possibility to attach dissenting opinions by the Committee members who are distancing themselves from the position adopted by the Committee.

The author, after analysing the contents of the Council Decision 2020/2053 in the light of national, European and international law, states that the decision does not levy any new taxes on the member states and does not grant the Union any new powers. In her opinion, the decision includes only a temporary authorisation for the European Commission to take out loans. Therefore, the author believes the decision needs to be ratified pursuant to Article 89 para. 1 of the Constitution, i.e. it requires a prior consent granted in a statute. She rejects the opinion that the decision should be ratified pursuant to Article 90 of the Constitution.

The opinion deals with the effects of the European Commission Implementing Decision whereby ellaOne is commercially available in all Member States without a prescription. The analysis leads to the conclusion that under the existing law, Poland is obliged to implement the decision of the Executive Committee and the medicinal product ellaOne should be available over-the-counter. Nevertheless, Polish legislature may decide to exclude or restrict the sale or use of medicinal products as contraceptives or abortifacients. Therefore, it is permissible to adopt a regulation to prohibit the sale of ellaOne or adopt provisions specifying that it will be available in Poland only on prescription.

The opinion concerns a draft resolution to amend the Standing Orders of the Sejm of the Republic of Poland. The principal purpose of the amendment was to abolish the requirement to seek an opinion of the minister competent for Republic of Poland’s membership in the European Union when considering matters concerning the conformity of provisions of the considered bills to the legislation of the European Union. Sponsors of the resolution justify the amendment on legal grounds, such as the need for implementation of the principle of separation of powers, and on extra‑legal grounds, such as the need for modernisation and restoration of functionality of the provision of opinions on legislative proposals. The author of the opinion challenges the arguments of the sponsors of the draft resolution, pointing out its lack of appropriate justification and possible inconsistency with the provisions of both the Constitution and the Act on the Branches of Government Administration.

Having assessed the EU documents, the author states that the proposed decision does not have social, economic or financial consequences. When assessing documents legally, the author states that the recommendations and the determination of a clear risk are two separate acts of the Council, the recommendations of which are a an act adopted prior to the one concerning the identification of the clear risk. Consequently, the recommendations cannot be part of the statement of a clear risk. The defective nature of the Commission’s proposed decision makes it difficult to assess the impact. The contradiction of this decision with the TEU should be challenged by the European Parliament during the consent procedure or by the Court of Justice in the course of the follow-up procedure.

The author provides an analysis of Poland’s obligations as a Member State of the European Union, relating to the implementation of Community law in so far as it concerns Ellaone contraceptive. He points out that Regulation 726/2004 does not regulate issues related to the marketing of medicinal products in a comprehensive manner. Directive 2001/83/EC of the European Parliament and of the Council, according to its Article 4 para. 4, does not affect the application of national legislation prohibiting or restricting the sale or use of medicinal products as contraceptives or abortifacients. In Poland, there is no legislation expressly establishing a ban or restrictions on marketing or application of this particular type of agents, and any possible national legislation introduced to implement the restrictions permitted under the Directive should not only aim at eliminating the effect of the decision of the European Commission amending marketing authorisation issued by a decision (2009) 4049 for “ellaOne – ulipristal acetate”, a medicinal product for human use, but should relate to this category of products.

The purpose of the opinion is not to examine thoroughly the proposal for a regulation but only to assess the legal basis for its issue, and to provide an analysis of those provisions of the proposal that may raise doubts about their conformity with the Constitution of the Republic of Poland. The main conclusions of the opinion relate to the lack of grounds for delegation by the Republic of Poland to the bodies of the European Union of the competence to regulate the issue of clinical trials on medicinal products for human use under primary law of the EU. Such delegation would infringe Article 90(1) of the Constitution. The author claims that the time limits specified in the proposal for regulation for action of the State make it impossible for Polish public authorities to implement obligations resulting from the preamble to the Constitution and their duties relating to protection of individual’s rights referred to in its Article 30.
