Opis:
The author of the article argues that constitutions are written in a well-thought-out manner, in view of the scope of matters to be considered, their subjective content, particular sequence and internal composition. Constitutional issues mostly reflect general experiences of a number of countries, but also unique solutions of the country’s own historical experience. The Constitution of the Republic of Poland of 1997 is an act founded, in principle, on liberal-democratic philosophy which takes into account experiences from systemic transformation since 1989, and reflecting political and axiological compromises made during the preparation thereof. In the conclusion, the author finds, above all, that the Constitution meets the current standards of European constitutional law. Apart from some deficiencies mentioned in the article, the author does not find need for any considerable modification or supplement, unless a substantial change is to be made in the philosophy of political system on which it is framed.

In the case pending before the Constitutional Tribunal, a review is to be carried out in relation to the statute granting consent for ratification by the President of the Republic of Poland of the European Council Decision of 25 March 2011 amending Article 136 of the Treaty on the Functioning of the European Union with regard to a stability mechanism for Member States whose currency is the euro. Article 90 in conjunction with Article 120 the first sentence in fine of Polish Constitution and Article 48 (6) of the Treaty on European Union are invoked as a standard for the review. In the opinion of the Sejm, those standards for the review are inadequate. In relation to other matters, the Sejm applies for discontinuance of the proceedings due to inadmissibility of making a decision.

Opis:
Statutory institutionalization of civil partnerships stirs up large controversies and considerable disputes in the public debate. Legal arguments appearing in the discussion regard Article 18 and Article 32 of the Constitution of the Republic of Poland. The author expressed a negative position concerning the possibility to institutionalize civil partnerships in compliance with the Constitution. In his opinion an appropriate and consistent with the Constitution legal solution is to strengthen or to extend the scope of rights of persons remaining in such partnerships (hetero-or homosexual ones) ensured by various legal acts, without statutory institutionalization of these partnerships.

The author points out that in Polish constitutional tradition, bicameral parliaments play very important role. She examines the structure and functions of a bicameral parliament, claiming that the Senate acts as the second chamber under an unequal bicameralism model. The main function of both chambers, performed jointly, is lawmaking. In the author’s view the arguments for abolishing the Senate – although currently presented in political debates and declarations – in the nearest future will probably not be given support for bringing them to life. The more probable seems to be a reform of the second chamber, not only in the field of legal solutions, but also on via parliamentary practice.

The conflict between the protection of authors’ work and their right to financial benefits on the one hand and a demand for broad access to cultural goods on the other requires the existence of regulations concerning fair use rules (both personal and public).The bill, however, raises doubts about the compatibility with Article 64 paragraph 1, in conjunction with Article 31 paragraph 3, of the Constitution. The authors consider the bill to be the wrong way to implement Directive 2001/29/EC of the European Parliament and of the Council of 22 May 2001 on the harmonization of certain aspects of copyright and related rights in the information society. There is doubt as to whether the bill is consistent with international conventions.

The author, after analysing the contents of the Council Decision 2020/2053 in the light of national, European and international law, states that the decision does not levy any new taxes on the member states and does not grant the Union any new powers. In her opinion, the decision includes only a temporary authorisation for the European Commission to take out loans. Therefore, the author believes the decision needs to be ratified pursuant to Article 89 para. 1 of the Constitution, i.e. it requires a prior consent granted in a statute. She rejects the opinion that the decision should be ratified pursuant to Article 90 of the Constitution.

The provisions subject to the Constitutional Tribunal’s assessment concern, inter alia, the employment on high rank positions in the Civil Service, the establishment of an employment relationship on the basis of appointment and the conditions and time requirements of work in the context of senior official positions related to the executive power. After analysing the proposed provisions, the author states that they all fully conform to the Polish Constitution.

The author raises arguments in favour of considering the proposed solutions unconstitutional. The amendments to the provisions of particular statutes, envisaged in the Bill, which regulate the relations between the State and individual churches and religious associations, do not meet the constitutional requirement of consensual regulation of relations. Furthermore, it should be considered whether the vacatio legis proposed in the bill is sufficient for the addressees of the regulation to adapt to the new solutions. Legislative shortcomings of the draft were also indicated.

In the opinion of the author, the provision of the Bill, which introduces an obligation to record and disclose all benefits for churches and religious associations by units of the public finance sector, is compliant with the Constitution. However, the introduction of provisions on the rights of churches and religious associations without observing the consensual procedure provided for in the Constitution may become the basis for an effective allegation of non-compliance with the Constitution, and – in the case of relations with the Catholic Church – also of non-compliance with provisions of a ratified international agreement.

Article 1, Article 2 and Article 84 of the Constitution of the Republic of Poland state that there is no obstacle to the placing of sales tax charged only to certain categories of taxpayers, as long as its main objectives will be sufficiently justified by the protection of particular constitutional values. The introduction of sales tax charged only on the supermarkets may be also considered compatible with the provisions of Article 32 of the Constitution provided that it protects constitutional values. From a subjective point of view, large-format stores category does not appear to satisfy the condition required for tax generality by definition. At the moment there isn’t any legal possibility of introducing to the Polish tax system of a turnover tax or any other tax borne solely by supermarkets.

The aim of this opinion is to answer the question of how the status of a full-time (also called “a professional”) Deputy to the Sejm (assuming that it is the only form of his/her activity) involves limitations on his/her human and civil rights enshrined in the Constitution? According to the author, the establishment of a full-time job as the only form of exercise of the Deputy’s mandate, would need an amendment of the constitution. The legislative interference must respect the constitutional requirement that any limitation of the rights and freedoms should correspond to the public interest and respect the principle of proportionality.

The bill proposes to separate from persons holding state positions a subgroup consisting of the President, Marshals and Deputy Marshals of the Sejm and Senate, the Prime Minister and Deputy Prime Ministers of the Council of Ministers and Ministers, who would be obliged to disclose not only their personal and marital property, but also personal property of their spouses. In the opinion of the author, the determination of the above group may raise doubts from the point of view of the constitutional principle of equality. Objections also apply to the proposed principle of publishing address data, the information about the location of the property and the information enabling the identification of the movable property of the person submitting the declaration. Publication of such statements in the Public Information Bulletin raises serious constitutional doubts.

In the author’s view the possibility of submitting documents and applications by air carriers to the President of the Civil Aviation Authority in a language other than Polish raises serious due to its lack of conformity with Article 27 of the Constitution. Other provisions of the proposed amendment do not raise doubts about their constitutionality. In accordance with the proposal all administrative cases filed and pending before appropriate bodies (mostly the President of the Civil Aviation Authority) are subject to the new provisions which will be inserted in Aviation Law Act.

A restriction concerning conducting business activity set out in the aforementioned provisions should refer to State property understood as a property of the State Treasury and the one of State legal persons. After an analysis, while agreeing with the view that tenancy (similarly to lease) should not be classified as an economic activity, and bearing in mind the principle that in view of the ambiguity of the regulations, norms determining the prohibition should not be interpreted restrictively, the author expresses a view that the prohibition provided in Article 34 para. 1 of the act does not apply to the lease of agricultural land by a Deputy to a company wholly owned by the State Treasury.
