PUBLIC BANKERS IN ROMAN LAW SOURCESSummaryThe Romans had an extensive terminology for persons who engaged in banking activities; however, only nummularii and mensarii pursued activities on behalf of the State. Their operations may be regarded as public banking in the broad sense of the term, and were conducted from the 4th century BC until the 3rd century AD. Banking was of key importance in the peak period of growth for Roman trading and financial operations, and this is confirmed in the sources for Roman law. We do not have any records for the bankers referred to as nummularii until the period of classical Roman law, when we get fragmentary references to them in the writings of Roman jurists. There are only two passages on their public activities in the quality control and exchange of coinage; the first is by Sextus Caecilius Africanus, and the second is Ulpian’s commentary on the duties of the prefectus Urbi. Other references to them in the works of Roman jurists relate to their operations concerning deposits and credit, and as such do not belong to the sphere of public law. We get more mentions of public bankers in the Roman non-legal literature. Mensarii, who performed a certain type of public banking duties, are referred to in Livy’s Ab urbe condita. Cicero, Suetonius, and Festus also wrote about them. Moreover, Grammaticus treated the term mensarii as synonymous with nummularii. Presumably the two categories of public bankers were considered to be generally respected individuals. We also have mentions of the nummularii in the non-legal literature. In his Satyricon Petronius esteemed their skills of assessing the quality of coins; they were also held in high regard by Martial, Suetonius, and Apuleius. Suetonius wrote of the severe penalties imposed on the nummularii by the Emperor Galba. On the other hand, all we get in the epigraphic sources, mostly tombstone inscriptions from Rome, elsewhere in Italy, and the western provinces, are records of the activities of the nummularii for the quality control and exchange of coinage, considered an important duty from the point of view of the State. In fact the non-legal and epigraphic literature of Rome tells us more about public bankers than do the sources on Roman law. Their work did not give rise to many legal problems, as we may conclude from the fact they are mentioned only in two juridical passages. The assessment of the quality of coins and their exchange, and other banking activities on behalf of the State were sufficiently supervised by Roman administrative officers, so there was no need for jurists to comment on them at length.

Historical PatternsSummaryThe author uses a specific example, multiple residence under German law, to show the impact of Roman law on many of the modern European legal systems. The observations made by the editors of the German Bürgerliches Gesetzbuch (BGB) and the sources and literature they used show that Roman law was still relevant and universal in the 19th century, the age of the great codifications. Today, too, it is admissible under German law to have more than one residence and the issue is not controversial.

The Judicial Mortgage: A Form of Securing Tax LiabilitySummaryThis paper incorporates a characterisation and a thorough dogmatic analysis of the judicial mortgage as a form of securing the satisfaction of tax liabilities in Polish law. The significance of this issue warrants a discussion of the research both on its practical and theoretical aspects. In addition there has not been much interest in this subject in the Polish tax and legal literature. Undoubtedly, the amendments introduced during the last few years have prompted numerous questions and doubts with regard to these issues, which justifies the need for such research all the more. The fact that securing the satisfaction of tax liabilities is performed by employing methods well-known in civil law connected with liability involving rights in rem such as the mortgage, and the insufficient regulations regarding the judicial mortgage in tax law have made it necessary to analyse the legislation on private law as well as the doctrines and case-law connected with it.

THE CATEGORIES OF “AUTHORSHIP” AND “THE WORK” IN THE DRAFT FOR THE EUROPEAN COPYRIGHT CODESummaryEconomic and technological factors have brought radical changes to the legal framework of authors’ copyright protection on both the national and international levels. Despite twenty years of directives and ECJ case law, the copyright system in the European Union is still fragmented and ill-adapted. This paper provides an insight into the Wittem Group’s European Copyright Code, established in 2002, the first draft European copyright codification. The aim of the Wittem Copyright Code is to increase the overall protection of authors and to provide a new, holistic approach to copyright. The paper presents useful clarification of the meaning of specific provisions in the European Copyright Code, and particularly of the concepts of “The Work” and “Authorship”.

The Lost Academic Legacy of Ignacy DaniłowiczSummaryIgnacy Daniłowicz occupies a special place among Polish law historians of the first half of the nineteenth century. This profesor of Vilnius, and then Kharkov, Kiev, and Moscow Universities, an expert on Lithuanian and Russian law, the discoverer and publisher of invaluable sources, codifier of municipal law, and translator and bibliographer of the Statutes of Lithuania, fully deserves the admiration of his contemporaries and the memory of posterity. The fate of Daniłowicz’s manuscript legacy is not known. In particular, it is unknown whether the scholar really left an extensive manuscript on the history of Lithuania, as certain sources would seem to suggest. There is no doubt that Daniłowicz lost some of his manuscripts when moving from Moscow to Kiev. After Daniłowicz’s death, the Russian historian Mikhail P. Pogodin was interested in the acquisition of his surviving papers, but his efforts proved unsuccessful. Some of Daniłowicz’s manuscripts had come into the hands of the Polish researchers and collectors Eustachy Tyszkiewicz and Konstanty Świdziński. One example is a document from 1846 preserved among Mikołaj Malinowski’s papers in the Kórnicka Library. Malinowski apparently mediated in the transfer of the Daniłowicz legacy between Świdziński and Tyszkiewicz. The materials submitted to Tyszkiewicz are kept in eight files and cover a total of several hundred pages, and are probably the basis for the publication a few years after Daniłowicz’s death of the famous “Diplomats’ Treasury”.

THE LIABILITY OF THE ‘AGRIMENSORES’ AND SURVEYORS’ LIABILITYSummaryThe agrimensores played an important role in the society of ancien Rome. They were highly respected for their technical skills and knowledge of mathematics. The grounds for the liability of the agrimensores were material damage caused intentionally by surveyor (dolus) and intent to deceive (fallere). An agrimensor was not liable for damage caused as a result of lack of knowledge or experience (imperitia). If several agrimensores onducted the surveying activities they were jointly liable (in solidum), regardless of their individual contribution to the damage. This type of liability could not be used when it was not possible to assign blame to one of the agrimensores. An agrimensor who had a slave to do the measuring held the liability and could not resort to noxal responsibility. Noxal responsibility could be applied if the shoddy work had been performed by a slave; in such cases the party suffering the damage could obtain dominion over the slave who had caused it or receive full compensation from the slave’s owner. The injured party could seek compensation on the grounds of a praetorian actio in factum. The injured party and his heirs had the right to submit a claim, which was subsidiary and therefore penal in nature, which meant it could not be brought against the heirs of the perpetrators. Actio in factum was used as an actio utilis and actio ad exemplum in other similar cases in surveying activities, such as when measuring wine or grain. Nowadays a surveyor’s liability is civil, criminal, administrative or disciplinary. The first two types are important when a specific injury or offence occurs. In such cases only a surveyor who carried out the surveying or cartographic activities on his own is liable. The study shows that, despite some similarities, there are differences between the liabilities of Roman agrimensores and of modern surveyors. Roman law used a system of praetorian civil liability which was penal in character, while today we have a stratified system of liability of up to four separate levels, where the injured party may use only one or submit a cumulative claim, seeking civil damages, and claiming punishment for the perpetrators under criminal law and/or disciplinary proceedings.

ROMAN REGULATIONS CONCERNING ‘INIURIA’ AND PROTECTION OF HONOUR AND REPUTATION IN POLISH CRIMINAL LAWSummaryThe aim of this article is to compare and contrast Roman and Polish criminal regulations concerning protection of an individual’s honour and reputation in two different areas: objects of legal protection, and forms of conduct liable to prosecution and providing grounds for legal action. Considerable differences may be observed between these two legal systems on both counts. While in Roman law any and every defamatory act, regardless of its form, gave rise to iniuria, Polish penal law divides non-physical acts against honour and reputation into two separate categories: pomówienie (defamation and/or slander), and zniewaga (insult). This distinction is based on the criterion of the object of legal protection: pomówienie is an attack on an individual’s reputation, while zniewaga is an attack on his dignity. The types of punishable conduct are different as well; as regards pomówienie only verbalised attacks are liable to prosecution as offences against reputation. Analysis of this matter leads to the conclusion that the distinction made in Polish criminal law for offences against honour and reputation into two different categories in consequence of the recognition of two separate objects of protection against non-physical attacks may not be the best solution.

SELECTED ASPECTS OF THE INTERRELATIONSHIP BETWEEN CHURCH, STATE, RELIGION, AND THE LAW IN THE UNITED STATESSummaryThe United States is a secular state which at the same time puts religion and its institutions at the centre of its legal and constitutional considerations. This situation leads to frequent tension between state institutions and the followers of different religions, whose religious requirements or prohibitions come into conflict with the uniform legal standards. The classic examples of this include Mormon polygamy, which Mormons consider a condition of salvation, but which has been found unconstitutional; and the use of legally prohibited drugs by the followers of Indian religions during their religious ceremonies. Recognition of the needs of worshippers in the latter case shows that over time the U.S. authorities have tended more and more to acknowledge the need to take into account the specific requirements of the non-mainstream religious institutions. Another specific feature of the U.S. system of constitutional law is that as a rule such discrepancies are settled not by Congress but by the Supreme Court, although the two institutions have been known to make conflicting decisions on the same issue. The article is also a review of judicial decisions and legislative acts on controversial issues like abortion, the admissibility of the use of stem cells, same-sex marriages, and conscientious objection to military service.

PROHIBITION OF ‘REFORMATIO IN PEIUS’ IN POLISH CIVIL PROCEDURE IN THE LIGHT OF THE TRADITION OF ROMAN LAWSummaryThe subject of this paper is an assessment of the influence of Roman law on the contemporary regulations for appeal in Polish civil procedurę as regards the prohibition of reformatio in peius. The author’s analysis shows that despite the general belief that the ban on the worsening of the appellant’s situation in the event of the opposite party failing to lodge an appeal derives from Roman roots, in fact when used in the context of the way in which Polish appeal courts deliver a verdict, the expression reformatio in peius is nothing more than an artificial legal concept derived from Latin.

‘Superficies’: The Roman Origins Of The Right To Build Upon A Plot Of LandSummaryThe aim of this paper is to present the Roman origin of the right of superficies (the right to erect a building on a plot of land), which is thesubject of a bill drafted by the Polish Civil Law Codification Committee. This right is to replace the institution of perpetual usufruct, which has been extant in Polish civil law since the 1960s. Superficies has been present in many European systems of law (for example in the Bürgerliches Gesetzbuch German Civil Code of 1896, and the Austrian law of 1919). The author compares the subject and object of the right in question, the legal situation of the superficiarius and the rights of the owner of the land in Roman law and in the Polish draft bill. The main difference between the Roman superficies and the right proposed in the draft bill is the deviation from the principle of accession (superficies solo cedit): under the Polish draft bill the superficiarius will become the owner of the building. Furthermore, the Roman superficies was perpetual; in Poland it will be constructed as temporary (30-100 years). Both rights (in Roman and Polish law) share many other similarities: they are hereditary, and the superficiarius is to pay the owner of the land. The conclusion which may be drawn is that Roman institutions can still inspire the contemporary legislator.

Polish Romanists' Research Work, 2011-2013SummaryA look at the research done by Polish Romanists in the 21st century and its effects in the form of publications and progress on the academic ladder confirms the claim that Poland continues to be one of the leading countries for scholarship in Roman law. In the first decade of the century four Polish scholars of Roman law were appointed to full professorships, seven gained their post-doctoral habilitation degrees, and forty-five were awarded the doctor’s degree. The figures for the past three and a half years are respectively four professorships (with a further two waiting for the formality of the President’s signature on the appointment), eight habilitations, and twelve doctorates. A characteristic feature marking recent years has been an unprecedented number of translations (into Polish) of source texts, usually accompanied by an extensive commentary. The main achievement in this area has been the translation of the Digests by a team of lawyers and linguists. Alongside the publication of source texts and collective volumes, the past years have also seen the issue of thirty-three monographs and hundreds of articles on a variety of subjects, but one of the characteristic features has been an unprecedented interest in public law, especially criminal law, which has given rise to eight monographs in three years. Unfortunately, certain tendencies have given cause for concern, as quantity is not always tantamount to quality. A lot of articles do not come up to the required standard and call for improvement as regards references and recent literature (especially Polish publications) cited, writing style, and a more critical approach to their subject. Many articles offer an oversimplified comparison of a contemporary legal institution with aspects of Roman law. Occasionally suggestions are made that only subjects which are directly related to today’s issues should be addressed. Time will tell whether this is the right attitude to take.

Presidential clemency is also the least appreciated and most misunderstood of presidential powers – the Constitutionplaces no limits on the way the President exercises his power to pardon,except in cases of impeachment.The article gives a historical overview of the power of clemency in theU.S. Constitution. It also examines the evolution of the Supreme Court’sviews on clemency over the years, both substantively and procedurally,and how the Court has interpreted the power to grant pardons, conditional pardons, as well as amnesties, commutations of sentence, remissions of fines and forfeitures, and respites. Henryk Kupiszewski’s Vision of Roman LawSummaryThis article is an extended version of the author’s paper delivered atthe International Conference held at the University of Warsaw to commemorate the twentieth anniversary of the death of Professor HenrykKupiszewski. The author presents the biography and academic developments in the life of Kupiszewski, a student of Wacław Osuchowski, Rafał Taubenschlag, and Max Kaser. He then goes on to discussKupiszewski’s main research interests. Starting with papyrology forthe legal sciences, Kupiszewski moved on to research on the internalhistory of classical Roman law and finally to the study of the impact ofRoman law on contemporary law and legal culture. The author also recalls Kupiszewski’s work in international co-operation in scholarshipand for the Polish diplomatic service as ambassador to the Vatican.
